104 PURSUANT TO THE STATUTORY THREE-YEAR REPORTING REVIEW

Eliminates the requirement that the department of corrections
submit a report to the capital development committee containing proposed
correctional facility program plans.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. Repeal. 17-1-104.8 (1), Colorado Revised
3 Statutes, is repealed as follows:
4 17-1-104.8. Legislative review of facilities program plans for
5 correctional facilities. (1) Prior to any appropriation by the general
6 assembly for the construction of a new, expanded, renovated, or
7 improved correctional facility, and no later than November 1 prior to the
8 beginning of the budget year for which the appropriation is made, the

1 department shall submit a proposed facility program plan for each
2 proposed new, expanded, renovated, or improved correctional facility to
3 the capital development committee. The capital development committee
4 shall make a recommendation regarding the facility program plan to the
5 joint budget committee. The general assembly may contract with a
6 consultant to provide assistance to the capital development committee and
7 the joint budget committee in the review of facilities program plans
8 submitted by the department.
9 SECTION 2. Effective date. This act shall take effect at 12:01
10 a.m. on the day following the expiration of the ninety-day period after
11 final adjournment of the general assembly that is allowed for submitting
12 a referendum petition pursuant to article V, section 1 (3) of the state
13 constitution; except that, if a referendum petition is filed against this act
14 or an item, section, or part of this act within such period, then the act,
15 item, section, or part, if approved by the people, shall take effect on the
16 date of the official declaration of the vote thereon by proclamation of the
17 governor.
