Senator Penry explained the justification for making the changes that were made in the Senate. He stated that there was plenty of disagreement about the death penalty issue, while there was consensus on the issue of greater funding for cold case investigations. Representative Weissmann asked why the Senate chose to fund cold case investigation at the local level rather than the statewide CBI unit. Senator Penry indicated that law enforcement officials believe that funding the investigations at the local level is more effective and ultimately results in more crimes solved.

Senator Carroll discussed the nexus between the surcharges and the investigation of cold cases. The committee talked about the savings that would likely occur through a repeal of the death penalty. They discussed the savings specific to the Office of the State Public Defender.

Senator Penry stated his belief that if the repeal of the death penalty is not removed, the bill is unlikely to pass the Senate. He also indicated that it might be vetoed by the Governor. He stated that the funding for cold case investigation is important and the committee should adhere to the Senate position.

MOTION:Adopt the first report of the first conference committee (Attachment A). The report returns to the reengrossed version of the bill and it allows the CBI Cold Case Unit to provide grants, support services, and various costs for local investigations of cold case homicides. It also requires the Department of Corrections to report to the Joint Budget Committee regarding any additional risks encountered by department personnel as a result of the repeal of the death penalty. Senator Carroll stated that this is the best option because it directs more funding to cold case investigation. Members of the committee commented about the report. The motion passed on a vote of 4-2.
