Senator Sandoval, prime sponsor, presented Senate Bill 09-283, concerning the use of redaction software by the Secretary of State to redact taxpayer identification numbers from secured transaction records filed with the Secretary of State.

Cathy Krendel, Denver, representing herself, said that the Business Division of the Colorado Department of State works very well due to its employment of electronic filing. She noted that it is possible to start a new company in Colorado in under five minutes through electronic filing with the Secretary of State. She spoke of situations in which social security numbers remain in documents filed with the Secretary of State from prior years. She said that Senate Bill 09-283 allows the Secretary to redact these social security numbers.

Tony van Westrum, representing the Colorado Bar Association, commented on the process of redaction of information to protect against identity theft. He commented on situations in which it is useful to have identifying information.

Bernie Buescher, Colorado Secretary of State, said that Senate Bill 09-283 was initiated by the Department of State. He said that Senate Bill 09-283 provides a reasonable balance that is satisfactory to privacy advocates. He noted that the department has tested redaction software and said that the department does not currently have explicit authority to conduct such redactions.
