Representative McNulty, prime sponsor, presented House Bill 10-1143, concerning the authority of the Regional Transportation District (RTD) to enter into agreements permitting specified uses at its transfer facilities. Representative McNulty talked about development surround transportation centers and explained that under existing law, RTD may negotiate and enter into agreements with any person or public entity for the provision of retail and commercial goods and services to the public at transfer facilities. The bill would permit RTD to negotiate and enter into similar agreements for the provision of residential and other uses at transfer facilities, so long as such uses are consistent with local planning and zoning laws. The bill also requires services to be conducted in a manner that encourages multimodal access for all users, and eliminates a provision prohibiting agreements if they create a competitive disadvantage for nearby businesses.

Barbara Steinmeyer, representing herself, testified against the bill and submitted her written comments to the committee (Attachment E). Ms. Steinmeyer responded to questions from the committee concerning property owned by RTD that does not serve a public purpose.

Allan Ferguson, representing himself, testified against the bill and talked about the misuse of property management surrounding RTD transfer facilities. Mr. Ferguson addressed questions from the committee concerning voters within RTD supporting the expansion and funding of the RTD light rail system. Mr. Ferguson explained that RTD should not be in the business of developing commercial, retail, and residential development surrounding light rail stations.

Diane Barret, Special Assistant for Transportation and Development, City and County of Denver, testified in support of the bill, talked about the light rail development throughout RTD, and discussed the need to add the authority for residential development at RTD stations.

Kent Bagley, Regional Transportation District, testified in support of the bill and talked about the amount of support from surrounding cities throughout RTD for lightrail development and the expansion of uses at transportation facilities. Mr. Bagley discussed the need for the bill, which provides a wider range of uses at RTD stations and explained that property is leased or sold by RTD to developers for commercial, residential, and retail uses. Mr. Bagley addressed questions from the committee concerning private-public partnerships for mixed-use development at transportation facilities.

Robin Kniech, representing FRESC: Good Jobs, Strong Community, and Karen Lado, representing Housing Colorado and Enterprise Community Partners, testified in support of the bill and distributed a study to the committee concerning affordable housing at transit centers (Attachment F). Ms. Lado discussed the importance of developing land near transit centers and the need to expand RTD's authority to develop residential property for lower-and medium-income workers.

Nancy Sharpe, Mayor, City of Greenwood Village, testified in support of the bill, talked about light rail centers in the City of Greenwood Village, and explained that the need to provides the option of residential development at RTD transfer facilities. She talked about importance of having mixed-uses surrounding transit centers and explained that local governments have oversight of RTD centers through planning and zoning regulations.

Bob Moody, Executive Vice-President, NAIOP: Commercial Real Estate Development Association, testified in support of the bill and explained the importance of allowing residential development as well as commercial and retail development at light rail centers. Mr. Moody addressed questions from the committee concerning smart growth and mixed-use development surrounding light rail stations.

Bill Sirois, Regional Transportation District, addressed the committee to respond to questions. Mr. Sirois discussed a specific commercial development surrounding a light rail station where the development has stalled. He also addressed questions from the committee, explained that the bill addresses property owned by RTD, and discussed the process when RTD takes land.
