11:03 AM -- Senate Bill 10-114

Representative Weissmann, prime sponsor, presented Senate Bill 10-014, concerning the "Colorado Taxpayer Transparency Act of 2010." Representative Weissmann discussed action taken on the bill in the Senate, and explained the effect of the legislation. Discussion ensued regarding forthcoming amendments to the bill. Representative Weissmann responded to questions regarding the need for the legislation, and the process by which certain information would be obtained under the bill from private entities contracting with state government. Representative Weissmann responded to further questions regarding the ability of government agencies to request disclosure of contracting information covered by the bill under current law, and clarified the effect of Senate Bill 10-014 on the public's ability to access such information. Discussion ensued regarding the burden for showing that government procurement law is being properly followed.

Representative Weissmann responded to questions regarding the ability of the public to file a request against a private entity under the Colorado Open Records Act (CORA), and the fiscal impact of Senate Bill 10-114, considering a number of forthcoming amendments. Discussion ensued regarding how CORA requests for government contracts would be honored under the bill.

Ms. Sheryle Hutter, representing the Colorado Cross-Disability Coalition and the Equal Justice Foundation, testified in favor of the bill. Ms. Hutter discussed the importance of transparency for all public contracting, and explained that her organization has submitted numerous CORA requests that were denied under existing law.

Mr. John Nevins, representing the Imagine Community Centered Board, spoke in favor of forthcoming amendment L.018. Discussion ensued regarding the effect of the amendment.

Mr. Greg Romberg, representing the Colorado Press Association and the Colorado Broadcaster's Association, testified in favor of Senate Bill 10-114. Mr. Romberg discussed the forthcoming amendments to the bill, and the applicability of CORA when a private entity assumes administration of a public function through contracting. Discussion returned to the effect of amendment L.018.

Mr. Jeff Weist, representing Associated General Contractors and Associated Plumbing Contractors, testified regarding Senate Bill 10-114 from a neutral position. Mr. Weist discussed the process that went into drafting the language in amendment L.019, and urged adoption of the amendment. Mr. Weist responded to questions regarding the need for the amendment, and the potential for proprietary information to be released through a CORA request under the bill.
