01:43 PM -- House Bill 09-1284

Senator Williams, prime sponsor, presented House Bill 09-1284, concerning corridor capacity strategic planning to foster transportation efficiency. House Bill 09-1284 was on the committee's calendar for action only. Testimony on House Bill 09-1284 was heard by the committee on April 14, 2009. Senator Williams said that the bill will put in place a high standard of collaboration among entities involved in land use planning. She described potential amendments to House Bill 09-1284.

Tim Leonard, representing Deepwater Point Company, Inc. said that he is a land developer, and that he supports a proposed amendment to the bill, L.012 (Attachment A). He commented on some concerns he has with House Bill 09-1284. He questioned whether the Colorado Department of Transportation (CDOT) will be able to perform duties assigned in the bill with the minimal resources that are anticipated in the fiscal note for House Bill 09-1284. Senator Williams said that CDOT is currently performing many of the duties assigned in the bill, and that this explains the relatively minor appropriation that is needed.

Melissa Nelson, representing the Colorado Department of Transportation, noted that a program that was originally in the bill and drove costs was removed. She said that CDOT is neutral on the bill.

02:13 PM -- House Bill 09-1318

Senator Brophy, prime sponsor, presented House Bill 09-1318, concerning the issuance of overweight permits based on axle configuration for vehicles weighing more than the eighty-five thousand pound nonoverweight vehicle gross vehicle weight limit. He said that the bill will modify the permitting requirements and fees charged for certain overweight vehicles, and permit weight to be distributed over more wheels on tractor trailers. He noted that this greater weight distribution will help to preserve Colorado highways.

Melissa Nelson, representing the Colorado Department of Transportation, explained that House Bill 09-1318 creates a permit allowing the use of "triple-axles" by motor carriers allowing them to carry heavier loads.

02:21 PM -- House Bill 09-1322

Senator Schwartz, prime sponsor, presented House Bill 09-1322, concerning access by motor vehicle repair shops to an electronic system implemented by the Department of Revenue for purposes of determining ownership and lienholders of motor vehicles abandoned at motor vehicle repair shops. She said that the bill is a technical cleanup of statutes that were adopted at the prior legislative session.

Maren Rubino, representing the Titles and Registration Section, Colorado Department of Revenue, explained that a provision was inadvertently left out of legislation on this subject adopted during the 2008 legislative session and that the bill will facilitate identification of vehicle owners and lienholders by motor vehicle repair shops.
