Representative Riesberg called the committee to order. He pointed out an error in the fiscal note stating the it incorrectly says that the bill would require a majority of the voting membership on a board or commission that oversees programs affecting persons with disabilities be a representative of the disability population. He stated that the bill requires that each board or commission that oversees programs affecting persons with disabilities have a representative from the disability population, but not necessarily a majority of the voting membership. Representative Labuda concurred with Representative Riesberg. She stated that the fiscal note states that the bill mandates that a "majority of the voting membership be disabled", but as Representative Riesberg pointed out, the fiscal note is incorrect.

Representative Gerou stated that she googled each of the boards listed in the fiscal note that would be affected by the bill and stated that they already have representatives from the disabled community. Representative Labuda stated that the bill will provide standard language in the law.

Sheryle Hutter, Policy Analyst, Developmentally Disabled Council (DDC), testified in support of the bill. Ms. Hutter stated there are several boards, such as the Colorado Commission on Criminal and Juvenile Justice or the Job Creation and Economic Growth committee, do not have a representative from the disabled community on it. Representative Kefalas asked what the intent of the bill was and stated that the boards she mentioned would not be impacted by this legislation. Ms. Hutter stated that the intent of the bill is a starting point to get to requiring that all boards and commissions have a representative from the disabled community.

Marcia Tewell, Executive Director, Developmentally Disability Council, testified in support of the bill. Ms. Tewell provided a handout to the committee in support of the bill (Attachment A). A letter in support of the bill from Dr. Irene Aguilar was provided to the committee (Attachment B). A committee member asked if accommodations would be required for individuals with disabilities in order to comply with the federal Americans Disability Act, such as transportation to and from board meetings. Ms. Tewell stated that accommodations are required for those who may need it.

Sheila Hicks, Colorado Cross Disability Coalition, testified in support of the bill. She stated that people with disabilities have good ideas and they would like to have input.
