"SECTION 5. Transfer of funds

on July 1, 1999, the state treasurer shall deduct one hundred
thousand dollars ($100,000) from the wildlife cash fund and transfer
such sum to the wildlife management public education fund created

there is hereby appropriated, out of any moneys in the wildlife

($63,260), or so much thereof as may be necessary, for the implementation

there is hereby appropriated, out of any moneys in the wildlife
management public education fund created in section 33-1-112 (3.5)
(a), Colorado Revised Statutes, not otherwise appropriated, to
the division of wildlife, for allocation to the wildlife management
public education advisory council, for the fiscal year beginning
July 1, 1999, the sum of one hundred fifty thousand dollars ($150,000),
or so much thereof as may be necessary, for the implementation
of this act.".

be subject to the "(H)" notation as defined in the general

assembly anticipates that, for the fiscal year beginning July 1,
1999, the department of military affairs will receive the sum
of one million nine hundred sixty thousand dollars ($1,960,000)
in federal funds for the implementation of this act. Although
federal funds are not appropriated in this act, they are noted
for the purpose of indicating the assumptions used relative to
these funds in developing the state appropriation amounts.".

and the local board of education, pursuant to section 2230.5105,
Colorado Revised Statutes, such contracts are enforceable and
the parties to such contracts may obtain such remedies for the
violation of such contracts as are provided by law.".

AID PROGRAMS SHALL BE DIRECTED TO CHARTER SCHOOLS SERVING STUDENTS
ELIGIBLE FOR SUCH AID.
(II) FOR BUDGET YEAR 20002001 AND
BUDGET YEARS THEREAFTER, IF THE CHARTER SCHOOL AND THE SCHOOL
DISTRICT HAVE NEGOTIATED TO ALLOW THE CHARTER SCHOOL TO PROVIDE
FEDERALLY REQUIRED EDUCATIONAL SERVICES PURSUANT TO PARAGRAPH
(a.8) OF SUBSECTION (2) OF THIS SECTION, THE PROPORTIONATE SHARE
OF STATE AND FEDERAL RESOURCES GENERATED BY STUDENTS RECEIVING
SUCH FEDERALLY REQUIRED EDUCATIONAL SERVICES OR STAFF SERVING
THEM SHALL BE DIRECTED BY THE SCHOOL DISTRICT OR ADMINISTRATIVE
UNIT TO THE CHARTER SCHOOL ENROLLING SUCH STUDENTS.
(III) FOR BUDGET YEAR 20002001 AND
BUDGET YEARS THEREAFTER, THE PROPORTIONATE SHARE OF MONEYS GENERATED
UNDER FEDERAL OR STATE CATEGORICAL AID PROGRAMS, OTHER THAN FEDERALLY

TRANSPORTATION AND ENERGY
After consideration on the merits, the Committee
recommends the following:
SB99-208 be amended
as follows, and as so amended, be referred to the Committee of
the Whole with favorable recommendation:
Amend reengrossed bill, strike everything below the
enacting clause, and substitute the following:
"SECTION 1. 424310
(1) (a) (II) (A), (1) (a) (II) (B), (1) (b) (II), the introductory
portion to 424310 (4) (a), and 424310
(4) (c), Colorado Revised Statutes, are amended to read:
424310. Periodic emissions
control inspection required. (1) (a) (II) (A) If
title to a roadworthy motor vehicle, as defined in section 426102
(11), for which a certification of emissions compliance or emissions
waiver must be obtained pursuant to this paragraph (a) is being
transferred to a new owner, the new owner may require at the time
of sale that the prior owner provide PROOF OF said certification
as required for the county of residence of the new owner.
(B) The new owner shall submit such PROOF
OF certification to the department of revenue or an authorized
agent thereof with application for registration of the motor vehicle.
(b) (II) (A) New motor vehicles
required under this section to have a certification of emissions
control shall be issued a certification of emissions compliance
without inspection which
THAT shall expire on the EARLIER OF THE FIFTH anniversary of the
day of the issuance of such certification when
such vehicle has reached its fourth model year
or ON THE DATE THAT THE VEHICLE HAS TRAVELED FIFTY THOUSAND MILES
AS SHOWN BY THE ODOMETER IN THE VEHICLE. on
the date of the transfer of ownership at any time prior to the
fourth model year. Prior to the expiration
of such certification, such vehicle shall be inspected and a certification
of emissions control shall be obtained therefor. SUCH CERTIFICATE
OF EMISSIONS CONTROL SHALL BE VALID FOR TWENTYFOUR MONTHS.
(B) 1982 and newer model motor vehicles
required pursuant to this section to have a certification of emissions
control shall be inspected at the
time of the sale or transfer of any such vehicle and, prior to
registration renewal AND, IF IN COMPLIANCE,
shall be issued a certification of emissions control that shall
be valid for twentyfour months except as provided under
section 424309. SUCH VEHICLES SHALL BE REINSPECTED
BEFORE THE EXPIRATION OF THE TWENTYFOUR MONTH PERIOD.
THE SALE OR TRANSFER OF A VEHICLE WITH A VALID CERTIFICATE OF
EMISSIONS DOES NOT REQUIRE SUCH VEHICLE TO UNDERGO AN INSPECTION
PRIOR TO ITS REGISTRATION. This subsubparagraph (B) does
not apply to the sale of a motor vehicle which
THAT is inoperable or otherwise cannot be tested in accordance
with regulations promulgated by the department of revenue if the
seller of the motor vehicle provides a written notice to the purchaser
pursuant to the requirements of subsection (4) of this section.
(C) 1981 and older model motor vehicles
required pursuant to this section to have a certification of emissions
control shall be inspected at the
time of the sale or transfer of any such vehicle and, prior to
registration renewal AND, IF IN COMPLIANCE,
shall be issued a certification of emissions control that shall

of the vehicle if the seller provides a written notice to the
purchaser prior to completion of the sale that clearly indicates
the following:
(c) If a motor vehicle is exempted from
the requirement for obtaining
HAVING a VALID certification of emissions control prior to sale
because it is inoperable or otherwise cannot be tested, the new
owner of the motor vehicle is required to obtain a certification
of emissions control for such motor vehicle before registering
it in the program area.
SECTION 2. Safety
clause. The general assembly hereby finds, determines, and
declares that this act is necessary for the immediate preservation
of the public peace, health, and safety.".

DISTRICT TO PROVIDE ADEQUATE FACILITIES THAT ARE SUFFICIENT TO
OPERATE AN EDUCATIONAL PROGRAM WITHIN THE SCHOOL DISTRICT; AND
(b) THE GENERAL ASSEMBLY DESIRES TO ASSIST
SCHOOL DISTRICTS IN ENSURING THAT THE FACILITIES USED BY THE SCHOOL
DISTRICTS PROVIDE A HEALTHY AND SAFE ENVIRONMENT IN WHICH TO MEET
STUDENTS' EDUCATIONAL NEEDS; AND
(c) COLORADO SCHOOL DISTRICTS HAVE DIFFERING
FINANCIAL ABILITIES TO MEET STUDENTS' EDUCATIONAL NEEDS, INCLUDING
THE NEED FOR RENOVATIONS OF AND CONTROLLED MAINTENANCE AT PUBLIC
SCHOOLS TO ENSURE A HEALTHY AND SAFE ENVIRONMENT FOR STUDENTS
AND TEACHERS; AND
(d) THE ESTABLISHMENT OF A PROGRAM TO
PROVIDE GRANTS, LOWINTEREST AND INTERESTFREE LOANS,
AND INTEREST RATE BUYDOWNS TO SCHOOL DISTRICTS FOR CAPITAL
CONSTRUCTION PROJECTS WOULD ASSIST THE SCHOOL DISTRICTS IN MEETING

(2) IT IS THE INTENT OF THE GENERAL ASSEMBLY
IN ENACTING THIS PART 2 TO ESTABLISH A PROGRAM THAT WILL PROVIDE
FINANCIAL ASSISTANCE TO SCHOOL DISTRICTS THAT DESIRE TO UNDERTAKE
CAPITAL CONSTRUCTION PROJECTS AND THAT HAVE A NEED FOR FINANCIAL
ASSISTANCE IN ORDER TO UNDERTAKE SUCH CONSTRUCTION PROJECTS.
2436202. Definitions.
AS USED IN THIS PART 2, UNLESS THE CONTEXT OTHERWISE REQUIRES:
(1) "BOARD" MEANS THE
TWENTYFIRST CENTURY SCHOOL FUND BOARD CREATED IN SECTION
2436203.
(2) "CAPITAL CONSTRUCTION"
SHALL HAVE THE SAME MEANING AS SET FORTH IN SECTION 2475301
(1).
(3) "FUND" MEANS THE
TWENTYFIRST CENTURY SCHOOL REVOLVING LOAN FUND CREATED IN
SECTION 2436205.
(4) "FUND ADMINISTRATOR"
MEANS THE PERSON OR PERSONS WITH WHOM THE BOARD CONTRACTS PURSUANT
TO SECTION 2436204 FOR ADMINISTRATION OF THE FUND
IN ACCORDANCE WITH THIS PART 2 AND THE RULES OF THE BOARD ADOPTED
PURSUANT TO THIS PART 2.
(5) "MASTER SETTLEMENT AGREEMENT"
MEANS THE MASTER SETTLEMENT AGREEMENT, THE SMOKELESS TOBACCO MASTER
SETTLEMENT AGREEMENT, AND THE CONSENT DECREE APPROVED AND ENTERED
BY THE COURT IN THE CASE DENOMINATED STATE OF COLORADO, EX

2436203. Twentyfirst
century school fund board created membership
rules. (1) THERE IS HEREBY
CREATED IN THE TREASURY DEPARTMENT THE TWENTYFIRST CENTURY
SCHOOL FUND BOARD. THE TWENTYFIRST CENTURY SCHOOL FUND BOARD,
TOGETHER WITH ITS POWERS AND DUTIES, IS TRANSFERRED BY A TYPE
1 TRANSFER TO THE TREASURY DEPARTMENT. THE BOARD SHALL CONSIST
OF NINE MEMBERS AS FOLLOWS:
(a) THE COMMISSIONER OF EDUCATION;
(b) EIGHT MEMBERS APPOINTED BY THE GOVERNOR,
WITH THE CONSENT OF THE SENATE, AS FOLLOWS:
(I) TWO MEMBERS WHO ARE ELECTED SCHOOL
DISTRICT DIRECTORS, ONE OF WHOM REPRESENTS AN URBAN SCHOOL DISTRICT
AND ONE OF WHOM REPRESENTS A RURAL SCHOOL DISTRICT;
(II) ONE MEMBER WHO REPRESENTS A CHARTER
SCHOOL;
(III) THREE MEMBERS WHO REPRESENT THE
PRIVATE SECTOR FINANCE, BOND, AND INVESTMENT BANKING INDUSTRY;
(IV) TWO MEMBERS WHO REPRESENT THE CONSTRUCTION
ENGINEERING INDUSTRY AND HAVE EXPERIENCE IN CONSTRUCTING SCHOOL
BUILDINGS.
(2) (a) THE APPOINTED MEMBERS OF
THE BOARD SHALL SERVE TERMS OF THREE YEARS; EXCEPT THAT OF THE
MEMBERS FIRST APPOINTED, THE GOVERNOR SHALL SELECT FOUR WHO SHALL
SERVE TERMS OF TWO YEARS. NO MEMBER SHALL SERVE MORE THAN TWO
CONSECUTIVE THREEYEAR TERMS.
(b) THE GOVERNOR MAY REMOVE ANY APPOINTED
BOARD MEMBER FOR ANY CAUSE THAT RENDERS THE MEMBER INCAPABLE OF
DISCHARGING OR UNFIT TO DISCHARGE THE DUTIES OF THE OFFICE. WHENEVER
A VACANCY ON THE BOARD EXISTS DUE TO THE DEATH, DISQUALIFICATION,
REMOVAL, OR RESIGNATION OF A MEMBER, THE GOVERNOR SHALL APPOINT
A MEMBER FOR THE REMAINING PORTION OF THE UNEXPIRED TERM CREATED
BY THE VACANCY.
(c) THE MEMBERS OF THE BOARD SHALL SERVE
WITHOUT COMPENSATION BUT SHALL BE REIMBURSED FROM MONEYS IN THE
FUND FOR THEIR ACTUAL AND NECESSARY EXPENSES INCURRED IN THE PERFORMANCE
OF THEIR DUTIES PURSUANT TO THIS PART 2.
(3) IN ADDITION TO OTHER POWERS AND DUTIES
SPECIFIED IN THIS PART 2, THE BOARD SHALL PROMULGATE RULES IN
ACCORDANCE WITH ARTICLE 4 OF THIS TITLE FOR THE ADMINISTRATION
OF THIS PART 2, INCLUDING BUT NOT LIMITED TO:
(a) APPLICATION PROCEDURES BY WHICH SCHOOL
DISTRICTS MAY APPLY FOR FINANCIAL ASSISTANCE PURSUANT TO THIS
PART 2;
(b) TIMELINES FOR THE AWARDING AND REPAYMENT,
WHERE APPROPRIATE, OF FINANCIAL ASSISTANCE PURSUANT TO THIS PART
2;
(c) CRITERIA FOR DETERMINING THE TYPE
OF FINANCIAL ASSISTANCE AND THE AMOUNT TO BE GRANTED TO ANY SCHOOL
DISTRICT;
(d) FISCAL CONTROLS AND ACCOUNTING PROCEDURES
SUFFICIENT TO ASSURE PROPER ACCOUNTING DURING APPROPRIATE ACCOUNTING
PERIODS FOR:
(I) PAYMENTS RECEIVED BY THE FUND;
(II) DISBURSEMENTS MADE BY THE FUND; AND
(III) FUND BALANCES AT THE BEGINNING AND
END OF THE ACCOUNTING PERIOD.
2436204. Fund administration.
(1) THE GENERAL ASSEMBLY HEREBY FINDS THAT THE VARIOUS
FINANCING ARRANGEMENTS AND ARRANGEMENTS FOR FINANCIAL ASSISTANCE
AVAILABLE TO SCHOOL DISTRICTS THROUGH THE FUND ARE ARRANGEMENTS
WITH WHICH THE PRIVATE SECTOR HAS A GREAT DEAL OF EXPERIENCE AND
EXPERTISE. THE GENERAL ASSEMBLY FURTHER FINDS THAT ADMINISTRATION
OF THE FUND IN ACCORDANCE WITH THE PROVISIONS OF THIS PART 2 DOES
NOT INVOLVE DUTIES SIMILAR TO DUTIES CURRENTLY OR PREVIOUSLY PERFORMED
BY STATE EMPLOYEES.
(2) PURSUANT TO PART 5 OF ARTICLE 50 OF
THIS TITLE, THE TREASURY DEPARTMENT, IN CONSULTATION WITH THE
BOARD, SHALL ENTER INTO ONE OR MORE PERSONAL SERVICES CONTRACTS
THAT CREATE INDEPENDENT CONTRACTOR RELATIONSHIPS FOR ADMINISTRATION
OF THE FUND IN ACCORDANCE WITH THE PROVISIONS OF THIS PART 2 AND
RULES PROMULGATED BY THE BOARD.
(3) THE BOARD SHALL ADOPT RULES SPECIFYING
THE DUTIES OF THE FUND ADMINISTRATOR, WHICH DUTIES AT A MINIMUM
SHALL INCLUDE:
(a) REVIEWING APPLICATIONS FOR FINANCIAL
ASSISTANCE AND MAKING RECOMMENDATIONS TO THE BOARD CONCERNING
THOSE SCHOOL DISTRICTS THAT SHOULD RECEIVE FINANCIAL ASSISTANCE
PURSUANT TO THIS PART 2 BASED ON THE FACTORS SET FORTH IN SECTION
2436206 AND SUCH ADDITIONAL FACTORS AS THE BOARD MAY
ESTABLISH BY RULE;
(b) MAKING RECOMMENDATIONS TO THE BOARD CONCERNING THE AMOUNT AND TYPE OF FINANCIAL ASSISTANCE, AS DESCRIBED IN SECTION 2436207, TO BE GRANTED TO APPLYING SCHOOL DISTRICTS;
(c) IMPLEMENTING THE FISCAL CONTROLS AND
ACCOUNTING PROCEDURES SPECIFIED IN BOARD RULES;
(d) ASSISTING THE BOARD IN PREPARING THE
ANNUAL REPORT REQUIRED PURSUANT TO SECTION 2436208.
2436205. Twentyfirst
century school revolving loan fund created purpose.
(1) (a) THERE IS HEREBY ESTABLISHED IN THE STATE
TREASURY THE TWENTYFIRST CENTURY SCHOOL REVOLVING LOAN FUND.
THE FUND SHALL CONSIST OF MONEYS APPROPRIATED THERETO PURSUANT
TO PARAGRAPH (b) OF THIS SUBSECTION (1), ANY OTHER MONEYS THAT
MAY BE MADE AVAILABLE BY THE GENERAL ASSEMBLY, AND PAYMENTS OF
PRINCIPAL AND INTEREST ON LOANS MADE FROM THE FUND. ALL INTEREST
DERIVED FROM THE DEPOSIT AND INVESTMENT OF MONEYS IN THE FUND
SHALL BE CREDITED TO THE FUND. ANY MONEYS NOT APPROPRIATED SHALL
REMAIN IN THE FUND AND SHALL NOT BE TRANSFERRED OR REVERT TO THE
GENERAL FUND OF THE STATE AT THE END OF ANY FISCAL YEAR.
(b) FOR THE 200203 FISCAL YEAR,
THE GENERAL ASSEMBLY SHALL APPROPRIATE TO THE FUND TEN PERCENT
OF THE TOTAL AMOUNT OF MONEYS RECEIVED BY THE STATE PURSUANT TO
THE MASTER SETTLEMENT AGREEMENT DURING THE PRECEDING FISCAL YEAR.
BEGINNING WITH THE 200304 FISCAL YEAR AND FOR EACH FISCAL
YEAR THEREAFTER UNTIL THE 200607 FISCAL YEAR, THE GENERAL
ASSEMBLY SHALL DECREASE THE AMOUNT APPROPRIATED TO THE FUND BY
TWO PERCENT PER FISCAL YEAR. FOR THE 200607 FISCAL YEAR
AND FOR EACH FISCAL YEAR THEREAFTER SO LONG AS THE STATE RECEIVES
MONEYS PURSUANT TO THE MASTER SETTLEMENT AGREEMENT, THE GENERAL
ASSEMBLY SHALL ANNUALLY APPROPRIATE TO THE FUND TWO PERCENT OF
THE TOTAL AMOUNT OF MONEYS RECEIVED BY THE STATE PURSUANT TO THE
MASTER SETTLEMENT AGREEMENT DURING THE PRECEDING FISCAL YEAR.
(2) SUBJECT TO APPROPRIATION BY THE GENERAL
ASSEMBLY, MONEYS IN THE FUND SHALL BE USED TO PROVIDE FINANCIAL
ASSISTANCE TO APPLYING SCHOOL DISTRICTS THAT ARE UNDERTAKING QUALIFIED
CAPITAL CONSTRUCTION PROJECTS. SUCH FINANCIAL ASSISTANCE MAY BE
PROVIDED IN THE MANNER DESCRIBED IN SECTION 2436207.
IN ADDITION, UP TO FIVE PERCENT OF THE MONEYS IN THE FUND MAY
BE USED FOR THE EXPENSES INCURRED BY THE BOARD IN ADMINISTERING
THIS PART 2, INCLUDING BUT NOT LIMITED TO THE COSTS INCURRED IN
CONTRACTING FOR ADMINISTRATION OF THE FUND PURSUANT TO SECTION
2436204. ANY MONEYS NOT NEEDED TO PROVIDE FINANCIAL
ASSISTANCE TO SCHOOL DISTRICTS MAY BE INVESTED BY THE STATE TREASURER
AS PROVIDED IN SECTION 2436113.
2436206. Financial assistance
application requirements evaluation criteria.
(1) (a) EXCEPT AS OTHERWISE PROVIDED IN PARAGRAPH
(b) OF THIS SUBSECTION (1), APPLICATIONS FOR FINANCIAL ASSISTANCE
FROM THE FUND SHALL BE SUBMITTED TO THE BOARD NO LATER THAN JUNE
1 OF EACH YEAR FOR THE FISCAL YEAR BEGINNING ON THE NEXT JULY
1. INDIVIDUAL SCHOOLS MAY APPLY FOR MATCHING GRANTS THROUGH THE
SCHOOL DISTRICT IN WHICH THE SCHOOLS ARE LOCATED, AND THE SCHOOL
DISTRICT MAY, IN TURN, APPLY TO THE BOARD FOR SUCH GRANTS.
(b) THE BOARD MAY GRANT EXPEDITED APPROVAL
OF FINANCIAL ASSISTANCE BASED ON A SHOWING BY A SCHOOL DISTRICT
THAT FINANCIAL ASSISTANCE IS NECESSARY TO MITIGATE OR AVOID AN
EMERGENCY SITUATION THAT THREATENS THE HEALTH OR SAFETY OF STUDENTS
AND TEACHERS WITHIN THE SCHOOL DISTRICT.
(2) THE FUND ADMINISTRATOR SHALL EVALUATE
EACH APPLICATION BASED ON THE FACTORS SPECIFIED IN THIS SECTION
AND SUCH OTHER FACTORS AS THE BOARD MAY ESTABLISH BY RULE. BASED
ON SUCH EVALUATION, THE FUND ADMINISTRATOR SHALL MAKE RECOMMENDATIONS
TO THE BOARD CONCERNING WHICH SCHOOL DISTRICTS SHOULD RECEIVE
FINANCIAL ASSISTANCE PURSUANT TO THIS PART 2 AND THE AMOUNT AND
TYPE OF FINANCIAL ASSISTANCE THAT EACH SCHOOL DISTRICT SHOULD
RECEIVE. BASED ON THE FUND ADMINISTRATOR'S RECOMMENDATIONS, THE
BOARD SHALL SELECT THOSE SCHOOL DISTRICTS THAT SHALL RECEIVE FINANCIAL
ASSISTANCE PURSUANT TO THIS PART 2 AND SPECIFY THE AMOUNT AND
TYPE OF FINANCIAL ASSISTANCE THAT EACH SCHOOL DISTRICT SHALL RECEIVE.
(3) IT IS THE INTENT OF THE GENERAL ASSEMBLY
THAT SCHOOL DISTRICTS GIVE CONSIDERATION TO THE NEEDS OF BOTH
TRADITIONAL PUBLIC SCHOOLS AND CHARTER SCHOOLS ESTABLISHED PURSUANT
TO ARTICLE 30.5 OF TITLE 22, C.R.S., WHEN SUBMITTING APPLICATIONS
FOR FINANCIAL ASSISTANCE PURSUANT TO THIS PART 2.
(4) ALL APPLICATIONS SUBMITTED TO THE
BOARD SHALL BE IN A FORM PRESCRIBED BY RULE OF THE BOARD AND SHALL
INCLUDE:
(a) A DESCRIPTION OF THE SCOPE AND NATURE
OF THE CAPITAL CONSTRUCTION PROJECT;
(b) A DESCRIPTION OF THE ARCHITECTURAL,
FUNCTIONAL, AND CONSTRUCTION STANDARDS THAT ARE TO BE APPLIED
TO THE FACILITY THAT IS THE SUBJECT OF THE CAPITAL CONSTRUCTION
PROJECT;
(c) THE FORM AND AMOUNT OF FINANCIAL CONTRIBUTION
THAT WILL BE PROVIDED BY THE SCHOOL DISTRICT FOR THE CAPITAL CONSTRUCTION
PROJECT;
(d) WHETHER AN ELECTION IS REQUIRED BEFORE
THE SCHOOL DISTRICT CAN PROCEED WITH THE CAPITAL CONSTRUCTION
PROJECT AND, IF SO, THE ANTICIPATED DATE OF THE ELECTION;
(e) AN ACCOUNTING OF THE SCHOOL DISTRICT'S
CONTINGENCY RESERVES AND CAPITAL CONSTRUCTION RESERVES AND AN
EXPLANATION OF WHY THE SCHOOL DISTRICT IS SEEKING FINANCIAL ASSISTANCE
PURSUANT TO THIS SECTION;
(f) IF THE SCHOOL DISTRICT IS SEEKING
EXPEDITED APPROVAL OF ITS REQUEST FOR FINANCIAL ASSISTANCE PURSUANT
TO PARAGRAPH (b) OF SUBSECTION (1) OF THIS SECTION, INFORMATION
DEMONSTRATING THAT FINANCIAL ASSISTANCE IS NECESSARY TO MITIGATE
OR AVOID AN EMERGENCY SITUATION THAT THREATENS THE HEALTH OR SAFETY
OF STUDENTS AND TEACHERS WITHIN THE SCHOOL DISTRICT; AND
(g) SUCH OTHER INFORMATION AS THE BOARD MAY REQUIRE FOR THE EVALUATION OF THE CAPITAL CONSTRUCTION PROJECT.
(5) APPLICATIONS THAT DESCRIBE CAPITAL
CONSTRUCTION PROJECTS DEEMED ELIGIBLE FOR FINANCIAL ASSISTANCE
BY THE BOARD SHALL BE PRIORITIZED BASED ON THE FOLLOWING CRITERIA,
IN DESCENDING ORDER OF IMPORTANCE:
(a) CAPITAL CONSTRUCTION PROJECTS THAT
WILL ADDRESS IMMEDIATE SAFETY HAZARDS OR HEALTH CONCERNS AT EXISTING
SCHOOL FACILITIES, CONSIDERING THE AGE OF THE FACILITIES AND ANY
PREVIOUS RENOVATION WORK OR CONTROLLED MAINTENANCE THAT HAS BEEN
PERFORMED AT THE FACILITIES;
(b) CAPITAL CONSTRUCTION PROJECTS IN A
SCHOOL DISTRICT THAT HAS A LOWER RELATIVE WEALTH COMPARED TO OTHER
SCHOOL DISTRICTS IN THE STATE BASED ON THE PER PUPIL ASSESSED

THE SCHOOL DISTRICT IS ENTITLED RELATIVE TO THE DISTRICT'S TOTAL
PROGRAM, AS DEFINED IN SECTION 2254103 (6), C.R.S.
2436207. Types of financial
assistance. (1) MONEYS IN THE
FUND MAY BE DISTRIBUTED BY THE FUND ADMINISTRATOR IN ACCORDANCE
WITH THE PROVISIONS OF THIS PART 2 TO PROVIDE FINANCIAL ASSISTANCE
IN THE FOLLOWING FORMS:
(a) LOANS TO SCHOOL DISTRICTS, MADE AFTER
APPROVAL BY THE VOTERS IN THE SCHOOL DISTRICT AND MADE ON THE
FOLLOWING CONDITIONS:
(I) THAT SUCH LOANS ARE MADE AT OR BELOW
MARKET INTEREST RATES, INCLUDING INTERESTFREE LOANS, AT
TERMS NOT TO EXCEED TWENTY YEARS;
(II) THAT ANNUAL PRINCIPAL AND INTEREST
PAYMENTS SHALL COMMENCE NOT LATER THAN ONE YEAR AFTER COMPLETION
OF THE PROJECT FOR WHICH THE LOAN IS GRANTED, AND THAT ALL LOANS
SHALL BE FULLY AMORTIZED NOT LATER THAN TWENTY YEARS AFTER PROJECT
COMPLETION;
(III) THAT THE RECEIVING SCHOOL DISTRICT
SHALL ESTABLISH A DEDICATED SOURCE OF REVENUE FOR REPAYMENT OF
THE LOAN;
(IV) THAT THE FUND SHALL BE CREDITED WITH
ALL PAYMENTS OF PRINCIPAL AND INTEREST ON ALL LOANS;
(b) THE PURCHASE OR REFINANCING OF THE
DEBT OBLIGATIONS OF A SCHOOL DISTRICT AT OR BELOW MARKET RATES;
(c) DIRECT GRANTS TO SCHOOL DISTRICTS.
2436208. Annual report.
(1) THE BOARD, WITH THE ASSISTANCE OF THE FUND ADMINISTRATOR,
SHALL ANNUALLY PREPARE AND SUBMIT TO THE GOVERNOR, THE STATE BOARD
OF EDUCATION, AND THE JOINT BUDGET COMMITTEE AND EDUCATION COMMITTEES
OF THE GENERAL ASSEMBLY A REPORT CONCERNING IMPLEMENTATION OF
THE PROVISIONS OF THIS PART 2. AT A MINIMUM, THE REPORT SHALL
INCLUDE:
(a) A LIST OF THE PROJECTS THAT RECEIVED
FINANCIAL ASSISTANCE FROM THE FUND DURING THE PRECEDING YEAR,
INCLUDING THE TERMS OF THE FINANCIAL ASSISTANCE PROVIDED AND THE
COMMUNITIES SERVED;
(b) A DESCRIPTION OF THE SHORT AND
LONGTERM GOALS FOR ADMINISTRATION OF THE FUND;
(c) THE CRITERIA AND METHOD ESTABLISHED
FOR THE DISTRIBUTION OF MONEYS IN THE FUND.";

INTRODUCTION OF MEMORIAL
The following memorial was read by title and laid
over one day under the rules:
HJM99-1001 by Representative
Gordon; also Senator Feeley--Memorializing former United States
senator and state representative Floyd K. Haskell.
WHEREAS, By the Will of Divine Providence, our beloved
former United States Senator and member, Floyd K. Haskell, departed
this life August 25, 1998, at the age of 82; and
WHEREAS, Senator Haskell was born in 1916 in Morristown,
New Jersey; and
WHEREAS, Senator Haskell graduated from Harvard College
and Harvard Law School; and
WHEREAS, Senator Haskell served in the United States
Army during World War II, saw action in Asia, achieved the rank
of major, and was awarded a Bronze Star Medal for intelligence
work; and
WHEREAS, In 1941, Senator Haskell married Eileen
Nicoll, and, after his service in World War II, he and his wife
moved to Colorado, where he practiced law, specializing in tax
law, and participated in community affairs; and
WHEREAS, Senator Haskell and his wife Eileen had
three daughters, Ione, Evelyn, and Pamela; and
WHEREAS, Although he had built a successful law practice,
Senator Haskell saw public service as a duty, and, in 1964, while
residing in Littleton, Colorado, Senator Haskell was elected to
the Colorado House of Representatives as a registered Republican,
representing what was then house district number 6 in Arapahoe
County, and was reelected to an additional twoyear term
in 1966; and
WHEREAS, While a member of the House of Representatives,
Senator Haskell served in 1967 and 1968 as Assistant Majority
Leader and as Chair of the House Judiciary Committee and also
served as a member of the House Education and Finance Committees;
and
WHEREAS, In 1970, having returned to private life,
Senator Haskell changed his party registration to the Democratic
Party in opposition to the Vietnam War; and
WHEREAS, In 1972, Senator Haskell was elected to
the United States Senate from Colorado; and
WHEREAS, During his six years in the United States
Senate, Senator Haskell served as a member of the Senate Finance
and Energy and Natural Resources Committees, where, among other
things, he was recognized for his expertise and successful advocacy
in the areas of tax reform and environmental protection, having
helped create wilderness areas and encouraged the development
of alternative energy sources; and
WHEREAS, Among Senator Haskell's more significant
legislative accomplishments while serving as a member of the United
States Senate are the Payment in Lieu of Taxes Act, the Taxpayer
Privacy Act, and the Jobs Tax Credit Act; and
WHEREAS, Upon completion of his single term in the
United States Senate, Senator Haskell practiced law, served on
the board of Common Cause, and was active with a bipartisan group
of lawmakers seeking changes in campaign finance laws and trying
to break congressional gridlock; and
WHEREAS, In 1979, Senator Haskell married Nina Totenberg,
the legal affairs correspondent for National Public Radio; and
WHEREAS, Senator Haskell was deeply respected by
members of both parties in the United States Congress and the
Colorado General Assembly for his acumen, his scholarly understanding
of complex problems, his thoughtful approach to contested issues
and, above all, his patriotism, integrity, modesty, and fundamental
decency; and
WHEREAS, A man of grace and dignity, Senator Haskell
also showed himself to be a person of incredible grit and determination
as he fought valiantly against two long illnesses during the latter
years of his life; now, therefore,
Be It Resolved by the House of Representatives
of the Sixtysecond General Assembly of the State of Colorado,
the Senate concurring herein:
That, in the death of Floyd K. Haskell, the people
of the state of Colorado have lost a dedicated public servant
and outstanding citizen, and that we, the members of the House
of Representatives and the Senate of the Sixtysecond General
Assembly, do hereby extend our deep and heartfelt sympathy to
the members of his family and pay tribute to a man who served
his nation and state well and faithfully.
Be It Further Resolved, That copies of this Joint Memorial be sent to Senator Haskell's wife, Nina Totenberg, and daughters Ione Haskell, Evelyn Maxwell, and Pamela Haskell.

SB99-067, 089, 163, 173, 223, and 229 and repassed the bills as
amended.
The Senate has voted not to concur in House Amendments
to SB99-040 and requests that a Conference Committee be appointed.

The Senate has voted not to concur in House Amendments to SB99-154 and requests that a Conference Committee be appointed. The President appointed Senators Evans, Chm., Andrews, and Pascoe as members of the First Conference Committee on the part of the Senate. The bill is transmitted herewith.
