The bill allows a public school educator to opt in or opt out of his or her membership in a labor organization at any time. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add 22-63-105 as follows: 22-63-105. Membership in union - definitions. (1) (a) An educator may join or terminate membership in a labor organization at any time. A labor organization or employer may not place a restriction on the time that an educator may join or terminate membership in a labor organization. (b) As used in this section, unless the context otherwise requires: (I) "Educator" means a person employed in a school district or a public school as defined in section 22-1-101. (II) "Labor organization" means a lawful organization that is composed of educators and that exists for the purpose of dealing with employers concerning grievances, labor disputes, wages, rates of pay, hours of employment, or other terms and conditions of employment. "Labor organization" includes a labor union exempt from taxation pursuant to section 501 (c)(5) of the federal "Internal Revenue Code of 1986", as amended, and a professional employee association exempt from taxation pursuant to section 501 (c)(6) of the federal "Internal Revenue Code of 1986", as amended. SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
