"SECTION 3.  Exception to the requirements of section 2­2­703, Colorado Revised Statutes. The general assembly hereby finds that the amendment to section 18­16­401, Colorado Revised Statutes, in this act would require a five­year appropriation pursuant to the requirements of section 2­2­703, Colorado Revised Statutes, for prison bed construction and operating costs. However, it is the intent of the general assembly that any prison bed construction and operating costs resulting from the passage of this act be offset by prison bed savings and operating costs savings created by the amendment to section 42­2­206, Colorado Revised Statutes, in House Bill 99­1168, that are anticipated to be equal to or greater than the costs resulting from the passage of this act.

SECTION 4.  Effective date ­ applicability. (1)  This act shall take effect upon passage and shall apply to offenses committed on or after said date; except that this act shall only take effect if section 42­2­206, Colorado Revised Statutes, is amended in House Bill 99­1168 to change the penalty for driving with a revoked license from a class 6 felony to a class 1 misdemeanor and House Bill 99­1168 is enacted at the First Regular Session of the Sixty­second General Assembly and becomes law.".

"SECTION 3.  Appropriation. (1)  In addition to any other appropriation, there is hereby appropriated, to the department of health care policy and financing, for the fiscal year beginning July 1, 1999, the sum of one million six hundred twenty­one thousand six hundred twenty­three dollars ($1,621,623), or so much thereof as may be necessary, for the implementation of this act. Of said sum, five hundred seventy thousand three hundred seventy­three dollars ($570,373) shall be from the general fund, and one million fifty­one thousand two hundred fifty dollars ($1,051,250) shall be from federal funds anticipated to be received. The federal funds are noted for the purpose of indicating the assumptions used relative to these funds. Said sum shall be allocated as follows:

(a)  Sixteen thousand two hundred seventy­two dollars ($16,272) shall be allocated to the executive director's office, computer systems costs. Of said sum, eight thousand one hundred thirty­six dollars ($8,136) shall be from the general fund and eight thousand one hundred thirty­six dollars ($8,136) shall be from federal funds anticipated to be received.

(b)  Seventy­four thousand twenty­two dollars ($74,022) shall be allocated to medical services administration, for the early and periodic screening, diagnosis, and treatment program, and for computer system changes for the medicaid management information system. Of said sum, twenty­four thousand five hundred eleven dollars ($24,511) shall be from the general fund and subject to the "(M)" notation as defined in the general appropriation act, and forty­nine thousand five hundred eleven dollars ($49,511) shall be from federal funds anticipated to be received.

(c)  One million two hundred forty­one thousand six hundred eight dollars ($1,241,608) shall be allocated for medical services premiums. Of said sum, four hundred thirty­three thousand one hundred ninety­seven dollars ($433,197) shall be from the general fund and subject to the "(M)" notation as defined in the general appropriation act, and eight hundred eight thousand four hundred eleven dollars ($808,411) shall be from federal funds anticipated to be received.

(d)  Two hundred eighty­nine thousand seven hundred twenty­one dollars ($289,721) shall be allocated for department of human services programs. Of said sum, one hundred four thousand five hundred twenty­nine dollars ($104,529) shall be from the general fund and subject to the "(M)" notation as defined in the general appropriation act, and one hundred eighty­five thousand one hundred ninety­two dollars ($185,192) shall be from federal funds anticipated to be received.

(2)  In addition to any other appropriation, there is hereby appropriated, to the department of human services, for the fiscal year beginning July 1, 1999, the sum of three hundred thirty­eight thousand nine hundred ninety­five dollars ($338,995), or so much thereof as may be necessary, for the implementation of this act. Of said sum, three hundred five thousand nine hundred ninety­three dollars ($305,993) shall be from cash funds transferred from the department of health care policy and financing out of the appropriation made in subsection (1) of this section and thirty­three thousand two dollars ($33,002) shall be from local matching funds. Said sum shall be allocated as follows:

(a)  Sixteen thousand two hundred seventy­two dollars ($16,272) shall be allocated to the office of information technology services. Said sum shall be from cash funds transferred from the department of health care policy and financing out of the appropriation made in paragraph (a) of subsection (1) of this section.

(b)  One hundred sixty­five thousand twelve dollars ($165,012) shall be allocated to county administration. Of said sum, one hundred thirty­two thousand nine dollars ($132,009) shall be from cash funds transferred from the department of health care policy and financing out of the appropriation made in paragraph (d) of subsection (1) of this section and thirty­three thousand two dollars ($33,002) shall be from local matching funds.

(c)  One hundred fifty­seven thousand seven hundred twelve dollars ($157,712) shall be allocated to health and rehabilitation services, mental health community programs, for mental health capitation. Said sum shall be from cash funds transferred from the department of health care policy and financing out of the appropriation made in paragraph (d) of subsection (1) of this section.

(3)  In addition to any other appropriation, there is hereby appropriated, to the department of public health and environment, for the fiscal year beginning July 1, 1999, the sum of twenty­four thousand twenty­two dollars ($24,022), or so much thereof as may be necessary, for the implementation of this act. Said sum shall be from cash funds transferred from the department of health care policy and financing out of the appropriation made in paragraph (b) of subsection (1) of this section.

SECTION 4. Appropriation ­ adjustment in 1999 long bill. (1)  In addition to any other appropriation, there is hereby appropriated, out of any moneys in the general fund not otherwise appropriated, to the department of health care policy and financing, for the fiscal year beginning July 1, 1999, the sum of five hundred seventy thousand three hundred seventy­three dollars ($570,373), or so much thereof as may be necessary, for the implementation of this act.

(2)  For the implementation of this act, appropriations made in the annual general appropriations act for the fiscal year beginning July 1, 1999, shall be adjusted as follows:

(a)  The general fund appropriation to the capital construction fund outlined in section 3 (1) (f) is reduced by five hundred seventy thousand three hundred seventy­three dollars ($570,373).

(b)  The capital construction fund exempt appropriation to the department of transportation, construction projects, is reduced by five hundred seventy thousand three hundred seventy­three dollars ($570,373).".".

26­19­103.  Definitions. As used in this article, unless the context otherwise requires:

(6.3)  "MASTER SETTLEMENT AGREEMENT" MEANS THE MASTER SETTLEMENT AGREEMENT, THE SMOKELESS TOBACCO MASTER SETTLEMENT AGREEMENT, AND THE CONSENT DECREE APPROVED AND ENTERED BY THE COURT IN THE CASE DENOMINATED STATE OF COLORADO, EX REL. GALE A. NORTON, ATTORNEY GENERAL V. R.J. REYNOLDS TOBACCO CO.; AMERICAN TOBACCO CO., INC.; BROWN & WILLIAMSON TOBACCO CORP.; LIGGETT GROUP INC.; LORILLARD TOBACCO COMPANY; PHILLIP MORRIS, INC.; UNITED STATES TOBACCO CO.; B.A.T. INDUSTRIES, P.L.C.; THE COUNCIL FOR TOBACCO RESEARCH­­U.S.A., INC.; AND TOBACCO INSTITUTE, INC., CASE NO. 97 CV 3432, IN THE DISTRICT COURT FOR THE CITY AND COUNTY OF DENVER.

SECTION 3.  26­19­105, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:

26­19­105.  Trust ­ created. (2.5)  BEGINNING IN FISCAL YEAR 2000­01, THE GENERAL ASSEMBLY SHALL APPROPRIATE FROM THE MONEYS ANNUALLY RECEIVED BY THE STATE PURSUANT TO THE MASTER SETTLEMENT AGREEMENT AN AMOUNT NECESSARY TO PROVIDE SERVICES TO ALL ACTUAL AND POTENTIAL ENROLLEES; EXCEPT THAT THE AMOUNT APPROPRIATED IN ANY FISCAL YEAR SHALL NOT EXCEED THIRTY PERCENT OF THE TOTAL AMOUNT RECEIVED BY THE STATE PURSUANT TO THE MASTER SETTLEMENT AGREEMENT DURING THE PRECEDING FISCAL YEAR.

SECTION 4.  26­19­107 (1) (a), Colorado Revised Statutes, is amended to read:

26­19­107.  Duties of the department ­ schedule of services ­ premiums ­ copayments ­ subsidies. (1)  In addition to any other duties pursuant to this article, the department shall have the following duties:

(a) (I)  To design, on or after April 21, 1998, and from time to time revise, a schedule of health care services included in the plan and to propose said schedule to the policy board for approval or modification. The schedule of health care services as proposed by the department and approved by the policy board shall include, but shall not be limited to, preventive care, physician services, inpatient and outpatient hospital services, prescription drugs and medications, and other services that may be medically necessary for the health of enrollees. The department shall design and revise this schedule of health care services included in the plan to be similar to the basic and standard health benefit plans defined in section 10­16­102 (4) and (42), C.R.S.

(II)  IN ADDITION TO THE ITEMS SPECIFIED IN SUBPARAGRAPH (I) OF THIS PARAGRAPH (a) AND ANY ADDITIONAL ITEMS APPROVED BY THE POLICY BOARD, ON AND AFTER JULY 1, 2001, THE SCHEDULE OF HEALTH CARE SERVICES SHALL INCLUDE DENTAL SERVICES.".
