Bill Summary

Establishes the communications and information technology committee.
In addition to assuming the responsibilities of the joint legislative computer
management committee, requires the committee to review the following
operations:
The commission on information management;
Telecommunications coordination within state government;
General government computer center;
Division of state archives and public records;
Central indexing system board.
Requires the committee to review the duties of the state personnel
director and the secretary of state in connection with the administration of such
operations or the successor to such duties.
Authorizes the committee to make recommendations to the joint budget
committee and the general assembly concerning appropriations and changes to
those duties.
Specifies the membership of the committee. Requires the committee to
make findings and recommendations including necessary legislation by a
specified date.

1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. Article 30 of title 24, Colorado Revised Statutes,
3 is amended BY THE ADDITION OF A NEW PART to read:

5 COMMUNICATIONS AND INFORMATION TECHNOLOGY
6 COMMITTEE
7 24-30-2001. Communications and information technology
8 committee. (1) THERE IS HEREBY ESTABLISHED A JOINT COMMITTEE OF
9 THE SENATE AND HOUSE OF REPRESENTATIVES OFFICIALLY KNOWN AS THE
10 COMMUNICATIONS AND INFORMATION TECHNOLOGY COMMITTEE,
11 REFERRED TO IN THIS PART 20 AS THE "COMMITTEE". THE COMMITTEE
12 SHALL REPLACE AND SUCCEED TO THE DUTIES AND RESPONSIBILITIES OF
13 THE JOINT LEGISLATIVE COMPUTER MANAGEMENT COMMITTEE
14 ESTABLISHED BY THE EXECUTIVE COMMITTEE OF LEGISLATIVE COUNCIL.
15 IN ADDITION TO ASSUMING THE DUTIES AND RESPONSIBILITIES OF THE JOINT
16 LEGISLATIVE COMPUTER MANAGEMENT COMMITTEE, THE COMMITTEE
17 SHALL:
18 (a) REVIEW THE OPERATIONS OF THE STATE AGENCIES DESCRIBED
19 IN SUBSECTION (2) OF THIS SECTION;
20 (b) REVIEW THE DUTIES OF THE EXECUTIVE DIRECTOR OF THE
21 DEPARTMENT OF PERSONNEL AND THE SECRETARY OF STATE IN
22 CONNECTION WITH THE ADMINISTRATION OF SUCH AGENCIES OR OF ANY
23 DEPARTMENT OR AGENCY HEAD SUCCEEDING TO SUCH DUTIES;
24 (c) MAKE RECOMMENDATIONS TO THE GENERAL ASSEMBLY AND
25 THE JOINT BUDGET COMMITTEE CONCERNING APPROPRIATIONS AND
26 CHANGES TO SUCH OPERATIONS AND DUTIES.

1 (2) THE AREAS THE COMMITTEE MAY ADDRESS INCLUDE, BUT ARE
2 NOT LIMITED TO, THE FOLLOWING:
3 (a) (I) THE DUTIES OF THE COMMISSION ON INFORMATION
4 MANAGEMENT SPECIFIED IN PART 17 OF THIS ARTICLE;
5 (II) THE POWERS, DUTIES, AND FUNCTIONS CONCERNING
6 TELECOMMUNICATIONS COORDINATION WITHIN STATE GOVERNMENT
7 SPECIFIED IN PART 9 OF THIS ARTICLE;
8 (III) THE DUTIES OF THE GENERAL GOVERNMENT COMPUTER
9 CENTER SPECIFIED IN PART 16 OF THIS ARTICLE;
10 (IV) THE DUTIES OF THE DIVISION OF STATE ARCHIVES AND PUBLIC
11 RECORDS SPECIFIED IN PART 1 OF ARTICLE 80 OF THIS TITLE;
12 (V) THE DUTIES OF THE CENTRAL INDEXING SYSTEM BOARD
13 SPECIFIED IN SECTION 4-9.3-103, C.R.S.;
14 (b) THE DUTIES OF ANY PRINCIPAL DEPARTMENT OF STATE
15 GOVERNMENT OR OTHER STATE AGENCY THAT MAY BE CREATED FOR THE
16 PURPOSE OF SUCCEEDING TO, COORDINATING, OR INCLUDING ANY OR ALL
17 OF THE DUTIES OF THE STATE AGENCIES DESCRIBED IN PARAGRAPH (a) OF
18 THIS SUBSECTION (2);
19 (c) THE DUTIES OF THE EXECUTIVE DIRECTOR OF THE DEPARTMENT
20 OF PERSONNEL AND THE SECRETARY OF STATE IN CONNECTION WITH THE
21 ADMINISTRATION OF THE AGENCIES DESCRIBED IN PARAGRAPH (a) OF THIS
22 SUBSECTION (2);
23 (d) THE DUTIES OF THE HEAD OF A PRINCIPAL DEPARTMENT OR
24 STATE AGENCY DESCRIBED IN PARAGRAPH (b) OF THIS SUBSECTION (2);
25 (e) THE BUDGET PROCESS OF A STATE AGENCY DESCRIBED IN

8 DESCRIBED IN PARAGRAPH (a) OR (b) OF THIS SUBSECTION (2);
9 (h) THE AUTHORITIES AND RESPONSIBILITIES RELATING TO A STATE
10 AGENCY DESCRIBED IN PARAGRAPH (a) OR (b) OF THIS SUBSECTION (2);
11 (i) ANY ANNUAL REPORT PREPARED BY A STATE AGENCY
12 DESCRIBED IN PARAGRAPH (a) OR (b) OF THIS SUBSECTION (2);
13 (j) ANY ANNUAL REPORT OF A STATE AGENCY NOT DESCRIBED IN
14 PARAGRAPH (i) OF THIS SUBSECTION (2) THAT, PURSUANT TO LAW, MUST
15 BE SUBMITTED TO A STATE AGENCY DESCRIBED IN PARAGRAPH (a) OR (b)
16 OF THIS SUBSECTION (2).
17 [(3) ANY STATE AGENCY THAT IS SUBJECT TO THE PROVISIONS OF
18 SUBSECTION (2) OF THIS SECTION SHALL MAKE AVAILABLE TO THE
19 COMMITTEE SUCH DATA, REPORTS, AND INFORMATION AS ARE NECESSARY
20 FOR THE PERFORMANCE OF THE COMMITTEE'S DUTIES.]
21 [(4)] THE COMMITTEE SHALL CONSIST OF TWO MAJORITY PARTY
22 MEMBERS AND ONE MINORITY PARTY MEMBER FROM THE HOUSE OF
23 REPRESENTATIVES APPOINTED BY THE SPEAKER OF THE HOUSE OF
24 REPRESENTATIVES AND TWO MAJORITY PARTY MEMBERS AND ONE
25 MINORITY PARTY MEMBER FROM THE SENATE APPOINTED BY THE
26 PRESIDENT OF THE SENATE. THE INITIAL MEMBERS OF THE COMMITTEE

1 SHALL BE APPOINTED BY JULY 1, 1999.
2 [(5)] THE COMMITTEE SHALL ELECT A CHAIRPERSON AND A
3 VICE-CHAIRPERSON AT THE FIRST MEETING HELD ON OR AFTER OCTOBER
4 15 IN EACH ODD-NUMBERED YEAR AND AT THE FIRST MEETING HELD AFTER
5 THE GENERAL ELECTION IN EACH EVEN-NUMBERED YEAR. THE
6 CHAIRPERSONSHIP AND VICE-CHAIRPERSONSHIP SHALL ALTERNATE
7 BETWEEN A MEMBER OF THE MAJORITY PARTY FROM THE HOUSE OF
8 REPRESENTATIVES AND A MEMBER OF THE MAJORITY PARTY FROM THE
9 SENATE WITH THE FIRST CHAIRPERSON BEING FROM THE HOUSE OF
10 REPRESENTATIVES AND THE FIRST VICE-CHAIRPERSON BEING FROM THE
11 SENATE. THE PERSON SERVING AS CHAIRPERSON, OR A MEMBER OF THE
12 SAME HOUSE IF SUCH PERSON IS NO LONGER A MEMBER THEREOF, SHALL
13 SERVE AS VICE-CHAIRPERSON DURING THE NEXT LEGISLATIVE SESSION,
14 AND THE PERSON SERVING AS VICE-CHAIRPERSON, OR A MEMBER OF THE
15 SAME HOUSE IF SUCH PERSON IS NO LONGER A MEMBER THEREOF, SHALL
16 SERVE AS CHAIRPERSON DURING THE NEXT LEGISLATIVE SESSION.
17 [(6)] THE COMMITTEE SHALL MAKE FINDINGS AND
18 RECOMMENDATIONS REGARDING THE ITEMS REVIEWED UNDER THIS
19 SECTION, INCLUDING, BUT NOT LIMITED TO, ANY NECESSARY LEGISLATION.
20 BEGINNING IN THE YEAR 2001, THE COMMITTEE SHALL SUBMIT A WRITTEN
21 REPORT ON ITS FINDINGS AND RECOMMENDATIONS TO THE GENERAL
22 ASSEMBLY AND THE JOINT BUDGET COMMITTEE ON OR BEFORE NOVEMBER
23 15 OF EACH YEAR. LEGISLATION RECOMMENDED BY THE COMMITTEE
24 SHALL BE TREATED AS LEGISLATION RECOMMENDED BY ANY OTHER
25 LEGISLATIVE COMMITTEE FOR PURPOSES OF ANY INTRODUCTION
26 DEADLINES OR BILL LIMITATIONS IMPOSED BY THE JOINT RULES OF THE

1 SENATE AND THE HOUSE OF REPRESENTATIVES OF THE GENERAL ASSEMBLY.
2 [(7)] THE COMMITTEE SHALL MEET AT LEAST THREE TIMES PER YEAR
3 TO FULFILL ITS RESPONSIBILITIES UNDER THIS SECTION, INCLUDING
4 MEETING AS NECESSARY WITH REPRESENTATIVES OF THE STATE AGENCIES
5 DESCRIBED IN THIS SECTION TO PROVIDE OPPORTUNITIES FOR THE
6 PRESENTATION OF TESTIMONY BY ANY INTERESTED INDIVIDUALS. THE
7 COMMITTEE SHALL FUNCTION DURING THE LEGISLATIVE SESSION AND
8 DURING THE INTERIM BETWEEN LEGISLATIVE SESSIONS.
9 [(8)] MEMBERS OF THE COMMITTEE SHALL BE REIMBURSED FOR
10 NECESSARY EXPENSES IN CONNECTION WITH THE PERFORMANCE OF THEIR
11 DUTIES AND SHALL BE PAID THE SAME PER DIEM AS OTHER MEMBERS OF
12 LEGISLATIVE COMMITTEES IN ATTENDANCE AT MEETINGS.
13 [(9)] THE LEGISLATIVE COUNCIL STAFF SHALL BE MADE AVAILABLE
14 TO ASSIST THE COMMITTEE IN CARRYING OUT ITS DUTIES UNDER THIS
15 SECTION. ALL PERSONNEL OF ANY STATE AGENCY DESCRIBED IN
16 PARAGRAPH (a) OR (b) OF SUBSECTION (2) OF THIS SECTION SHALL
17 COOPERATE WITH THE COMMITTEE AND WITH ANY PERSONS ASSISTING THE
18 COMMITTEE IN CARRYING OUT ITS DUTIES UNDER THIS SECTION.
19 [SECTION 2. Appropriation - adjustment in 1999 long bill. (1)
20 In addition to any other appropriation, there is hereby appropriated, out
21 of any moneys in the general fund not otherwise appropriated, to the
22 legislative department, for the fiscal year beginning July 1, 1999, the sum
23 of fifty-four thousand seven hundred nine dollars ($54,709) and 1.1 FTE,
24 or so much thereof as may be necessary, for the implementation of this
25 act. Of said sum, forty thousand two hundred fifty-four dollars ($40,254)
26 and 1.0 FTE shall be allocated to the legislative council, three thousand

1 seven hundred twenty-seven dollars ($3,727) and 0.1 FTE shall be
2 allocated to the office of legislative legal services, and ten thousand seven
3 hundred twenty-eight dollars ($10,728) shall be allocated to the general
4 assembly.
5 (2) For the implementation of this act, appropriations made in the
6 annual general appropriations act for the fiscal year beginning July 1,
7 1999, shall be adjusted as follows:
8 (a) The general fund appropriation to the capital construction fund
9 outlined in section 3 (1) (f) is reduced by fifty-four thousand seven
10 hundred nine dollars ($54,709).
11 (b) The capital construction fund exempt appropriation to the
12 department of transportation, construction projects, is reduced by fifty-
13 four thousand seven hundred nine dollars ($54,709).]
14 SECTION [3.] Safety clause. The general assembly hereby finds,
15 determines, and declares that this act is necessary for the immediate
16 preservation of the public peace, health, and safety.
