Senator Renfroe presented Senate Bill 09-137. The bill requires a property lien waiver for a construction loan to contain a statement that all debts associated with the lien have been paid or will be paid. It makes it a class 1 misdemeanor to knowingly fail to timely pay the debts covered by the lien waiver. Senator Renfroe explained the bill and responded to questions from the committee.

Rocky Gentry, the owner of West Point Interiors, testified in favor of the bill. He discussed his experience with contractors who have not paid, and stated that he is trying to find a way to make sure everyone plays by the same rules. He gave examples of problems caused by a specific contractor. He distributed a packet of materials to the committee (Attachment C). He explained the process of filing a lien.

Mr. Gentry continued his testimony. He discussed the problems and costs that may occur when contractors are not held accountable for their failure to pay.
