Mr. Al Kolwicz, representing the Colorado Voter Group, provided testimony regarding widespread corruption in Colorado's election system. Commission members received copies of an e-mail circulated by Mr. Kolwicz to the commissioners (Attachment A).

Ms. Mary Eberle, representing Coloradans for Voting Integrity, testified. Ms. Eberle referenced comments forwarded to the commission by Mr. Harvie Branscomb (Attachment B). Ms. Eberle testified against a subcommittee recommendation to allow continued use of unauditable direct recording electronic (DRE) voting machines.

Ms. Jenny Flanagan, representing a coalition of groups calling itself Colorado Election Advocacy Organizations, provided testimony regarding the subcommittee recommendations. Ms. Flanagan detailed the coalition's position on each of the action items recommended by the Registration and Database Subcommittee to be considered by the commission. Ms. Flanagan's testimony relied upon a document detailing the coalition's positions on the commission's action items, copies of which were distributed to the commission members (Attachment C). Ms. Flanagan responded to questions regarding a recommendation by the Registration and Database Subcommittee to allow the statewide Colorado voter registration database (SCORE) to be expanded to allow for verification of social security numbers.

Ms. Flanagan responded to questions regarding the frequency with which provisional ballots are used based on missing information from a voter registration drive, and redesigning the voter registration form. Ms. Flanagan detailed Common Cause's position on each of the Technology and Auditing Subcommittee's recommendations. Ms. Flanagan responded to questions regarding Common Cause's position on the use of paper ballots versus DREs, and the subcommittee's recommendations regarding voting system certification.

Ms. Flanagan continued to discuss the Technology and Auditing Subcommittee's recommendations regarding voting system certification, and the use of ballot marking devices to accommodate certain populations of disabled voters. Discussion returned to Common Cause's position on the use of DREs in elections, and the impact of their use on election integrity during the 2008 election. Discussion followed regarding the potential for subdividing certain Technology and Auditing Subcommittee recommendations into several action items. Ms. Flanagan returned to briefing the committee on Common Cause's positions, moving on to the recommendations of the Uniformity and Simplification Subcommittee. Ms. Flanagan then discussed additional recommendations that Common Cause feels are important.

Mr. Joel Leventhal, representing himself, testified before the commission. Mr. Leventhal discussed his background in elections, and endorsed recommendations forwarded to the commission by Mr. Harvie Branscomb. Mr. Leventhal expressed support for paper balloting, and detailed the benefits of using this method of voting versus using DREs. Mr. Leventhal used examples from the 2008 election to support his preference for paper balloting, and discussed the importance of offering choices of voting methods in elections.
