SENATE JOINT RESOLUTION 99-037

also REPRESENTATIVES Lawrence, Allen, Chavez, George,
Gotlieb, Hagedorn, Hoppe, Kaufman, Larson, Leyba, Mace, Miller,
Mitchell, Pfiffner, Plant, Swenson, and Tochtrop.
CONCERNING THE CONTINUED DEVELOPMENT AND MAINTENANCE
OF AN ORAL HISTORY LIBRARY OF THE COLORADO GENERAL ASSEMBLY.
WHEREAS, In 1994, the Fiftyninth General Assembly
passed House Joint Resolution 941012, which described the
development of an oral history of the General Assembly to be included
as part of the Joint Legislative Library located in the state
capitol as "vitally important to improving communication
and knowledge of the history of the state"; and
WHEREAS, Pursuant to House Joint Resolution 941012
and guidelines established by the Capital Development Committee,
Lee C. Bahrych, retired chief clerk of the House of Representatives,
has established an oral history library of the General Assembly,
and audio taped interviews with former legislators, reporters,
lobbyists, legislative staff, and a Supreme Court Justice are
now on file in the Joint Legislative Library; and
WHEREAS, It is appropriate at this time to transfer
the responsibility for the oral history library from Ms. Bahrych
to persons who will ensure that the oral history library continues
on a permanent basis; and
WHEREAS, For the oral history library of the General
Assembly to continue on an ongoing and permanent basis, it is
necessary to ensure that persons with sufficient knowledge of
the General Assembly continue to oversee and coordinate the development
and maintenance of the library and that funds exist to cover the
costs of developing and maintaining the library; and
WHEREAS, The chief clerk of the House of Representatives
and the secretary of the Senate are in the best position to oversee
and coordinate the development and maintenance of the oral history
library of the General Assembly and are able to pay the cost of
such development and maintenance within existing resources; now,
therefore,
Be It Resolved by the Senate of the Sixtysecond
General Assembly of the State of Colorado, the House of Representatives
concurring herein:
(1) That the "Trust Account for the
Legislative Oral Library" be terminated and that any moneys
in such account be transferred to the special account within the
public buildings trust fund created by section 2482108
(1) (f) (I), Colorado Revised Statutes.
(2) That the Joint Rules of the Senate
and House of Representatives are amended BY THE ADDITION OF A
NEW JOINT RULE to read:
40. ORAL HISTORY OF THE GENERAL
ASSEMBLY
(a) The chief clerk of the House of Representatives
and the secretary of the Senate shall have joint responsibility
for overseeing and coordinating the ongoing development and maintenance
of the oral history library of the General Assembly.
(b) The chief clerk of the House of Representatives
and the secretary of the Senate shall defray the costs of overseeing
and coordinating the ongoing development and maintenance of the
oral history library of the General Assembly by using any gifts,
donations, and grants that may be received for such purpose and,
if necessary, by using existing resources.
(c) The chief clerk of the House of Representatives
and the secretary of the Senate shall report to the Capital Development
Committee regarding the ongoing development and maintenance of
the oral history library of the General Assembly as required by
the Capital Development Committee.
