101 CONCERNING THE EXEMPTION OF PRINTED MATERIALS FROM THE STATE
102 SALES AND USE TAX.

Exempts magazines, periodicals, journals, and other printed
materials from the state sales and use tax.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 39-26-102 (15), Colorado Revised Statutes, is
3 amended to read:
4 39-26-102. Definitions. As used in this article, unless the context
5 otherwise requires:
6 (15) "Tangible personal property" means corporeal personal
7 property. The term shall not be construed to include newspapers, as
8 legally defined by section 24-70-102, C.R.S., preprinted newspaper
9 supplements which THAT become attached to or inserted in and
10 distributed with such newspapers, MAGAZINES, PERIODICALS, TRADE
11 PUBLICATIONS OR JOURNALS, CREDIT BULLETINS, ADVERTISING

1 PAMPHLETS, CIRCULARS, DIRECTORIES, or direct mail advertising materials
2 which THAT are distributed in Colorado by any person engaged solely and
3 exclusively in the business of providing cooperative direct mail
4 advertising.
5 SECTION 2. Effective date. This act shall take effect October
6 1, 1999, unless a referendum petition is filed during the ninety-day period
7 after final adjournment of the general assembly that is allowed for
8 submitting a referendum petition pursuant to article V, section 1 (3) of the
9 state constitution. If such a referendum petition is filed against this act
10 or an item, section, or part of this act within such period, then the act,
11 item, section, or part, if approved by the people, shall take effect April 1,
12 2001.
