Senator White presented House Bill 09-1141. The bill modifies several provisions related to the Uniform Consumer Credit Code (UCCC) and the fees charged by the UCCC administrator. Senator White distributed a memorandum pertaining to the bill (Attachment A).

Laura Udis, the First Assistant Attorney General in the Consumer Credit Unit of the Attorney General's office, testified in favor of the bill. She explained the changes made by the bill. She discussed portions of the bill pertaining to consumer protection and to the fee structure. She addressed how the bill would affect the funding for the Uniform Consumer Credit Code Cash Fund.

01:48 PM -- House Bill 09-1109

Senator Veiga presented House Bill 09-1109. The bill amends the definition of a "residence in foreclosure" to include a dwelling that is encumbered by a residential mortgage loan that is delinquent or in default. In addition to properties for which a foreclosure action has commenced, a "residence in foreclosure" can include a residence upon which a foreclosure action is authorized under the terms of the loan. Senator Veiga distributed prepared Amendment L.003 (Attachment B). She explained the bill and the amendment.

Jan Zavislan, Deputy Attorney General for Consumer Protection, testified in support of the bill. He described the Colorado Foreclosure Protection Act. He discussed investigations that the Attorney General's office has conducted under the act and described the protections that House Bill 09-1109 would extend. He explained prepared Amendment L.003.
