A BILL FOR AN ACT Concerning prohibition of the negligent storage of firearms. Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Makes it a class 3 misdemeanor if a person negligently stores a firearm in such a manner that a juvenile obtains possession of the firearm and uses it to commit a criminal offense. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Article 12 of title 18, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: 18-12-111. Negligent storage of firearms. (1) A person commits a class 3 misdemeanor if such person negligently stores a firearm in such a manner that a juvenile obtains possession of the firearm and uses the firearm in violation of any provision of this title or any municipal ordinance or county resolution. (2) For purposes of this section, "negligently stores" means to place or leave a firearm in a location where a reasonable person would perceive a substantial and unjustifiable risk that a juvenile would obtain possession of the firearm. SECTION 2. Effective date - applicability. This act shall take effect upon passage, and shall apply to offenses committed on or after said date. SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
