101 CONCERNING PROHIBITION OF THE PURCHASE OF FIREARMS BY PERSONS
102 ON BEHALF OF OTHER PERSONS WHO ARE INELIGIBLE TO PURCHASE
103 FIREARMS.
Bill Summary

Makes it a class 1 misdemeanor for a person to purchase a firearm
on behalf of or for transfer to a person who is ineligible to possess a
firearm or to purchase a firearm in this state. Requires firearms sellers to
post a sign informing the public of the prohibition.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. Article 12 of title 18, Colorado Revised Statutes,
3 is amended BY THE ADDITION OF A NEW SECTION to read:
4 18-12-111. Unlawful purchase of firearms. (1) ANY PERSON
5 WHO KNOWINGLY PURCHASES OR OTHERWISE OBTAINS A FIREARM ON
6 BEHALF OF OR FOR TRANSFER TO A PERSON WHO IS INELIGIBLE TO POSSESS
7 A FIREARM PURSUANT TO FEDERAL OR STATE LAW OR INELIGIBLE TO
8 PURCHASE A FIREARM IN THIS STATE COMMITS A CLASS 1 MISDEMEANOR.
9 (2) ANY PERSON WHO IS A LICENSED FIREARM DEALER, AS DEFINED

1 IN 18 U.S.C. SEC. 921 (a) (21), SHALL POST A SIGN DISPLAYING THE
2 PROVISIONS OF SUBSECTION (1) OF THIS SECTION IN A MANNER THAT IS
3 EASILY READABLE. THE PERSON SHALL POST SUCH SIGN IN AN AREA THAT
4 IS VISIBLE TO THE PUBLIC AT EACH LOCATION FROM WHICH THE PERSON
5 SELLS FIREARMS TO THE GENERAL PUBLIC.
6 SECTION 2. Effective date - applicability. This act shall take
7 effect July 1, 1999, and shall apply to offenses committed on or after said
8 date.
9 SECTION 3. Safety clause. The general assembly hereby finds,
10 determines, and declares that this act is necessary for the immediate
11 preservation of the public peace, health, and safety.
