Amend engrossed bill, page 3, line 3, strike "APPLY."
and substitute "APPLY; EXCEPT THAT THE FINE OR PENALTY FOR
A VIOLATION CHARGED AND THE SURCHARGE THEREON IF AUTHORIZED BY
COUNTY ORDINANCE SHALL BE PAID TO THE COUNTY.".

"SECTION 4. 4241701
(5) (a), Colorado Revised Statutes, is amended to read:
4241701. Traffic offenses and infractions classified penalties penalty and surcharge schedule. (5) (a) At the time that any person is arrested for the commission of any misdemeanors, petty offenses, or misdemeanor traffic offenses set forth in subsection (4) of this section,
the arresting officer may, except when the provisions
of paragraph (c) of this subsection (5) prohibit it, offer to
give a penalty assessment notice to the defendant. At any time
that a person is charged with the commission of any traffic infraction,
the peace officer shall, except when the provisions of paragraph
(c) of this subsection (5) prohibit it, give a penalty assessment
notice to the defendant. Such penalty assessment notice shall
contain all the information required by section 4241707
(3) or by section 4241709, whichever is applicable.
The fine or penalty specified in subsection (4) of this section
for the violation charged and the surcharge thereon may be paid
at the office of the department of revenue, motor vehicle division,
either in person or by postmarking such payment within twenty
days from the date the penalty assessment notice is served upon
the defendant; EXCEPT THAT THE FINE OR PENALTY CHARGED AND THE
SURCHARGE THEREON SHALL BE PAID TO THE COUNTY IF IT RELATES TO
A TRAFFIC OFFENSE AUTHORIZED BY COUNTY ORDINANCE. The motor vehicle
division of the department of revenue shall accept late payment
of any penalty assessment up to twenty days after such payment
becomes due. In the case of an offense other than a traffic infraction,
a defendant who otherwise would be eligible to be issued a penalty
assessment notice but who does not furnish satisfactory evidence
of identity or who the officer has reasonable and probable grounds
to believe will disregard the summons portion of such notice may
be issued a penalty assessment notice if the defendant consents
to be taken by the officer to the nearest mailbox and to mail
the amount of the fine or penalty and surcharge thereon to the
department. The peace officer shall advise the person arrested
or cited of the points to be assessed in accordance with section
422127. Acceptance of a penalty assessment notice
and payment of the prescribed fine or penalty and surcharge thereon
to the department shall be deemed a complete satisfaction for
the violation, and the defendant shall be given a receipt which
so states when such fine or penalty and surcharge thereon is paid
in currency or other form of legal tender. Checks tendered by
the defendant to and accepted by the department and on which payment
is received by the department shall be deemed sufficient receipt.".

HB99-1050 be amended
as follows, and as so amended, be referred to the Committee of
the Whole with favorable recommendation:
Amend printed bill, page 9, strike lines 11 through
26, and substitute the following:
"SECTION 2. Allocation of money - appropriation.
(1) For the fiscal year beginning July 1, 1999, there is hereby
allocated from the operational account of the severance tax trust
fund, pursuant to section 39-29-109(1) (a) (II), Colorado Revised
Statutes, to the water needs assistance account created in section
37-60-205, Colorado Revised Statutes, the sum of two hundred twenty-eight
thousand two hundred ninety-four dollars ($228,294), for the administrative
costs of the basin planning efforts and preparation of reports
to the general assembly pursuant to part 2 of article 60 of title
37, Colorado Revised Statutes.
(2) In addition to any other appropriation, for the
fiscal year beginning July 1, 1999, there is hereby appropriated,
to the department of natural resources, for allocation to the
Colorado water conservation board and the division of water resources,
out of any moneys in the water needs assistance account, created
in section 37-60-205, Colorado Revised Statutes, the sum of two
hundred twenty-eight thousand two hundred ninety-four dollars
($228,294), or so much thereof as may be necessary, for the administrative
costs of the basin planning efforts and preparation of the reports
to the general assembly.".

health and environment, emergency response program, for program

WHEREAS, "Read Across America", a national
celebration of Dr. Seuss' birthday on March 2, 1999, promotes
reading and adult involvement in the education of our state's
children; and
WHEREAS, Thousands of businesses, community and education
groups, schools, and individuals across the country have pledged
their participation in this national celebration of reading; now,
therefore,
Be It Resolved by the House of Representatives
of the Sixtysecond General Assembly of the State of Colorado,
the Senate concurring herein:
That we, the members of the Colorado General Assembly,
do hereby call on the citizens of the state of Colorado to assure
that every child is in a safe place reading with a caring adult
on the evening of March 2, 1999;
Be It Further Resolved, That the General Assembly enthusiastically endorses "Read Across America" and recommits this state to engage in programs and activities to continue to support the ongoing efforts to make Colorado's children among the best readers in the country.

Gotlieb--Concerning the recognition of the Joy of Music Marathon.
WHEREAS, The Joy of Music Marathon will be held Friday,
February 26, through Sunday, February 28, 1999; and
WHEREAS, The Joy of Music Marathon will present fortyeight
continuous hours of live entertainment to raise funds for Songs
Across the Seas; and
WHEREAS, The Joy of Music Marathon will make Colorado
citizens more aware of the music education needs of children,
our many resources for filling them, the great diversity of musical
expression, the role of the performing arts in initiating and
galvanizing community effort, and the many talented and caring
performing artists in Colorado; and
WHEREAS, The Joy of Music Marathon will also provide the opportunity for community interaction, a venue for Colorado and international performing artists, a means for performing artists around the world to connect with each other to help children, and a forum for diversity in the performing arts; and
WHEREAS, The Governor and Mrs. Owens are especially
committed to helping children both in Colorado and around the
world; and
WHEREAS, The Joy of Music Marathon is unique in its
approach to raising the awareness of and funds for many worthwhile
children's programs; now, therefore,
Be It Resolved by the House of Representatives
of the Sixtysecond General Assembly of the State of Colorado:
That, Friday, February 26, through Sunday, February 28, 1999, the days of the Joy of Music Marathon, be dedicated toward achieving awareness of the music education needs of all children.

SJR99-010 by Senators Arnold, Anderson, Lamborn, Pascoe, Powers, Reeves, Tebedo, Wham; also Representatives Gotlieb, Alexander, Johnson, McPherson, Miller, Paschall--Concerning the Colorado General Assembly's opposition to any federal legislation that would mandate participation by state and local government employees in the federal social security system.
