09:50 AM -- House Bill 09-1161

Representative Baumgardner presented House Bill 1161 concerning a reduction in the time to provide written documentation supporting an oil and gas valuation statement. The bill reduces the time that an oil and gas operator or owner has to submit written documentation supporting a valuation statement to a county assessor from 45 to 30 days. Representative Baumgardner indicated that the bill has been agreed to by the oil and gas industry. Amendment L.003 was provided to the committee (Attachment A) to be offered at the appropriate time.

Patrick Boyle, Colorado Assessor's Association, testified in favor of the bill. He began by explaining that assessors are officers who value property for property tax purposes. Every other year, he said that assessors value real property and that personal property is evaluated annually. The allotted timelines are fairly restrictive because the focus has been on real property valuations. However, he noted that in oil and gas counties where there is a lot of production, the property is subject to an annual assessment. He testified that this bill provides additional time for assessors to gather the information they need to provide a notice of valuation to the taxpayer. He also said that he supported amendment L. 003 because it ensures that the taxpayer is neither discouraged from filing their schedule early nor punished from doing so, ensuring that assessors have all the information they need within the time constraints. Mr. Boyle answered questions from the committee concerning raising the fines assessed by assessors against an owner or operator. Mr. Boyle stated that the fine would not be much of a deterrent to a big company but would have a large impact on smaller companies. He indicated that the Assessor's Association had not considered raising the fines.

Travis Holland, a property tax accountant on behalf of the Colorado Petroleum Association and the Colorado Oil and Gas Association, testified in support of the bill. He commented that the associations member companies recognize that assessors may need additional time to gather the information they need to determine the value of oil and gas companies production and facilities. He indicated that reducing the number of days taxpayers have to respond is a reasonable compromise. He also indicated that both associations support the amendment.
