SENATE BILL 99­197

CONCERNING THE PAYMENT OF EXPENSES OF THE LEGISLATIVE DEPARTMENT, AND MAKING AN APPROPRIATION IN CONNECTION THEREWITH.


Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  2­2­307 (3) (a) (IV), Colorado Revised Statutes, is amended to read:

2­2­307.  Compensation of members ­ reimbursement of expenses ­ repeal. (3) (a)  When the general assembly is in recess for more than three days or is not in session, in addition to the base compensation specified in subsection (1) of this section, the following members of the general assembly shall be entitled to the further sum of ninety­nine dollars per day for necessary attendance at meetings or functions or to legislative matters as follows:

(IV)  Any member of a committee of reference designated pursuant to section 2­3­1201 who attends a meeting of the committee of reference OR WHO ATTENDS A MEETING OF THE JOINT BUDGET COMMITTEE WHEN IT IS CONSIDERING MATTERS FOR WHICH THE MEMBER'S COMMITTEE OF REFERENCE HAS OVERSIGHT RESPONSIBILITY, or, with the approval of the chairperson, who attends a state function or a function at a state institution or state agency at which matters concerning the committee are considered. THE EXECUTIVE COMMITTEE OF THE LEGISLATIVE COUNCIL MAY ESTABLISH GUIDELINES FOR THE PAYMENT OF PER DIEM TO MEMBERS OF A COMMITTEE OF REFERENCE WHO ATTEND MEETINGS OF THE JOINT BUDGET COMMITTEE AS ALLOWED BY THIS SUBPARAGRAPH (IV).

SECTION 2.  Appropriation.  In addition to any other appropriation, there is hereby appropriated, to the legislative department of the state of Colorado, the sum of twenty-three million six hundred seventy-nine thousand three hundred forty dollars ($23,679,340), or so much thereof as may be necessary, of which amount twenty-three million five hundred seventy-nine thousand three hundred forty dollars ($23,579,340) shall be out of any moneys in the general fund not otherwise appropriated and one hundred thousand dollars ($100,000) shall be from cash funds, for payment of the expenses of the legislative department for the fiscal year beginning July 1, 1999, to be allocated as follows:

1/ Of this amount, $100,000 is appropriated out of cash funds generated by the joint bill room, and $9,746,851 is appropriated out of the general fund. It is the intent of the general assembly that any moneys budgeted but not expended for the 1999­2000 fiscal year to pay the costs of a special session during the 1999 interim be used to pay per diem to members of committees of reference who attend meetings of the joint budget committee. Such per diem payments shall be made in accordance with any guidelines established by the executive committee of the legislative council pursuant to section 2­2­307 (3) (a) (IV), Colorado Revised Statutes.

2/ It is anticipated that, during the 1999­2000 fiscal year, the tax levy on civil actions provided for in section 2­5­119, Colorado Revised Statutes, will return approximately $200,000 to the general fund to offset expenses of the revision of statutes by the office of legislative legal services.

SECTION 3.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
