A BILL FOR AN ACT
101 CONCERNING REGULATION OF THE STATE LOTTERY BY THE STATE LOTTERY
102 DIVISION IN THE DEPARTMENT OF REVENUE, AND, IN CONNECTION
103 THEREWITH, AUTHORIZING THE INSTALLATION OF VIDEO LOTTERY
104 TERMINALS UNDER THE CONTROL OF THE DIVISION.
Bill Summary

adopted.)
Allows licensed casinos, class B horse racetracks, and greyhound
racetracks to apply to the lottery commission for authority to act as lottery
sales agents and have on their premises video lottery terminals (VLTs)
through which patrons can participate in the state lottery. Limits the
hours during which VLTs may be operated. Grants to the lottery
commission and the lottery division in the department of revenue the
authority to issue and revoke licenses, approve games, control the number
and type of VLTs that may be used, and monitor play through a central
computer system. Requires that at least 500 VLTs per location be
approved for installation at licensed horse and greyhound racetracks.
Provides that VLTs are to be owned and maintained by, and
operated at the expense of, either the commission or a technology
provider, but assigns to the sales agent the costs of utilities, security,
marketing, removal of and accounting for proceeds, validating tickets or
vouchers, and maintaining and upgrading the premises on which the
VLTs are located.
Allows sales agents to retain 45% of net machine income. In the
case of sales agents that are pari-mutuel licensees (i.e. racetracks),
requires that 10% be used to fund purses for live races, leaving the sales
agent with a net return of 35%, and allows sales agents that are

pari-mutuel licensees to pay pari-mutuel taxes to the Colorado racing
commission on a monthly schedule. Distributes the remaining revenue,
net of prizes and expenses, pursuant to article XXVII of the state
constitution ("GOCO"), to the conservation trust fund for distribution to
municipalities and counties and other eligible entities for parks,
recreation, and open space purposes; to the division of parks and outdoor
recreation for the acquisition, development, and improvement of new and
existing state parks, recreation areas, and recreational trails; to the board
of the great outdoors Colorado trust fund; and to the general fund.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. Legislative declaration. (1) The general assembly
3 hereby finds, determines, and declares that it is the policy of the state of
4 Colorado to preserve pari-mutuel racing as a part of Colorado's cultural
5 heritage. The general assembly further finds that the introduction of
6 video lottery terminals at licensed class B horse racetracks and licensed
7 greyhound racetracks is necessary to preserve pari-mutuel racing and
8 foster and encourage the industry's ability to compete with other forms of
9 entertainment within the state of Colorado and nationwide.
10 (2) The general assembly further finds, determines, and declares
11 that in order to further the great outdoors Colorado program goal to
12 preserve, protect, enhance, and manage the state's wildlife, park, river,
13 trail, and open space heritage, the introduction of video lottery terminals
14 at licensed class B horse racetracks, licensed greyhound racetracks, and
15 licensed gaming establishments is appropriate and provides the general
16 public with appropriate locations to participate in the Colorado lottery.
17 (3) The general assembly further finds, determines, and declares
18 that the introduction of video lottery terminals at licensed class B horse
19 racetracks, licensed greyhound racetracks, and licensed gaming

1 establishments will enhance the lottery's ability to generate revenue for
2 its constitutional beneficiaries and legislative priorities.
3 SECTION 2. 24-35-201, Colorado Revised Statutes, is amended
4 BY THE ADDITION OF THE FOLLOWING NEW SUBSECTIONS to
5 read:
6 24-35-201. Definitions. As used in this part 2, unless the context
7 otherwise requires:
8 (4.5) "LICENSED PREMISES" MEANS:
9 (a) A CLASS B TRACK, AS DEFINED IN SECTION 12-60-102 (4),
10 C.R.S., AT WHICH A RACE MEET OF HORSES, CONSISTING OF SIXTY RACE
11 DAYS WITH A MINIMUM OF NINE RACES ON EACH RACE DAY, IS BEING
12 CONDUCTED OR WAS CONDUCTED THE PREVIOUS YEAR, UNLESS OTHERWISE
13 AGREED TO BY AN ORGANIZATION REPRESENTING A MAJORITY OF THE
14 OWNERS OF HORSES PARTICIPATING AT SUCH RACE MEETS;
15 (b) A GREYHOUND TRACK, AS DEFINED IN SECTION 12-60-102 (10),
16 C.R.S., AT WHICH A RACE MEET OF GREYHOUNDS, CONSISTING OF SEVENTY
17 OR MORE RACE DAYS WITH A MINIMUM OF TWELVE RACES ON EACH RACE
18 DAY, IS BEING CONDUCTED OR WAS CONDUCTED DURING THE CURRENT
19 YEAR OR THE IMMEDIATELY PRECEDING YEAR; AND
20 (c) A LICENSED GAMING ESTABLISHMENT, AS DEFINED IN SECTION
21 12-47.1-103 (15), C.R.S.
22 (6) "NET MACHINE INCOME" MEANS THE VALUE OF ALL CURRENCY
23 PLACED INTO A VIDEO LOTTERY TERMINAL LESS THE VALUE OF ALL PAY
24 VOUCHERS ISSUED BY SUCH TERMINAL.
25 (7) "PARI-MUTUEL LICENSEE" MEANS A LICENSEE, AS DEFINED IN
26 SECTION 12-60-102 (17), C.R.S., THAT OWNS OR CONTROLS LICENSED

1 PREMISES, AS DEFINED IN PARAGRAPH (a) OR (b) OF SUBSECTION (4.5) OF
2 THIS SECTION.
3 (8) "RETAIL GAMING LICENSEE" MEANS A LICENSEE THAT HOLDS A
4 RETAIL GAMING LICENSE ISSUED PURSUANT TO SECTION 12-47.1-501 (1)
5 (c), C.R.S.
6 (9) "SALES AGENT" MEANS A LOTTERY SALES AGENT LICENSED
7 PURSUANT TO SECTION 24-35-206.
8 (10) "TECHNOLOGY PROVIDER" MEANS A PERSON WHO DESIGNS,
9 MANUFACTURES, INSTALLS, DISTRIBUTES, OR SUPPLIES VIDEO LOTTERY
10 TERMINALS FOR SALE OR USE IN THE STATE OF COLORADO.
11 (11) "VIDEO LOTTERY TERMINAL" MEANS A COMPUTERIZED VIDEO
12 GAME MACHINE THAT, WHEN ACTIVATED BY INSERTION OF CURRENCY IN
13 THE FORM OF BILLS, PLAYS OR SIMULATES THE PLAY OF A GAME APPROVED
14 BY THE COMMISSION AND AWARDS CREDITS, EVIDENCED BY A PRINTED PAY
15 VOUCHER REDEEMABLE FOR CASH, ON THE BASIS OF CHANCE. "VIDEO
16 LOTTERY TERMINAL" DOES NOT INCLUDE ANY MACHINE OR DEVICE THAT
17 DIRECTLY DISBURSES COINS, CASH, TOKENS, OR ANY ITEM OF VALUE OTHER
18 THAN A PRINTED VOUCHER.
19 SECTION 3. Part 2 of article 35 of title 24, Colorado Revised
20 Statutes, is amended BY THE ADDITION OF A NEW SECTION to
21 read:
22 24-35-222. Video lottery terminals - authorization -
23 requirements - report. (1) THE COMMISSION MAY AUTHORIZE THE
24 INSTALLATION AND OPERATION OF VIDEO LOTTERY TERMINALS BY SALES
25 AGENTS WHO MEET ALL QUALIFICATIONS SET FORTH IN THIS SECTION AND
26 SECTION 24-35-206. SUCH AUTHORIZATION SHALL BE EVIDENCED BY AN

1 ADDITIONAL LICENSE ISSUED BY THE COMMISSION IN ACCORDANCE WITH
2 THIS SECTION.
3 (2) (a) NO SALES AGENT SHALL INSTALL OR OPERATE A VIDEO
4 LOTTERY TERMINAL UNLESS:
5 (I) SUCH SALES AGENT IS, AND AT ALL TIMES WITHIN THE
6 IMMEDIATELY PRECEDING THIRTY-SIX MONTHS HAS BEEN, A RETAIL
7 GAMING LICENSEE AND THE VIDEO LOTTERY TERMINAL IS TO BE LOCATED
8 ON LICENSED PREMISES, AS DEFINED IN SECTION 24-35-201 (4.5) (c), THAT
9 ARE OWNED OR CONTROLLED BY THE SALES AGENT; OR
10 (II) SUCH SALES AGENT IS, AND AT ALL TIMES DURING THE
11 IMMEDIATELY PRECEDING THREE CALENDAR YEARS HAS BEEN, A
12 PARI-MUTUEL LICENSEE AND THE VIDEO LOTTERY TERMINAL IS TO BE
13 LOCATED ON LICENSED PREMISES, AS DEFINED IN SECTION 24-35-201 (4.5)
14 (a) OR (b), THAT ARE OWNED OR CONTROLLED BY THE SALES AGENT.
15 (b) NO SALES AGENT SHALL OPERATE A VIDEO LOTTERY TERMINAL
16 EXCEPT DURING THE HOURS OF OPERATION ESTABLISHED BY THE
17 COMMISSION.
18 (c) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (b) OF
19 THIS SUBSECTION (2), NO SALES AGENT SHALL OPERATE A VIDEO LOTTERY
20 TERMINAL UNLESS THE CENTRAL COMPUTER SYSTEM DESCRIBED IN
21 PARAGRAPH (h) OF SUBSECTION (7) OF THIS SECTION IS FULLY
22 FUNCTIONAL.
23 (d) NO SALES AGENT THAT IS A GREYHOUND PARI-MUTUEL
24 LICENSEE SHALL OPERATE A VIDEO LOTTERY TERMINAL AFTER THE LAST
25 DAY OF ANY CALENDAR MONTH UNLESS, IN THE TWELVE CALENDAR
26 MONTHS IMMEDIATELY PRECEDING SUCH MONTH, THERE HAVE BEEN AT

1 LEAST THREE HUNDRED DAYS OF LIVE GREYHOUND RACING CONDUCTED IN
2 THE STATE. FOR PURPOSES OF THIS PARAGRAPH (d), IF LIVE RACING IS
3 CONDUCTED AT MORE THAN ONE LOCATION ON ANY GIVEN DAY, THAT DAY
4 SHALL BE COUNTED AS A SINGLE DAY OF LIVE RACING.
5 (e) THE COMMISSION MAY SUSPEND OR REVOKE THE AUTHORITY
6 GRANTED TO A SALES AGENT UNDER THIS SECTION IF THE PREMISES ON
7 WHICH A VIDEO LOTTERY TERMINAL IS LOCATED CEASES TO QUALIFY AS A
8 LICENSED PREMISES UNDER SECTION 24-35-201 (4.5) OR FOR ANY OTHER
9 REASON FOR WHICH SUSPENSION, REVOCATION, OR DENIAL OF A LICENSE
10 IS AUTHORIZED UNDER THIS SECTION OR SECTION 24-35-206.
11 (3) NOTHING IN THIS SECTION SHALL BE CONSTRUED TO PERMIT
12 THE INSTALLATION OR OPERATION OF VIDEO LOTTERY TERMINALS AT ANY
13 LOCATION OTHER THAN A LICENSED CLASS B HORSE RACETRACK, LICENSED
14 GREYHOUND RACETRACK, OR LICENSED GAMING ESTABLISHMENT.
15 (4) THE COMMISSION SHALL DETERMINE THE NUMBER OF VIDEO
16 LOTTERY TERMINALS TO BE PLACED ON LICENSED PREMISES; EXCEPT THAT
17 THE COMMISSION SHALL APPROVE AT LEAST FIVE HUNDRED VIDEO
18 LOTTERY TERMINALS PER LOCATION ON LICENSED PREMISES OF A SALES
19 AGENT THAT IS A PARI-MUTUEL LICENSEE.
20 (5) THE DIRECTOR AND THE COMMISSION SHALL MANAGE AND
21 REGULATE THE OPERATION OF VIDEO LOTTERY TERMINALS IN ACCORDANCE
22 WITH THIS SECTION AND WITH THEIR POWERS AND DUTIES AS SET FORTH IN
23 SECTIONS 24-35-204 AND 24-35-208, RESPECTIVELY. NOTHING IN THIS
24 SECTION SHALL BE CONSTRUED TO DIMINISH THE AUTHORITY OF THE
25 COLORADO LIMITED GAMING CONTROL COMMISSION OR THE COLORADO
26 RACING COMMISSION, AND SAID AGENCIES ARE AUTHORIZED AND

1 ENCOURAGED TO COORDINATE THEIR EFFORTS WITH THOSE OF THE
2 COMMISSION UNDER THIS SECTION.
3 (6) EACH VIDEO LOTTERY TERMINAL SHALL BE APPROVED IN
4 ACCORDANCE WITH RULES ADOPTED BY THE COMMISSION.
5 (7) IN ADDITION TO ANY OTHER REQUIREMENTS SET FORTH IN THIS
6 SECTION, EACH VIDEO LOTTERY TERMINAL APPROVED UNDER THIS SECTION
7 SHALL:
8 (a) OFFER ONLY GAMES LICENSED AND AUTHORIZED BY THE
9 COMMISSION;
10 (b) NOT HAVE ANY MEANS OF MANIPULATION BY A PLAYER OR
11 OTHER UNAUTHORIZED PERSON THAT WOULD AFFECT THE PROBABILITY OF
12 WINNING A GAME;
13 (c) HAVE ONE OR MORE MECHANISMS THAT ACCEPT CURRENCY IN
14 THE FORM OF BILLS; EXCEPT THAT EACH SUCH MECHANISM SHALL BE
15 DESIGNED TO PREVENT OBTAINING CREDITS WITHOUT PAYMENT BY
16 STRINGING, SLAMMING, DRILLING, OR ANY OTHER MEANS, AND, IF SUCH
17 ATTEMPTS INVOLVE PHYSICAL TAMPERING WITH THE TERMINAL, THE
18 TERMINAL SHALL BE DESIGNED TO CEASE OPERATING UNTIL IT IS RESET;
19 (d) HAVE NONRESETTABLE METERS, HOUSED IN A READILY
20 ACCESSIBLE BUT LOCKED AREA OF THE TERMINAL, THAT KEEP A
21 PERMANENT RECORD OF ALL CURRENCY INSERTED INTO THE TERMINAL,
22 ALL REFUNDS OF WINNINGS MADE BY THE TERMINAL'S PRINTER, AND ALL
23 CREDITS PLAYED FOR AND WON BY PLAYERS AT THE TERMINAL;
24 (e) BE CAPABLE OF PRINTING A PAY VOUCHER THAT STATES:
25 (I) THE VALUE OF THE PRIZE, IF ANY, AWARDED TO THE PLAYER AT
26 THE COMPLETION OF EACH GAME;

1 (II) THE TIME OF DAY, IN A TWENTY-FOUR-HOUR FORMAT,
2 SHOWING HOURS AND MINUTES;
3 (III) THE DATE;
4 (IV) THE TERMINAL'S SERIAL NUMBER;
5 (V) THE SEQUENTIAL NUMBER OF THE PAY VOUCHER;
6 (VI) AN ENCRYPTED VALIDATION NUMBER FROM WHICH THE
7 VALIDITY OF THE PRIZE MAY BE DETERMINED; AND
8 (VII) A NUMBER, GENERATED INDEPENDENTLY OF THE COMPUTER
9 SYSTEM DESCRIBED IN PARAGRAPH (h) OF THIS SUBSECTION (7), TO VERIFY
10 THE AUTHENTICITY OF THE VOUCHER;
11 (f) HAVE ACCOUNTING SOFTWARE THAT KEEPS AN ELECTRONIC
12 RECORD THAT INCLUDES, BUT IS NOT LIMITED TO, THE FOLLOWING:
13 (I) THE TOTAL AMOUNT OF CASH INSERTED INTO THE TERMINAL;
14 (II) THE VALUE OF WINNING TICKETS CLAIMED BY PLAYERS;
15 (III) THE TOTAL VIDEO LOTTERY TERMINAL CREDITS PLAYED AND
16 AWARDED IN A VIDEO LOTTERY TERMINAL GAME; AND
17 (IV) THE PAYBACK PERCENTAGE CREDITED TO PLAYERS OF EACH
18 VIDEO LOTTERY TERMINAL GAME;
19 (g) LIMIT, IN ACCORDANCE WITH RULES OF THE COMMISSION, THE
20 AGGREGATE AMOUNT OF CASH AND CREDITS THAT ANY PLAYER OF A VIDEO
21 LOTTERY TERMINAL GAME CAN WAGER ON ANY CHANCE FOR A PRIZE; AND
22 (h) BE CONNECTED TO AND MONITORED BY A CENTRAL COMPUTER
23 SYSTEM UNDER THE CONTROL OF THE DIVISION. PROCUREMENT OF THE
24 NECESSARY HARDWARE, SOFTWARE, AND SERVICES FOR THE SYSTEM
25 SHALL BE EFFECTED UNDER APPLICABLE STATE PURCHASING RULES. THE
26 DIVISION SHALL USE ITS BEST EFFORTS TO MEET A TARGET DATE OF

1 DECEMBER 1, 1999, FOR INSTALLATION AND OPERATIONAL READINESS OF
2 THE SYSTEM.
3 (8) EACH SALES AGENT OPERATING A VIDEO LOTTERY TERMINAL
4 PURSUANT TO THIS SECTION SHALL MAINTAIN A BOOTH OR WINDOW ON THE
5 LICENSED PREMISES FOR THE COLLECTION OF VOUCHERS AND FOR THE
6 ISSUANCE OF PRIZES IN THE FORM OF CASH IN EXCHANGE FOR WINNING
7 VOUCHERS. THE BOOTH OR WINDOW SHALL REMAIN OPEN AT ALL TIMES
8 DURING WHICH A VIDEO LOTTERY TERMINAL IS IN OPERATION ON THE
9 LICENSED PREMISES.
10 (9) THE COMMISSION IS AUTHORIZED TO ADOPT RULES AS
11 NECESSARY TO IMPLEMENT THIS SECTION AND TO MONITOR AND REGULATE
12 THE OPERATION OF VIDEO LOTTERY TERMINALS, AND IS SPECIFICALLY
13 AUTHORIZED TO SUSPEND, FINE, ADMONISH, OR REVOKE THE LICENSE OF
14 ANY LICENSEE FOUND BY THE COMMISSION TO HAVE ALLOWED AN
15 UNDERAGE PERSON TO ENTER A LICENSED PREMISES FOR THE PURPOSE OF
16 USING A VIDEO LOTTERY TERMINAL.
17 (10) THE COMMISSION SHALL EXAMINE AND APPROVE PROTOTYPES
18 OF VIDEO LOTTERY TERMINALS, ASSOCIATED EQUIPMENT, AND SOFTWARE
19 OF TECHNOLOGY PROVIDERS BEFORE SUCH TERMINALS ARE PLACED IN
20 OPERATION. THE COMMISSION SHALL REQUIRE THAT TECHNOLOGY
21 PROVIDERS SEEKING EXAMINATION AND APPROVAL PAY THE ANTICIPATED
22 ACTUAL COSTS OF THE EXAMINATION IN ADVANCE. UPON COMPLETION OF
23 THE EXAMINATION, THE COMMISSION SHALL REFUND ANY OVERPAYMENTS
24 OR UNINCURRED CHARGES ASSOCIATED WITH THE EXAMINATION AND
25 SHALL COLLECT ANY AMOUNTS NECESSARY TO REIMBURSE THE
26 COMMISSION FOR UNDERPAYMENTS OF ACTUAL COSTS ASSOCIATED WITH

1 THE EXAMINATION.
2 (11) ALL EXPENSES NECESSARY TO PURCHASE OR LEASE, INSTALL,
3 MAINTAIN, AND OPERATE VIDEO LOTTERY TERMINALS, OTHER THAN COSTS
4 ASSOCIATED WITH UTILITIES, SECURITY, MARKETING, REMOVAL OF
5 CURRENCY FROM VIDEO LOTTERY TERMINALS, ACCOUNTING FOR AND
6 DEPOSITING RECEIPTS, TICKET OR VOUCHER VALIDATION, FACILITIES
7 MAINTENANCE, AND UPGRADING LICENSED PREMISES TO ACCOMMODATE
8 THE TERMINALS, SHALL BE BORNE BY THE COMMISSION OR BY A
9 TECHNOLOGY PROVIDER. MARKETING AND ADVERTISING RELATED TO
10 VIDEO LOTTERY TERMINALS SHALL BE SUBJECT TO THE APPROVAL OF THE
11 COMMISSION. NOTHING IN THIS SUBSECTION (11) SHALL BE CONSTRUED TO
12 PRECLUDE THE COMMISSION FROM ADVERTISING OR MARKETING VIDEO
13 LOTTERY TERMINALS.
14 (12) (a) COMPENSATION TO BE PAID TO SALES AGENTS THAT ARE
15 PARI-MUTUEL LICENSEES OR RETAIL GAMING LICENSEES SHALL BE
16 FORTY-FIVE PERCENT OF NET MACHINE INCOME, WHICH IS THE AMOUNT
17 THAT THE GENERAL ASSEMBLY HAS DETERMINED IS REQUIRED TO ASSURE
18 THAT SALES AGENTS CONSIDERING INSTALLING VIDEO LOTTERY TERMINALS
19 WILL HAVE AN ADEQUATE INCENTIVE TO DO SO; EXCEPT THAT, IN THE CASE
20 OF A SALES AGENT THAT IS A PARI-MUTUEL LICENSEE, TEN PERCENT OF THE
21 ANNUAL NET MACHINE INCOME SHALL BE HELD BY THE SALES AGENT IN A
22 SEPARATE BANK ACCOUNT AND USED BY THE SALES AGENT TO FUND
23 PURSES FOR THE LIVE RACES AT THE LICENSED PREMISES. OF SUCH
24 FUNDING FOR PURSES, NO MORE THAN TWENTY PERCENT ANNUALLY SHALL
25 BE USED TO FUND PURSES FOR STAKES RACES.
26 (b) FOR ADMINISTRATIVE CONVENIENCE, SALES AGENTS THAT ARE

1 PARI-MUTUEL LICENSEES MAY PAY TO THE RACING COMMISSION ANY
2 PARI-MUTUEL TAX REQUIRED BY ARTICLE 60 OF TITLE 12, C.R.S., ON A
3 MONTHLY SCHEDULE.
4 (13) OF THE PROCEEDS RECEIVED FROM THE OPERATION OF VIDEO
5 LOTTERY TERMINALS, THE DIVISION SHALL FIRST REMIT TO SALES AGENTS
6 THE COMPENSATION SET FORTH IN SUBSECTION (12) OF THIS SECTION AND
7 PAY OTHER EXPENSES. THE BALANCE OF SUCH PROCEEDS, NET OF PRIZES
8 AND EXPENSES, SHALL BE DISTRIBUTED IN ACCORDANCE WITH SECTION 3
9 (1) (b) OF ARTICLE XXVII OF THE STATE CONSTITUTION, TO THE
10 CONSERVATION TRUST FUND FOR DISTRIBUTION TO MUNICIPALITIES AND
11 COUNTIES AND OTHER ELIGIBLE ENTITIES FOR PARKS, RECREATION, AND
12 OPEN SPACE PURPOSES; TO THE DIVISION OF PARKS AND OUTDOOR
13 RECREATION FOR THE ACQUISITION, DEVELOPMENT, AND IMPROVEMENT OF
14 NEW AND EXISTING STATE PARKS, RECREATION AREAS, AND RECREATIONAL
15 TRAILS; TO THE BOARD OF THE GREAT OUTDOORS COLORADO TRUST FUND;
16 AND TO THE GENERAL FUND.
17 (14) THE SUPERVISORY FUNCTIONS OF THE DIVISION PURSUANT TO
18 THIS SECTION SHALL BE SUBJECT TO TERMINATION AT THE TIME OF THE
19 TERMINATION OF THE DIVISION AS PROVIDED IN SECTION 24-35-218. THE
20 EFFECTS OF THE IMPLEMENTATION OF THIS SECTION SHALL BE INCLUDED
