12:35 PM -- House Bill 09-1355 - Concerning the Sales and Use Tax Exemption for Purchases of Food Through Vending Machines


Representative Pommer and Representative Ferrandino, prime sponsors, briefly discussed the provisions in the bill.

The following person testified.

12:41 PM -- Mr. Phillip Horowitz, Department of Revenue, responded to committee questions and commented that the price of a product sold in a vending machine is unlikely to change because the additional tax added by the removal of the exemption in the bill is minimal. The committee discussed whether the repeal of the exemption would result in any auditing concerns or expenses for the department. Mr. Horowitz responded by saying that the bill would not affect the department's audit selection process.
