101 CONCERNING THE ELIMINATION OF THE PROHIBITION AGAINST CERTAIN
102 OFFICIALS HAVING INTERESTS IN LIMITED GAMING LICENSES.

Removes language that prohibits a person from having an interest
in a limited gaming license if such person is an elected municipal official,
city manager, or planning commission member of Black Hawk, Cripple
Creek, or Central City, Colorado.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 12-47.1-804 (1), Colorado Revised Statutes, is
3 amended to read:
4 12-47.1-804. Persons prohibited from interest in limited
5 gaming. (1) None of the following persons shall have any interest,
6 direct or indirect, in any license involved in or with limited gaming:
7 (a) Officers, reserve police officers, agents, or employees of any
8 law enforcement agency of the state of Colorado with the authority to
9 investigate or prosecute crime in Teller or Gilpin counties or of any local
10 law enforcement agency or detention or correctional facility within Teller

1 or Gilpin counties;
2 (b) District, county, or municipal court judges whose jurisdiction
3 includes all or any portion of Teller or Gilpin counties;
4 (c) Elected municipal officials or county commissioners of the
5 counties of Teller and Gilpin. and of the cities of Central, Black Hawk,
6 and Cripple Creek;
7 (d) Central, Black Hawk, or Cripple Creek city manager or
8 planning commission member.
9 SECTION 2. Safety clause. The general assembly hereby finds,
10 determines, and declares that this act is necessary for the immediate
11 preservation of the public peace, health, and safety.
