SENATE BILL 13-120 BY SENATOR(S) Harvey, Baumgardner, Cadman, King, Lundberg, Marble, Crowder, Guzman, Heath, Johnston, Kerr, Lambert, Newell, Roberts, Scheffel, Tochtrop, Todd, Morse; also REPRESENTATIVE(S) Garcia, Duran, Ginal, Lebsock, Mitsch Bush, Pabon, Priola, Rosenthal, Ryden, Salazar, Schafer, Young. Concerning the creation of a Navy SEAL license plate, and, in connection therewith, making an appropriation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, 42-3-213, add (1) (a) (XXV) and (26) as follows: 42-3-213. Special plates - military veterans - rules - retirement. (1) (a) The department shall issue one or more sets of special license plates to the following persons who own a truck that does not exceed sixteen thousand pounds empty weight, a passenger car, a motorcycle, or a noncommercial or recreational vehicle: (XXV) An honorably discharged, retired, reserve, or active member of the Navy SEALs. (26) Honorably discharged, retired veteran, or active member of the Navy SEALs. (a) The department shall design the Navy SEAL license plate to indicate that an owner of a motor vehicle to which the plate is attached is a veteran, a reserve member, or an active member of the United States Navy SEALs. (b) A natural person who has received an honorable discharge, is retired, or is an active or reserve member of the United States Navy SEALs may use a United States Navy SEALs license plate. To qualify for the license plate, an applicant must submit a DD214 form issued by the United States government and a certification from the UDT/SEAL association, inc., the Rocky Mountain chapter of the UDT/SEAL association, inc., or a successor organization, that the applicant has an honorable discharge from, is retired from, or is currently an active or reserve member of the Navy SEALs. SECTION 2. Appropriation. (1) In addition to any other appropriation, there is hereby appropriated, out of any moneys in the license plate cash fund created in section 42-3-301 (1) (b), Colorado Revised Statutes, not otherwise appropriated, to the department of revenue, for the fiscal year beginning July 1, 2013, the sum of $355, or so much thereof as may be necessary, to be allocated to the division of motor vehicles for the purchase of special license plates related to this act. (2) In addition to any other appropriation, there is hereby appropriated, out of any moneys in the Colorado state titling and registration account in the highway users tax fund created in section 42-1-211 (2), Colorado Revised Statutes, not otherwise appropriated, to the department of revenue, for the fiscal year beginning July 1, 2013, the sum of $2,960, or so much thereof as may be necessary, to be allocated to the information technology division for the purchase of computer center services related to this act. (3) In addition to any other appropriation, there is hereby appropriated to the governor - lieutenant governor - state planning and budgeting, for the fiscal year beginning July 1, 2013, the sum of $2,960, or so much thereof as may be necessary, for allocation to the office of information technology, for the provision of computer center services for the department of revenue related to the implementation of this act. Said sum is from reappropriated funds received from the department of revenue out of the appropriation made in subsection (2) of this section. SECTION 3. Act subject to petition - effective date - applicability. (1) This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly (August 7, 2013, if adjournment sine die is on May 8, 2013); except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2014 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. (2) This act applies to license plate applications issued on or after January 1, 2014. ____________________________ ____________________________ John P.
