(3) (a) (II) and (17) (a), Colorado Revised Statutes, is amended
to read:
424304. Definitions relating
to automobile inspection and readjustment program.
As used in sections 424301 to 424316,
unless the context otherwise requires:
(3) (a) "Certification of emissions
control" means one of the following certifications, to be
issued to the owner of a motor vehicle which is subject to the
automobile inspection and readjustment program to indicate the
status of inspection requirement compliance of said vehicle:
(II) "Certification of emissions
compliance", indicating that the emissions from said vehicle
comply with applicable emissions and opacity standards and criteria
at the time of inspection or after required adjustments or repairs.
FOR PURPOSES OF THE ENHANCED INSPECTION AREA, THE INSPECTION
SHALL INCLUDE EITHER THE IM 240, RG 240, ASM 5015, ASM 2525, OR
COLORADO 94 TWOSPEED IDLE VEHICLE EMISSIONS INSPECTION CONDUCTED
AT AN INSPECTION FACILITY LICENSED PURSUANT TO THIS PART 3.
(17) (a) "Inspectiononly
facility" means a facility operated by an independent owneroperator
within the enhanced program area as defined in subsection (20)
of this section which meets the requirements of section
SECTIONS 424305, 424306, AND 424308
and which is equipped to enable vehicle exhaust, evaporative,
and chlorofluorocarbon emissions inspections and which facility
the operator is licensed to operate by the executive director
as an inspectiononly facility. Such
inspectiononly facility shall be authorized to conduct inspections
on model year 1981 and older vehicles.
SECTION 2. 424305
(1) (a) and (10) (a), Colorado Revised Statutes, are amended to
read:
424305. Powers and duties
of executive director automobile inspection and readjustment
program basic emissions program enhanced emissions
program clean screen program.
(1) (a) The executive director is authorized to
issue, deny, cancel, suspend, or revoke licenses for, and shall
furnish instructions to, inspection and readjustment stations,
inspectiononly facilities, fleet inspection stations, motor
vehicle dealer test facilities, and enhanced inspection centers.
The executive director shall provide all necessary forms for
inspection and readjustment stations, inspectiononly facilities,
and fleet inspection stations. Motor vehicle dealer test facilities,
INSPECTIONONLY FACILITIES, INSPECTION AND READJUSTMENT STATIONS,
and enhanced inspection centers shall purchase necessary inspection
forms from the vendor or vendors identified by the executive director.
Said inspection and readjustment stations, inspectiononly
facilities, fleet inspection stations, motor vehicle dealer test
facilities, and enhanced inspection centers shall be responsible
for the issuance of certifications of emissions control. The
executive director is authorized to furnish forms and instructions
and issue or deny licenses to, or cancel, suspend, or revoke licenses
of, emissions inspectors and emissions mechanics. The initial
biennial fee for an inspection and readjustment station license,
an inspectiononly facility license, a fleet inspection station
license, a motor vehicle dealer test facility license, and an
enhanced inspection center authorization shall be thirtyfive
dollars, and the biennial renewal fee shall be twenty dollars.
The initial biennial fee for issuance of an emissions inspector
license or an emissions mechanic license shall be fifteen dollars,
and the biennial renewal fee shall be ten dollars. The fee for
each transfer of an emissions inspector license or an emissions
mechanic license shall be ten dollars. The moneys received from
such fees shall be deposited to the credit of the AIR account
in the highway users tax fund, and such moneys shall be expended
by the department of revenue only for the administration of the
inspection and readjustment program upon appropriation by the
general assembly.
(10) (a) The executive director and
the department of public health and environment are authorized
to enter into a contract or service agreement with a contractor
to provide inspection services at enhanced inspection centers
for vehicles within the enhanced program area required to be inspected
pursuant to section 424310; EXCEPT INSPECTION SERVICES
PROVIDED THROUGH SUCH CONTRACT OR SERVICE AGREEMENT SHALL NOT
BE THE EXCLUSIVE METHOD FOR VEHICLES WITHIN THE ENHANCED PROGRAM
TO OBTAIN INSPECTION SERVICES. A VEHICLE WITHIN THE ENHANCED
PROGRAM AREA MAY BE INSPECTED BY ANY INSPECTIONONLY FACILITY
OR INSPECTION AND ADJUSTMENT STATION LICENSED BY THE EXECUTIVE
DIRECTOR IN ACCORDANCE WITH SECTIONS 424306 OR 424308.
Any such contract or service agreement shall include such terms
and conditions as are necessary to ensure that the contractor
shall operate enhanced inspection centers in accordance with the
requirements of this article and the federal act, shall include
provisions establishing liquidated damages and penalties for failure
to comply with the terms and conditions of the contract, and shall
be in accordance with regulations adopted by the commission and
the department of revenue. Any such contract or service agreement
shall include provisions specifying that inspection and readjustment
stations, inspectiononly facilities, fleet inspection stations,
and motor vehicle dealer test facilities shall have complete access
to electronic data transfer of inspection data through computer
services of the contractor at a cost equal to that of enhanced
inspection centers.
SECTION 3. 424306
(4) (a) and (17) (f), Colorado Revised Statutes, are amended to
read:
424306. Powers and duties
of commission automobile inspection and readjustment program
basic emissions program enhanced emissions program
clean screen program. (4) (a) The
commission shall develop a program to train and examine all applicants
for an emissions inspector or emissions mechanic license. Training
of emissions inspectors who are employed at enhanced inspection
centers OR LICENSED INSPECTIONONLY STATIONS OR INSPECTION
AND READJUSTMENT STATIONS within the enhanced emissions program
area shall be administered by the contractor
subject to the commission's oversight
COMMISSION. Emissions mechanic training shall be performed by
instructors certified in accordance with commission requirements.
Training classes shall be funded by tuition charged to the participants
unless private or federal funds are available for such training.
The qualifications and licensing examination for emissions inspectors,
excluding such inspectors at enhanced
inspection centers, who shall be authorized by and under the direction
of the contractor, shall include
a test of the applicant's knowledge of the technical and legal
requirements for emissions testing, knowledge of data and emissions
testing systems, and an actual demonstration of the applicant's
ability to perform emissions inspection procedures.
(17) (f) Within the enhanced emissions
program area the commission shall provide for the operation of
licensed inspectiononly facilities. Applicable facility
and inspector licensing, inspection procedures, and criteria shall
be pursuant to rule and regulation of the commission and compliance
with federal requirements. Inspectiononly facilities shall
be authorized to provide inspection services for all classes of
motor vehicles as defined in section 424304 (18).
of the model year 1981 and older.
Inspectiononly owners or operators, or both, shall comply
with paragraph (a) of this subsection (17).
SECTION 4. 424310
(1) (a) (II) (A), (1) (a) (II) (B), (1) (b) (II), (1) (c) (V),
the introductory portion to 424310 (4) (a) and 424310
(4) (c), Colorado Revised Statutes, are amended to read:".

"(c) (V) Motor vehicles operated
in the enhanced emissions program area, and required to be inspected
pursuant to subparagraph (I) of this paragraph (c), shall comply
with the inspection requirements of the enhanced emissions program
area AS SET FORTH IN SECTION 424304 (3) (a) (II) and
are not required to comply with the inspection requirements of
the basic emissions program area.".

424311. Operation of inspection
and readjustment stations inspectiononly facilities

license, inspectiononly facility license, fleet inspection
station license, motor vehicle dealer test facility license, or
enhanced inspection center contract may be assigned or transferred
or used at any other than the station, facility, or center therein
designated, and every such license or authorization for
an enhanced inspection center shall
be posted in a conspicuous place at the facility designated.
(6) The fee charged by an enhanced inspection
center, INSPECTIONONLY FACILITY, OR INSPECTION AND READJUSTMENT
STATION for emissions inspections performed within the enhanced
emissions program area shall not be any greater than that determined
by the competitive bid process conducted by the division in consultation
with the executive director in contractor selection and in no
case greater than twentyfive dollars. Such fee shall not
exceed the maximum fee required to be posted by the enhanced inspection
center, INSPECTIONONLY FACILITY, OR INSPECTION AND READJUSTMENT
STATION pursuant to section 424305 for the inspection
of any motor vehicle required to be inspected under section 424310.".

reduced by five hundred thousand dollars ($500,000).
(b) The capital construction fund exempt
appropriation to the department of transportation, construction

may file a motion, with supporting affidavit, in the court where
the adoption took place, to appoint one or more confidential intermediaries
for the purpose of determining the whereabouts of his
or her SUCH INDIVIDUAL'S unknown
relative or relatives; except that no one shall seek to determine
the whereabouts of a relative who is younger than eighteen years
of age. The court may rule on said motion and affidavit without
hearing and may appoint a trained confidential intermediary.

PERSONAL INCOME FOR COLORADO, AS DEFINED AND OFFICIALLY REPORTED
BY THE BUREAU OF ECONOMIC ANALYSIS IN THE UNITED STATES DEPARTMENT
OF COMMERCE FOR THE CALENDAR YEAR PRIOR TO THE CALENDAR YEAR IMMEDIATELY
PRECEDING THE CALENDAR YEAR IN WHICH THE ADJUSTMENT IS MADE.
(II) UPON CALCULATING THE ADJUSTMENT OF
SAID DOLLAR AMOUNT IN ACCORDANCE WITH SUBPARAGRAPH (I) OF THIS
PARAGRAPH (b), THE EXECUTIVE DIRECTOR SHALL NOTIFY IN WRITING
THE EXECUTIVE COMMITTEE OF THE LEGISLATIVE COUNCIL CREATED PURSUANT
TO SECTION 23301 (1), C.R.S., OF THE ADJUSTED DOLLAR
AMOUNT AND THE BASIS FOR THE ADJUSTMENT. SUCH WRITTEN NOTIFICATION
SHALL BE GIVEN WITHIN FIVE WORKING DAYS AFTER SUCH CALCULATION
IS COMPLETED, BUT SUCH WRITTEN NOTIFICATION SHALL BE GIVEN NO
LATER THAN OCTOBER 1 OF THE CALENDAR YEAR.
(III) IT IS THE FUNCTION OF THE EXECUTIVE
COMMITTEE TO REVIEW AND APPROVE OR DISAPPROVE SUCH ADJUSTMENT
OF SAID DOLLAR AMOUNT WITHIN TWENTY DAYS AFTER RECEIPT OF SUCH
WRITTEN NOTIFICATION FROM THE EXECUTIVE DIRECTOR. ANY ADJUSTMENT
THAT IS NOT APPROVED OR DISAPPROVED BY THE EXECUTIVE COMMITTEE
WITHIN SAID TWENTY DAYS SHALL BE AUTOMATICALLY APPROVED; EXCEPT
THAT, IF WITHIN SAID TWENTY DAYS THE EXECUTIVE COMMITTEE SCHEDULES
A HEARING ON SUCH ADJUSTMENT, SUCH AUTOMATIC APPROVAL SHALL NOT
OCCUR UNLESS THE EXECUTIVE COMMITTEE DOES NOT APPROVE OR DISAPPROVE
SUCH ADJUSTMENT AFTER THE CONCLUSION OF SUCH HEARING. ANY HEARING
CONDUCTED BY THE EXECUTIVE COMMITTEE PURSUANT TO THIS SUBPARAGRAPH
(III) SHALL BE CONCLUDED NO LATER THAN TWENTYFIVE DAYS AFTER
RECEIPT OF SUCH WRITTEN NOTIFICATION FROM THE EXECUTIVE DIRECTOR.
(IV) IF THE EXECUTIVE COMMITTEE DISAPPROVES
ANY ADJUSTMENT OF SAID DOLLAR AMOUNT CALCULATED BY THE EXECUTIVE
DIRECTOR PURSUANT TO THIS PARAGRAPH (b), THE EXECUTIVE COMMITTEE
SHALL SPECIFY SUCH ADJUSTED DOLLAR AMOUNT TO BE UTILIZED BY THE

UTILIZE ANY ADJUSTED DOLLAR AMOUNT THAT HAS NOT BEEN APPROVED
PURSUANT TO SUBPARAGRAPH (III) OF THIS PARAGRAPH (b) OR OTHERWISE
SPECIFIED PURSUANT TO SUBPARAGRAPH (IV) OF THIS PARAGRAPH (b).
(VI) IF ONE OR MORE BALLOT QUESTIONS ARE
SUBMITTED TO THE VOTERS AT A STATEWIDE ELECTION TO BE HELD IN
NOVEMBER OF ANY CALENDAR YEAR COMMENCING ON OR AFTER JANUARY 1,
2000, THAT SEEK AUTHORIZATION FOR THE STATE TO RETAIN AND SPEND
ALL OR ANY PORTION OF THE AMOUNT OF EXCESS REVENUES FOR THE STATE
FISCAL YEAR ENDING DURING SAID CALENDAR YEAR, THE EXECUTIVE DIRECTOR
SHALL NOT DETERMINE WHETHER ANY MODIFICATION FOR QUALIFYING GAINS

This Report Amends the Rerevised Bill.
To the President of the Senate and the
Speaker of the House of Representatives:
Your first conference committee appointed on HB991260,
concerning strengthening of the criminal laws concerning sex offenders,
has met and reports that it has agreed upon the following:
1. That the House accede to the Senate
amendments made to the bill, as said amendments appear in the
rerevised bill.
2. That, under the authority granted the
committee to consider matters not at issue between the two houses,
the following amendment be recommended:
Amend rerevised bill, page 26, strike lines 22 through
24 and substitute the following:
"SECTION 23. Appropriation.
In addition to any other appropriation, there is hereby appropriated,
out of any moneys remaining in the statewide instant criminal
background check cash fund created in section 1226.5107,
Colorado Revised Statutes, as it existed prior to November 30,
1998, not otherwise appropriated, to the department of public
safety, for the fiscal year beginning July 1, 1999, the sum of
two hundred fortyone thousand five hundred fiftyone
dollars ($241,551) and 2.5 FTE, or so much thereof as may be necessary,
for the implementation of sections 3 and 17 of this act.
SECTION 24. Future appropriations

addition to any other appropriation set forth in this act, it

This Report Amends the Reengrossed Bill.
To the President of the Senate and the
Speaker of the House of Representatives:
Your first conference committee appointed on SB99061,
concerning parole of persons sentenced to the department of corrections,
has met and reports that it has agreed upon the following:
That the House recedes from its amendments made to
the bill, as said amendments appear in the rerevised bill, and
that the following amendments be substituted therefor:
Amend reengrossed bill, page 9, strike lines 9 through
20, and substitute the following:
"171105.3. Duties
of executive director parole revocation options plan.
(1) THE EXECUTIVE DIRECTOR SHALL DEVELOP A PLAN SPECIFYING
A RANGE OF OPTIONS THAT THE DEPARTMENT MAY IMPLEMENT IN DEALING
WITH PERSONS WHO ARE IN CUSTODY AWAITING PAROLE REVOCATION PROCEEDINGS,
PAROLEES WHOSE PAROLE HAS BEEN REVOKED, AND PAROLEES WHO HAVE
BEEN GRANTED PAROLE AND ARE AWAITING PLACEMENT IN COMMUNITY CORRECTIONS
FACILITIES. THE PLAN MAY INCLUDE BUT NEED NOT BE LIMITED TO CONTRACTING
FOR THE USE OF A PRIVATELY OWNED AND OPERATED FACILITY TO HOUSE
AND PROVIDE SERVICES TO SAID PERSONS, CONTRACTING WITH COUNTY
