102 COMMISSIONERS TO REFER MEASURES TO THE ELECTORS OF A

Expands the authority of a board of county commissioners to refer
measures to the electors of a county by allowing a board of county
commissioners to refer any legislative issue or question of countywide
concern to a vote of the electors of the county.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 30-11-103.5, Colorado Revised Statutes, is
3 amended to read:
4 30-11-103.5. County petitions and referred measures. THE
5 BOARD OF COUNTY COMMISSIONERS OF A COUNTY MAY REFER ANY
6 LEGISLATIVE ISSUE OR QUESTION OF COUNTYWIDE CONCERN TO A VOTE OF
7 THE ELECTORS OF SUCH COUNTY. The procedures for placing an issue or
8 question on the ballot by a petition of the electors of a county that is
9 pursuant to statute or the state constitution or that a board of county
[ ] denotes HOUSE amendment. { } denotes SENATE amendment.

1 commissioners may refer to a vote of the electors pursuant to statute or
2 the state constitution shall, to the extent no such procedures are
3 prescribed by statute, charter, or the state constitution, follow as nearly
4 as practicable the procedures for municipal initiatives and referred
5 measures under part 1 of article 11 of title 31, C.R.S. The county clerk
6 and recorder shall resolve any questions about the applicability of the
7 procedures in part 1 of article 11 of title 31, C.R.S.
8 SECTION 2. Safety clause. The general assembly hereby finds,
9 determines, and declares that this act is necessary for the immediate
10 preservation of the public peace, health, and safety.
