101 CONCERNING THE REPEAL OF THE TRANSPORTATION LEGISLATION REVIEW
102 COMMITTEE.

Repeals the transportation legislation review committee (TLRC).
Makes conforming amendments.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. Repeal. 43-2-145, Colorado Revised Statutes, is
3 repealed as follows:
4 43-2-145. Transportation legislation review - committee.
5 (1) In order to give guidance and direction to the department of
6 transportation in the development of the state transportation system and
7 to provide legislative overview of and input into such development, there
8 is hereby created the transportation legislation review committee. The
9 committee shall meet at least once each year to review all transportation
10 legislation and may consult with experts in the field of highway
11 construction and planning or with personnel of the department of
12 transportation as may be necessary. All personnel of the department of

1 transportation shall cooperate with the committee and with any persons
2 assisting the committee in carrying out its duties pursuant to this section.
3 The committee may review any phase of department of transportation
4 operations, including planning and construction of highway projects,
5 prior to and during the completion of such projects. The committee may
6 also conduct a postoperation review of such projects to determine
7 whether the project was completed in the most cost-effective and efficient
8 manner. The committee may require the department of transportation to
9 prepare and adopt five-, ten-, and fifteen-year plans for the development
10 of the state transportation system, and the committee shall monitor the
11 progress of such plans. The committee may also require financial or
12 performance audits to be conducted. Upon completion of its review of
13 the transportation laws, the committee shall make recommendations to the
14 governor and to the general assembly for such additional legislation as it
15 deems necessary. The committee shall also develop and make
16 recommendations concerning the financing of the state transportation
17 system. Legislation recommended by the committee shall be treated as
18 legislation recommended by an interim legislative committee for purposes
19 of any introduction deadlines or bill limitations imposed by the joint rules
20 of the general assembly.
21 (1.5) The committee may review any phase of operations of any
22 public highway authority created pursuant to part 5 of article 4 of this
23 title, including planning and construction of public highway projects,
24 prior to and during the completion of such projects. The committee may
25 also conduct a postoperation review of a project to determine whether the
26 project was completed in the most cost-effective and efficient manner.

1 The committee may require any public highway authority to prepare and
2 adopt long-range plans for the development of the public highways, and
3 the committee shall monitor the progress of such plans. The committee
4 may also require financial or performance audits to be conducted.
5 (1.6) By June 30, 1991, the committee shall review the operation
6 of House Bill No. 1246, enacted by the second regular session of the
7 fifty-sixth general assembly, to determine its effects on the administration
8 of public highways in the state and recommend any necessary changes
9 necessitated by the committee's findings.
10 (1.8) The committee shall examine methods to increase the rate
11 of compliance with regulations applicable to vehicles with a gross vehicle
12 weight in excess of ten thousand pounds. Such analysis shall include an
13 evaluation of the current penalties to determine whether such penalties
14 are collected and whether a different level of penalties would be more
15 effective. The committee shall make recommendations to the general
16 assembly regarding its study no later than February 1, 1990.
17 (1.9) The committee may review any phase of operations of any
18 rural transportation authority created pursuant to part 6 of article 4 of this
19 title, including the planning and construction of rural transportation
20 systems, prior to and during the completion of such systems. The
21 committee may also conduct a postoperation review of any system to
22 determine whether the system was completed in the most cost-effective
23 and efficient manner. The committee may require any rural
24 transportation authority to prepare and adopt long-range plans for the
25 development of rural transportation systems, and the committee shall
26 monitor the progress of such plans. The committee may also require

1 financial or performance audits to be conducted.
2 (2) The committee shall be comprised of eleven members to be
3 selected as follows:
4 (a) Five members appointed by the governor from such highway
5 advisory groups as the governor shall select, but which members shall be
6 determined by him to adequately represent the entire state, no more than
7 three of whom shall be from the same political party;
8 (b) Three members of the house of representatives appointed by
9 the speaker of the house of representatives, no more than two of whom
10 shall be from the same political party;
11 (c) Three members of the senate appointed by the president of the
12 senate, no more than two of whom shall be from the same political party.
13 (3) The term of office of each member of the committee shall be
14 for two years and shall commence on February 1, 1987, and on February
15 1 every two years thereafter.
16 (4) Members of the committee shall serve without compensation
17 but shall be reimbursed for all necessary expenses incurred in the
18 performance of their duties and in addition shall receive fifty dollars per
19 diem for each day spent in attendance at meetings of the committee.
20 (5) The legislative council staff shall be made available to assist
21 the committee in carrying out its duties pursuant to this section.
22 (6) and (7) Repealed.
23 SECTION 2. 32-9-119.7 (4), Colorado Revised Statutes, is
24 amended to read:
25 32-9-119.7. Farebox recovery ratios - plans - reports. (4) The
26 district shall prepare annual budgets based on the percentages required by

1 subsection (3) of this section. The district shall submit copies of its
2 annual budget to the transportation legislation review committee created
3 in section 43-2-145 HOUSE TRANSPORTATION AND ENERGY COMMITTEE
4 AND THE SENATE TRANSPORTATION COMMITTEE.
5 SECTION 3. Repeal. 43-1-1302 (3), Colorado Revised Statutes,
6 is repealed as follows:
7 43-1-1302. Definitions. As used in this part 13, unless the
8 context otherwise requires:
9 (3) "TLRC" means the transportation legislation review committee
10 created in section 43-2-145.
11 SECTION 4. 43-1-1303 (2) and (3), Colorado Revised Statutes,
12 are amended to read:
13 43-1-1303. Duties of the executive director - property eligible
14 for acquisition. (2) The commission shall review any property
15 determined to be eligible for acquisition and approve the acquisition
16 before the executive director submits the prioritized list of rail lines or
17 rights-of-way to be acquired to the TLRC HOUSE TRANSPORTATION AND
18 ENERGY COMMITTEE AND THE SENATE TRANSPORTATION COMMITTEE
19 pursuant to subsection (3) of this section.
20 (3) The executive director shall submit a prioritized list with
21 recommendations to the TLRC HOUSE TRANSPORTATION AND ENERGY
22 COMMITTEE AND THE SENATE TRANSPORTATION COMMITTEE concerning
23 the railroad rights-of-way or rail lines proposed to be acquired by the
24 state and their proposed uses.
25 SECTION 5. 43-1-1305 (3), Colorado Revised Statutes, is
26 amended to read:

1 43-1-1305. Acquisition for state rail bank - acquisition of the
2 Towner line - repeal. (3) The commission shall review any property
3 determined to be eligible for acquisition and approve the acquisition
4 before the executive director submits the prioritized list of rail line or
5 right-of-way to be acquired to the TLRC HOUSE TRANSPORTATION AND
6 ENERGY COMMITTEE AND THE SENATE TRANSPORTATION COMMITTEE
7 pursuant to section 43-1-1303 (3).
8 SECTION 6. 43-1-1306 (5), Colorado Revised Statutes, is
9 amended to read:
10 43-1-1306. Disposition of state rail bank property. (5) The
11 executive director may convert property in the state rail bank to other
12 transportation uses following appropriate studies and upon approval by
13 the commission. and the TLRC.
14 SECTION 7. 43-4-614 (1) (a), Colorado Revised Statutes, is
15 amended to read:
16 43-4-614. Notice - coordination of information - reports.
17 (1) (a) At least forty-five days prior to the creation of any authority
18 pursuant to this part 6, a notice containing the proposed boundaries of the
19 authority and the methods proposed for financing rural transportation
20 systems in the authority shall be sent to the division AND to the
21 department of revenue and to the chair CHAIRS of the transportation
22 legislation review committee created in section 43-2-145 HOUSE
23 TRANSPORTATION AND ENERGY COMMITTEE AND THE SENATE
24 TRANSPORTATION COMMITTEE.
25 SECTION 8. Safety clause. The general assembly hereby finds,

1 determines, and declares that this act is necessary for the immediate
2 preservation of the public peace, health, and safety.
