04:24 PM -- House Bill 09-1048

Representative Riesberg called the committee to order. He pointed out an error in the fiscal note stating the it incorrectly says that the bill would require a majority of the voting membership on a board or commission that oversees programs affecting persons with disabilities be a representative of the disability population. He stated that the bill requires that each board or commission that oversees programs affecting persons with disabilities have a representative from the disability population, but not necessarily a majority of the voting membership. Representative Labuda concurred with Representative Riesberg. She stated that the fiscal note states that the bill mandates that a "majority of the voting membership be disabled", but as Representative Riesberg pointed out, the fiscal note is incorrect.

Representative Gerou stated that she googled each of the boards listed in the fiscal note that would be affected by the bill and stated that they already have representatives from the disabled community. Representative Labuda stated that the bill will provide standard language in the law.

Sheryle Hutter, Policy Analyst, Developmentally Disabled Council (DDC), testified in support of the bill. Ms. Hutter stated there are several boards, such as the Colorado Commission on Criminal and Juvenile Justice or the Job Creation and Economic Growth committee, do not have a representative from the disabled community on it. Representative Kefalas asked what the intent of the bill was and stated that the boards she mentioned would not be impacted by this legislation. Ms. Hutter stated that the intent of the bill is a starting point to get to requiring that all boards and commissions have a representative from the disabled community.

Marcia Tewell, Executive Director, Developmentally Disability Council, testified in support of the bill. Ms. Tewell provided a handout to the committee in support of the bill (Attachment A). A letter in support of the bill from Dr. Irene Aguilar was provided to the committee (Attachment B). A committee member asked if accommodations would be required for individuals with disabilities in order to comply with the federal Americans Disability Act, such as transportation to and from board meetings. Ms. Tewell stated that accommodations are required for those who may need it.

Sheila Hicks, Colorado Cross Disability Coalition, testified in support of the bill. She stated that people with disabilities have good ideas and they would like to have input.

05:02 PM -- House Bill 09-1023

Representative Swalm and Representative Gagliardi introduced HB 09-1023 which authorizes individuals between the ages of 16 and 18 to provide legal consent in order to donate blood, provided that the individual's parent or legal guardian also consents to the donation.

Jane Ritter, Office of Legislative Legal Services, explained "disaffirmance because of minority" from page 2, line 11 to the committee. There was some discussion between the committee and Ms. Ritter regarding the explanation.

Mallary Hicks, student, testified in support of the bill. She stated she is a student blood drive coordinator for Bonfils. She stated she felt conflicted because she was unable to donate blood due to her age, but encouraged others too.

Connor Randall, student, testified in support of the bill. Mr. Randall stated he attends high school student in Arvada, Colorado. He stated that he was given a blood transfer in 1992 when he had a heart transplant. He stated there is a need for blood donors and this bill would allow his friends to donate blood.

Thomas Puckett, Bonfils Blood Center, testified in support of the bill. He stated that by allowing young people to donate blood with their parents consent will help engage more young people to be civilly involved. Mr. Puckett spoke to the need for blood donations and the need to expand the potential donors. Mr. Puckett provided a letter from the Chief Medical and Scientific Officer of Bonfils Blood Center in support of the legislation (Attachment E). Mr. Puckett spoke to the decision to pick 16 years of age as the cut off point for donors.

Kadi Schroeder, Directory Ancillary Services, Bonfils Blood Center, testified in support of the bill. She spoke to a variety of high school blood drives and their success. She spoke to the potential increase in blood donations and how many individuals may benefit from the new blood donations. Ms. Schroeder spoke to the volunteerism that will be fostered among young people by this bill.

05:31 PM -- House Bill 09-1025

Representative Riesberg introduced House Bill 09-1025 which came out of the Health Care Task Force. Representative Riesberg stated that the people who inspect hospital-acquired diseases are in high demand and that in order for these people to keep their certification, they work in larger facilities. The reason these individuals work in large facilities is because they can maintain their certification in these places. He stated the witness will speak to this more in testimony. Representative Riesberg stated that the bill exempts ambulatory surgical centers (ASCs) and certified dialysis treatment centers from this requirement due to the size. He stated that under current law, individuals who collect data on hospital-acquired infection rates for hospitals with 50 or fewer beds are not required to have national certification. Representative Riesberg stated that ASCs already report on their own. He continued by saying that the problem is not with regard to data collection, but that there are not enough people in the state that meet the certification for the infectious-disease requirements.

Debbie Teetzel, Colorado Ambulatory Surgical Center Association, testified in support of the bill. Ms. Teetzel provided background information to the committee on what ASCs currently report on. She stated that the state has about 85 nurses currently certified. She pointed out a three page check-list which is required of the nurse to maintain his or her certification. She stated that most nurses do not have the opportunity to meet several of the requirements at an ASCs due to their size. She reassured the committee that they have their own infection control procedures. She also noted that prior to the bill being passed last year which required the hospital-acquired infection inspections, three was no reporting and ASCs still maintained a very low infection rate.
