04:41 PM -- Senate Bill 12-132

Representative Becker, bill sponsor, presented Senate Bill 12-132, concerning timely issuance of environmental control permits. Under current law, renewable operating permits for air emissions must be approved or denied by the Air Pollution Control Division (APCD) of the Colorado Department of Public Health and Environment (CDPHE) within 18 months after receipt of a complete application. For water quality permits in the Colorado Discharge Permit System (CDPS), administered by the Water Quality Control Division (WQCD) of CDPHE, an application must be approved or denied within 180 days (6 months) of receipt of the application. However, the deadline for CDPS permit action may be extended for specified reasons, including correspondence regarding completeness of the application and the undertaking of public meetings to receive input from interested persons. Under current law, applicants for certain air permits are authorized to hire third-party private contractors for permit review functions.

Will Allison, Colorado Department of Public Health and Environment, discussed the different types of air permits issued by the department. Mr. Allison answered questions from the committee about the number of air quality permits that have been issued annually.

Representative Swalm, bill sponsor, presented HB 12-1309 concerning the requirement that all employers in the state verify the work eligibility status of new employees through the federal electronic verification program, and discussed the testimony that was heard in the House Committee on Economic and Business Development. The bill repeals the current requirements for employers to verify the legal work status of new employees and creates the Colorado Mandatory E-Verify Act.

05:14 PM -- Senate Bill 12-129

Representative Coram, bill sponsor, presented Senate Bill 12-129, which requires the Office of Information Technology (OIT) and the Public Utilities Commission (PUC) to create a geographic database that identifies areas of the state without access to broadband services (e.g., high-speed internet). In addition, with no specific deadline, the OIT must complete a map of existing broadband assets owned by the state. The OIT may organize an advisory panel to make recommendations concerning the need for subsidies or other support mechanisms to develop broadband access in unserved areas of the state.

Stephen Merrill, American Association of Retired Persons (AARP), spoke in support of the mapping requirements in the bill in order to understand areas in the state that are not able to access broadband services. He also expressed concerns with the stakeholder groups represented in the bill.

Wendall Pryor, Chaffee County Economic Development Corporation, spoke in support of the bill and discussed how the bill will help underserved areas of the state obtain broadband access. Mr. Pryor answered questions from the committee.

Representative Sonnenberg, bill sponsor, presented Senate Bill 12-169, concerning the administration of county powers to maintain the landscape. This bill removes the $5,000 annual cap that a county can request from a property owner in reimbursement for control of a pest infestation or infection on private property. The bill also authorizes county pest inspectors to exercise the same powers granted counties to control noxious weeds, rodents and predatory animals.
