A BILL FOR AN ACT
101 CONCERNING SIMULCAST SIGNALS OF GREYHOUND RACING EVENTS.
Bill Summary

Eliminates the requirement that a simulcast facility receive the
consent of an in-state host greyhound track, located within 50 miles of the
simulcast facility, to broadcast simulcast races when live races are being
run at the in-state host track.
Requires simulcast facilities to broadcast in-state races rather than
out-of-state races when the broadcast of in-state races is offered on usual
and customary terms and conditions, including price. Allows simulcast
facilities to broadcast out-of-state signals when an in-state race track does
not offer its simulcast signal on usual and customary terms and
conditions, including price. Allows simulcast facilities receiving signals
to make signals available to other simulcast facilities and tracks.
Removes existing limitations on special event greyhound races,
including the current limitation to 15 such events per year. Permits
simulcast facilities to receive greyhound simulcast races at any time.
Prohibits the operation of a simulcast facility by anyone who is not
licensed to conduct live races.

2 SECTION 1. 12-60-602 (3), (5) (a), and (6), Colorado Revised
3 Statutes, are amended to read:
4 12-60-602. Simulcast facilities and simulcast races - unlawful

1 act - repeal. (3) A race meet of greyhounds which THAT is conducted at
2 an in-state host track may be received as a simulcast race by any
3 simulcast facility except that, notwithstanding any consent granted
4 pursuant to the provisions of section 12-60-102 (14), an in-state simulcast
5 facility which is located within fifty miles of a greyhound track may not
6 receive simulcast races of greyhounds on any day on which such
7 greyhound track is running live greyhound races, unless the licensee of
8 such greyhound track consents thereto. IF THE IN-STATE HOST TRACK
9 OFFERS THE SIMULCAST SIGNAL ON USUAL AND CUSTOMARY TERMS AND
10 CONDITIONS THAT PREVAIL IN COLORADO, INCLUDING PRICE. A
11 SIMULCAST FACILITY MAY MAKE AVAILABLE TO OTHER SIMULCAST
12 FACILITIES THE BROADCAST SIGNAL FROM THE IN-STATE HOST TRACK.
13 (5) (a) An in-state simulcast facility may receive only special
14 event greyhound races from an out-of-state host track and, in addition, on
15 any day on which an in-state simulcast facility receives greyhound
16 simulcast races from an out-of-state host track and on which one or more
17 in-state host tracks are running live greyhound races, such in-state
18 simulcast facility shall receive and conduct pari-mutuel wagering on the
19 broadcast signal of simulcast greyhound races from at least one such
20 in-state host track, if such broadcast signal is made available to it on usual
21 and customary terms and conditions THAT PREVAIL IN COLORADO,
22 including price. The commission shall approve no more than fifteen
23 special events per year.
24 (6) (a) An in-state simulcast facility having a written simulcast
25 racing agreement with an in-state or out-of-state host track pursuant to
26 section 12-60-503 (2) may receive simulcast races, as specified in

1 subsections (2) to (5) of this section, on any day, including a day not
2 within the race meet of such in-state simulcast facility which THAT is also
3 a track and a day on which no live race is conducted within the race meet
4 of such in-state simulcast facility which is also a track.
5 (b) WHEN AN IN-STATE GREYHOUND RACE IS CONDUCTED AND A
6 BROADCAST SIGNAL OF THE RACE IS MADE AVAILABLE TO AN IN-STATE
7 SIMULCAST FACILITY ON USUAL AND CUSTOMARY TERMS AND CONDITIONS
8 THAT PREVAIL IN COLORADO, INCLUDING PRICE, THE IN-STATE SIMULCAST
9 FACILITY SHALL GIVE PREFERENCE TO THE IN-STATE RACE FOR BROADCAST
10 PURPOSES.
11 (c) WHEN AN IN-STATE GREYHOUND RACE IS CONDUCTED AND A
12 BROADCAST SIGNAL OF THE RACE IS NOT OFFERED ON USUAL AND
13 CUSTOMARY TERMS AND CONDITIONS, INCLUDING PRICE, AND A
14 BROADCAST SIGNAL OF A GREYHOUND RACE OCCURRING OUT OF STATE IS
15 MADE AVAILABLE TO AN IN-STATE SIMULCAST FACILITY ON USUAL AND
16 CUSTOMARY TERMS AND CONDITIONS THAT PREVAIL IN COLORADO,
17 INCLUDING PRICE, THE IN-STATE SIMULCAST FACILITY MAY BROADCAST
18 THE OUT-OF-STATE RACE INSTEAD OF THE IN-STATE RACE.
19 SECTION 2. 12-60-503 (2) (a), Colorado Revised Statutes, is
20 amended to read:
21 12-60-503. Rules of the commission - licensing. (2) (a) Every
22 person holding a license or registration under this article, every person
23 operating an in-state simulcast facility, and every owner or trainer of any
24 horse or greyhound licensed to enter any racing contest under this article
25 shall comply with all rules and orders issued by the commission. It is
26 unlawful for any person to work upon the premises of a racetrack without

1 first obtaining from the commission a license or registration for such
2 activity. The commission may waive this licensing or registration
3 requirement for such occupational categories as the commission, in its
4 discretion, deems unnecessary to be licensed or registered. This licensing
5 or registration requirement does not apply to the members of the
6 commission or its employees or to persons whose only participation is
7 individually as spectator or bettor. It is unlawful for any person who
8 owns or leases a racing animal to allow such animal to race in this state
9 without first obtaining an owner's license or registration from the
10 commission, as prescribed by the rules of the commission. The
11 commission in its discretion may extend the validity of any license issued
12 for a period not to exceed three years, and the fee for such license shall
13 be increased proportionately; except that no temporary or conditional
14 license or registration shall be issued for a period longer than ninety days.
15 It is unlawful for any person to hold any race meet with pari-mutuel
16 wagering without obtaining a license therefor. It is unlawful for any
17 person to operate an in-state simulcast facility unless that person is a
18 licensee that has been licensed within the year to hold a race meet. or is
19 a licensee that has a written simulcast racing agreement with the in-state
20 host track or out-of-state host track from which the simulcast race is
21 broadcast and has filed a copy of the written simulcast racing agreement
22 with the commission prior to operation as an in-state simulcast facility.
23 SECTION 3. Safety clause. The general assembly hereby finds,
24 determines, and declares that this act is necessary for the immediate
25 preservation of the public peace, health, and safety.
