SENATE JOINT RESOLUTION 99­046

CONCERNING AN INTERIM STUDY ON DEVELOPMENT AND GROWTH.


WHEREAS, The coordination of development and growth in Colorado is a matter of statewide concern and interest in which the state has a responsibility for the health, welfare, and safety of the people of the state and for the protection of the environment; and

WHEREAS, Better coordination of development and growth throughout the state may enhance the health, welfare, and safety of the people of Colorado and may further enhance the high quality of life enjoyed by the residents of Colorado; and

WHEREAS, Such coordination will result in more efficient use of taxpayer money for the construction and maintenance of utilities, schools, and public facilities, improved efficiencies in supplying public services, reduction in sprawl, preservation of agricultural lands in production, and further protection of the environment; now, therefore,

Be It Resolved by the Senate of the Sixty­second General Assembly of the State of Colorado, the House of Representatives concurring herein:

(1)  That there shall be a committee to meet in the interim after the First Regular Session of the Sixty­second General Assembly to study, review, and evaluate the roles and relationships of state government, local governments, and the citizens of Colorado in planning for and accommodating urban development and growth in the state, as such development and growth impact the uses of land. Such interim committee shall consist of twenty members as follows:

(a)  Five members of the Senate, three members appointed by the President of the Senate and two members appointed by the Minority Leader of the Senate;




(b)  Six members of the House of Representatives appointed by the Speaker of the House of Representatives, and four of whom shall be from the majority party and two of whom shall be from the minority party.

(c)  The Executive Director of the Department of Local Affairs or the executive director's designee; and

(d)  Eight members appointed by the Governor. The Governor shall appoint one member to represent environmental interests, one member to represent development interests, two members to represent local governments, one member to represent planners, one member to represent agricultural interests, and two members to represent the general public. Members appointed by the Governor shall not receive compensation or be reimbursed for expenses.


(2)  That the appointments to the interim committee shall be made no later than July 1, 1999. The President of the Senate and the Speaker of the House of Representatives shall jointly call the first meeting of the interim committee no later than August 1, 1999. At its first meeting, the interim committee shall elect a chair and vice­chair.

(3)  That the interim committee shall perform the following duties:

(a)  Study and evaluate the roles and relationships between the state government, local governments, and the citizens of Colorado in planning for development and growth in the state, as such development and growth impact the uses of land;

(b)  Review and discuss any state taxes, state incentives, state environmental policies and requirements, and collaborative working relationships among local communities and different levels of government throughout the state that affect development and growth and make recommendations as to how such taxes, incentives, policies, and relationships can be modified to improve coordination of development and growth; and

(c)  Develop recommendations and a final report for the General Assembly, including any legislative changes necessary to improve the state and local governments' ability to plan for and accommodate such development and growth and any further studies or actions needed to address growth and development.

(4)  That the Legislative Council shall report the findings, recommendations, and final report of the interim committee to the members of the Second Regular Session of the Sixty­second General Assembly.


(5)  That all expenditures incurred in making the study, recommendations, and report described in this Resolution shall be approved by the chair of the Legislative Council and paid by vouchers and warrants drawn as provided by law from funds allocated to the Legislative Council from appropriations made by the General Assembly.
