INTRODUCTION OF RESOLUTIONS

The following resolution was read by title and referred to the committee indicated:

HJR99-1006 by Representatives McPherson, Tool, Berry, and Saliman; also Senators Grampsas, Lacy, Owen, and Tanner-Concerning the certification by the general assembly of its estimate of state general fund revenues and allowable state spending for the 1999-2000 budget year.

Committee on Finance.

WHEREAS, The general assembly is required by section 24­75­201.3, Colorado Revised Statutes, to make an annual certification of its estimate of general fund revenues for the next fiscal year to the controller; and

WHEREAS, Gross general fund revenues for the 1999-2000 fiscal year, as estimated in this resolution, have already been obligated by law as follows:

(1)  $100,327,838 for transfer to the capital construction fund pursuant to section 24­75­302 (2) (l), Colorado Revised Statutes;

(2)  Amounts required by statute to be used for: Payments to local governments based on state cigarette tax collections; property tax and heat or fuel expense grants; and payments to the fire and police members' benefit fund; and

WHEREAS, Under current law, general fund revenues must be used first to fund the obligations set forth above, second to fund appropriations for the executive, legislative, and judicial departments, and third to fund the reserve mandated by section 24­75­201.1 (1) (d), Colorado Revised Statutes; and

WHEREAS, The general assembly recognizes that new programs can be funded from the general fund only after these three priorities are satisfied; and

WHEREAS, If appropriate statutes are amended, additional general fund revenues could be realized; and

WHEREAS, The estimate of general fund revenues certified in this resolution does not include the balance carried forward from the 1998-99 fiscal year; and

WHEREAS, The general assembly intends to make an annual certification of its estimate of the allowable state fiscal year spending amount under section 20 of article X of the state constitution and its estimate of the total allowable state general fund appropriations under section 24­75­201.1, Colorado Revised Statutes; and

WHEREAS, In accordance with the provisions of article 77 of title 24, Colorado Revised Statutes, the estimate of the allowable state fiscal year spending amount for the 1999-2000 fiscal year under said provisions will be based upon the following conclusions:

(1)  For the 1998-99 fiscal year, allowable state fiscal year spending is $7,236.2 million;

(2)  The percentage of allowable increase in state fiscal year spending for the 1999-2000 fiscal year is estimated to be 4.4 %; and

WHEREAS, In accordance with the provisions of section 24­75­201.1, Colorado Revised Statutes, the estimate of the allowable state general fund appropriations for the 1999-2000 fiscal year will be based upon the following conclusions:

(1)  State general fund appropriations for the 1998-99 fiscal year, prior to the enactment of any supplemental appropriations during the 1999 regular session, are $4,699.0 million;

(2)  The allowable increase in state general fund appropriations for the 1999-2000 fiscal year is the cost of reappraisal of taxable property for property tax purposes as required by section 39­1­105.5, Colorado Revised Statutes, plus 6% of the 1998-99 state general fund appropriations; and

WHEREAS, The revenue estimate and the estimates of spending made pursuant to this resolution are made for the purpose of providing direction and guidance to the joint budget committee in the preparation of the 1999-2000 general appropriation act and does not affect the ability of the general assembly to make spending decisions in the general appropriation act; and

WHEREAS, The revenue estimate and the estimates of spending made pursuant to this resolution may be adjusted if additional relevant information is received by the general assembly after the adoption thereof; and

WHEREAS, For purposes of section 39 of article V of the state constitution, this resolution relates solely to the transaction of business of the two houses of the general assembly; now, therefore,

Be It Resolved by the House of Representatives of the Sixty­second General Assembly of the State of Colorado, the Senate concurring herein:

That, in accordance with section 24­75­201.3, Colorado Revised Statutes, the general assembly hereby certifies to the controller of the state of Colorado that the estimate of gross general fund revenues for the fiscal year beginning July 1, 1999, is $5,700.9 million. The general assembly further certifies that the estimate of the allowable state fiscal year spending amount for the fiscal year beginning July 1, 1999, under section 20 of article X of the state constitution and article 77 of title 24, Colorado Revised Statutes, is $7,554.6 million and the estimate of the allowable state general fund appropriations for the fiscal year beginning July 1, 1999, under section 24­75­201.1, Colorado Revised Statutes, is $4,981.0 million.

Be It Further Resolved, That a copy of this Resolution be transmitted to the controller of the state of Colorado, Arthur L. Barnhart.

The following resolution was read by title and laid over until later in the day:

HR99-1007 by Representative Dean-Concerning a recount by the county clerk and recorder of Boulder county of certain ballots cast in Boulder county at the 1998 general election for the purpose of assisting the Committee on Credentials of the House of Representatives in determining the election contest in House District 31.

WHEREAS, Pam Rhodes was the Republican Party candidate and Paul Zimmerman was the Democratic Party candidate for the House of Representatives in House District 31 at the 1998 general election; and

WHEREAS, There were irregularities on ballots given to voters in one precinct in the Boulder county portion of House District 31 at such election; and

WHEREAS, The secretary of state ordered that a recount of the ballots be made pursuant to section 1­10­301, Colorado Revised Statutes, in view of the narrow margin in such election; and

WHEREAS, After the recount, the secretary of state certified Paul Zimmerman as the winner of the election in House District 31; and

WHEREAS, Pam Rhodes filed an election contest with the secretary of state contesting the election; and

WHEREAS, Such election contest between Pam Rhodes as contestor and Paul Zimmerman as contestee is presently before the Committee on Credentials of the House of Representatives for determination; and

WHEREAS, Section 10 of article V of the Colorado Constitution provides that each house of the General Assembly shall judge the election and qualifications of its members; and

WHEREAS, Pursuant to part 2 of article 11 of title 1, Colorado Revised Statutes, the House of Representatives must hear and determine election contests of its own members; and

WHEREAS, Pursuant to section 1­11­209 (3), Colorado Revised Statutes, and in furtherance of resolving an election contest, the House of Representatives may order a recount of the ballots in such election; and

WHEREAS, A recount by the county clerk and recorder of Boulder county of the absentee ballots and early voters' ballots cast in Boulder county at the 1998 general election will provide information to the House of Representatives on the number of such ballots cast in House District 31 that is necessary to determine and resolve the election contest between Pam Rhodes and Paul Zimmerman; now, therefore,

Be It Resolved by the House of Representatives of the Sixty­second General Assembly of the State of Colorado:

That we, the members of the House of Representatives of the Colorado General Assembly, hereby direct that:

(1)  The county clerk and recorder of Boulder county conduct a recount of the absentee ballots and early voters' ballots cast in Boulder county at the 1998 general election in order to determine the number of such ballots cast for the candidates in House District 31;

(2)  The county clerk and recorder of Boulder county choose a designated election official of a county, or such official's designee, who is a member of the Republican Party and a designated election official of a county, or such official's designee, who is a member of the Democratic Party to be present at and assist with such recount;

(3)  Pam Rhodes, Paul Zimmerman, and their attorneys of record in the House District 31 election contest pending before the House of Representatives may attend and observe such recount and may visually inspect the absentee ballots and early voters' ballots that are subject to such recount;

(4)  Such recount shall be completed by the county clerk and recorder of Boulder county no later than January 22, 1999, and the results thereof transmitted to the Committee on Credentials of the House of Representatives no later than January 25, 1999; and

(5)  The expense of conducting such recount of absentee ballots and early voters' ballots shall be the responsibility of Boulder county.

Be it Further Resolved, That copies of this Resolution be transmitted to Pam Rhodes, Paul Zimmerman, the county clerk and recorder of Boulder county, and the secretary of state.
