WHEREAS, The "National Labor Relations Act", 29 U.S.C. sec. 159 (a), grants certified labor organizations the authority to represent and contractually bind all employees in a bargaining unit, including those employees who prefer not to join, financially support, or be represented by a labor organization; and

WHEREAS, Some union officials consider this federally granted "exclusive representation" an unfair arrangement under state legislation that bans the mandatory collection of a service or other such fee from nonunion employees; and

WHEREAS, The General Assembly of the state of Colorado agrees that bargaining agreements negotiated by a labor organization should cover or bind only those employees who join or financially support such labor organizations; and

WHEREAS, The General Assembly believes that employees who choose not to join or financially support a labor organization should not be bound by the provisions of such labor organization's collective bargaining agreement, nor should they be required to accept such labor organization as their bargaining representative; now, therefore,

Be It Resolved by the House of Representatives of the Sixty­second General Assembly of the State of Colorado, the Senate concurring herein:

That the General Assembly of the state of Colorado strongly urges the Congress of the United States to repeal all provisions of federal law that allow or require a labor organization to represent employees who choose not to join or financially support such labor organization.

Be It Further Resolved, That copies of this resolution be sent to the Speaker of the House of Representatives, J. Dennis Hastert, Senate Majority Leader, Trent Lott, House Minority Leader, Richard Gephardt, Senate Minority Leader, Thomas Daschle, and each member of the Colorado congressional delegation.

"SECTION 10  34­60­104 (2) (a), Colorado Revised Statutes, is amended to read:

34­60­104.  Oil and gas conservation commission ­ report ­ publication. (2) (a)  Effective July 1, 1994 1999, the commission shall consist of seven members appointed by the governor, with the consent of the senate. At least one member shall be appointed from each congressional district in the state; except that one member shall be from west of the continental divide. Two FOUR members shall not be employed by the oil and gas industry and shall be individuals with formal training or substantial experience in agriculture, land reclamation, environmental protection, or soil conservation. Five THREE members shall be individuals with substantial experience in the oil and gas industry, and at least two of said five THREE members shall have a college degree in petroleum geology or petroleum engineering. No more than four members of the commission shall be members of the same political party. A vacancy on the commission occurs whenever any member moves out of the congressional district from which such member was appointed. Any member who moves out of such congressional district shall promptly notify the governor of the date of such move, but such notice is not a condition precedent to the occurrence of the vacancy. The governor shall fill the vacancy as provided in paragraph (b) of this subsection (2). In case one or more vacancies occur on the same day, the governor shall designate the order of filling vacancies.

SECTION 20  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.".

23­1­102.  Commission abolished ­ commission reestablished ­ terms of office.  (8) (a) NOTWITHSTANDING OTHER PROVISIONS OF THIS SECTION, ON OR AFTER JULY 1, 1999, THE GOVERNOR, WITH THE CONSENT OF THE SENATE, SHALL APPOINT TWO ADDITIONAL MEMBERS TO THE COMMISSION FOR TERMS ENDING ON JUNE 30, 2002; EXCEPT THAT ONE OF THE TWO ADDITIONAL MEMBERS SHALL BE APPOINTED FROM THE MEMBERSHIP OF THE COLORADO ADVANCED TECHNOLOGY INSTITUTE COMMISSION AS SUCH COMMISSION EXISTED PRIOR TO ITS ABOLITION ON JULY 1, 1999.

(b) THIS SUBSECTION (8) IS REPEALED, EFFECTIVE JULY 1, 2002.

SECTION 5.  23-1-110 (2), Colorado Revised Statutes, is amended to read:

23-1-110. Organization, meetings, and staff. (2)  (a) The governor shall appoint, with the consent of the senate, an executive director qualified by substantial training and experience in the field of higher education. The executive director shall be the executive officer of the commission and the department of higher education, shall serve at the pleasure of the governor, and shall receive compensation commensurate with the duties of the office as determined by the governor. The duties and responsibilities of the executive director shall be discharged in accordance with the policies, procedures, and directives of the commission. The executive director shall employ such professional and clerical personnel as deemed necessary to carry out the duties and functions of the commission. Offices held by the executive director and professional personnel are declared to be educational in nature and not under the state personnel system.

(b) ON JULY 1, 1999, CERTAIN EMPLOYEES OF THE COLORADO ADVANCED TECHNOLOGY INSTITUTE PRIOR TO SAID DATE SHALL BE TRANSFERRED TO AND BECOME EMPLOYEES OF THE COMMISSION. ANY SUCH EMPLOYEES WHO ARE CLASSIFIED EMPLOYEES IN THE STATE PERSONNEL SYSTEM AT THE TIME OF THE TRANSFER SHALL RETAIN ALL RIGHTS TO THE PERSONNEL SYSTEM AND RETIREMENT BENEFITS PURSUANT TO THE LAWS OF THIS STATE, AND THEIR SERVICES SHALL BE DEEMED TO HAVE BEEN CONTINUOUS. ALL TRANSFERS AND ANY ABOLISHMENT OF POSITIONS IN THE STATE PERSONNEL SYSTEM SHALL BE MADE AND PROCESSED IN ACCORDANCE WITH STATE PERSONNEL SYSTEM LAWS AND REGULATIONS. THE TRANSFER OF EMPLOYEES PURSUANT TO THIS PARAGRAPH (b) SHALL BE MADE IN ACCORDANCE WITH THE PROVISIONS OF SECTION 12 OF HOUSE BILL 99-1359 ENACTED AT THE FIRST REGULAR SESSION OF THE SIXTY-SECOND GENERAL ASSEMBLY.".

Renumber succeeding sections accordingly.

Page 15, after line 25, insert the following:

"SECTION 11.  Part 1 of article 20 of title 24, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read:

24-20-110. Transfer of employees to office of innovation and technology. This Report Amends the Rerevised Bill.

To the President of the Senate and the

Speaker of the House of Representatives:

Your first conference committee appointed on SB99­006, concerning payments for continuing care, has met and reports that it has agreed upon the following:

That the Senate accede to the House amendments made to the bill, as said amendments appear in the rerevised bill, with the following changes:

Amend rerevised bill, page 4, line 7, strike "THE" and substitute "WITH RESPECT TO AN ENROLLEE RETURNING TO THE LOCATION WHERE THE CONTINUING CARE SERVICES ARE TO BE PROVIDED PURSUANT TO THIS SECTION, THE";

strike lines 25 and 26.
