A BILL FOR AN ACT
101 CONCERNING PROGRAMS TO ASSIST TEACHERS IN LEARNING TO TEACH
102 STANDARDS-BASED EDUCATION.
Bill Summary
(Note: This summary applies to this bill as introduced and does
not necessarily reflect any amendments that may be subsequently
adopted.)
Instructs the department of education to implement a program to
train persons to act as facilitators to assist schools in implementing
standards-based teacher development programs. Specifies the minimum
areas in which facilitators shall receive training. Instructs the department
to work with other entities that have experience in implementing
standards-based education to develop the facilitator training program.
Creates the standards-based teacher development program as a
voluntary program in which school districts may participate by creating
local teacher development programs. Instructs the state board of
education to develop guidelines for implementation of standards-based
teacher development programs. Allows a school district to request the
department to provide assistance from trained facilitators.
Beginning with the fall semester 2000, allows any school district
or board of cooperative services that implements a teacher development
program to apply for a teacher development grant. Specifies criteria for
awarding grants. Requires school districts to allocate grant funds to the
lowest-performing schools in the district. Specifies the amount of the
teacher development grants and the percentage of matching funds to be
provided by school districts. Creates the standards-based teacher
development fund. Directs the department of education to seek federal
funds and authorizes the department to use general fund moneys
appropriated to the fund as matching funds.

2 SECTION 1. Article 7 of title 22, Colorado Revised Statutes, is
3 amended BY THE ADDITION OF A NEW PART to read:

5 TEACHER DEVELOPMENT IN TEACHING
6 STANDARDS-BASED EDUCATION
7 22-7-601. Short title. THIS PART 6 SHALL BE KNOWN AND MAY BE
8 CITED AS THE "STANDARDS-BASED EDUCATION TEACHER DEVELOPMENT
9 ACT".
10 22-7-602. Legislative declaration. THE GENERAL ASSEMBLY
11 HEREBY FINDS THAT THE SUCCESS OF STANDARDS-BASED EDUCATION AND
12 OTHER EDUCATIONAL MODELS BASED ON SETTING STANDARDS AND
13 ASSESSING STUDENT ACHIEVEMENT OF THOSE STANDARDS IS DEPENDENT
14 IN GREAT PART ON THE INSTRUCTION AND SUPPORT PROVIDED TO
15 TEACHERS TO ENABLE THEM TO UNDERSTAND AND MASTER THE SKILLS
16 NECESSARY TO TEACH STANDARDS-BASED EDUCATION. THE GENERAL
17 ASSEMBLY FURTHER FINDS THAT IN-SERVICE TRAINING PROGRAMS AND
18 SIMILAR FORMS OF OFF-SITE COURSE WORK ARE INSUFFICIENT TO PROVIDE
19 THE KIND OF INSTRUCTION NEEDED. IN ORDER TO LEARN HOW TO TEACH
20 STANDARDS-BASED EDUCATION, TEACHERS MUST WORK
21 COLLABORATIVELY AS COLLEAGUES TO REVIEW THEIR ASSIGNMENTS,
22 STUDENT WORK, CURRICULUM, AND TEACHING METHODOLOGY. SUCH
23 COLLABORATION WILL ENABLE TEACHERS TO DETERMINE WHETHER ALL OF
24 THESE FACETS OF TEACHING IN COMBINATION SUCCESSFULLY PROVIDE THE
25 INFORMATION STUDENTS NEED TO MASTER STANDARDS, AS INDICATED BY

1 HIGH ACHIEVEMENT LEVELS ON ASSESSMENTS. IT IS THEREFORE THE
2 INTENT OF THE GENERAL ASSEMBLY IN ADOPTING THIS PART 6 TO
3 ENCOURAGE SCHOOL DISTRICTS TO ORGANIZE THEIR SCHOOLS IN SUCH A
4 WAY AS TO ENCOURAGE COLLABORATIVE DEVELOPMENT AMONG
5 TEACHERS.
6 22-7-603. Definitions. AS USED IN THIS PART 6, UNLESS THE
7 CONTEXT OTHERWISE REQUIRES:
8 (1) "DEPARTMENT" MEANS THE DEPARTMENT OF EDUCATION
9 CREATED PURSUANT TO SECTION 24-1-115, C.R.S.
10 (2) "ELIGIBLE SCHOOL" MEANS A PUBLIC SCHOOL AT WHICH A
11 TOTAL OF THIRTY-FIVE PERCENT OR MORE OF THE ENROLLED STUDENTS
12 SCORE LOWER THAN PROFICIENT ON THE STATEWIDE ASSESSMENTS
13 ADMINISTERED AT THAT SCHOOL.
14 (3) "STANDARDS-BASED EDUCATION" SHALL HAVE THE SAME
15 MEANING AS PROVIDED IN SECTION 22-7-402 (11).
16 (4) "STATE BOARD" MEANS THE STATE BOARD OF EDUCATION
17 CREATED PURSUANT TO SECTION 1 OF ARTICLE IX OF THE STATE
18 CONSTITUTION.
19 (5) "TEACHER DEVELOPMENT GRANTS" MEANS GRANTS AWARDED
20 TO SCHOOL DISTRICTS PURSUANT TO SECTION 22-7-606 TO ESTABLISH
21 STANDARDS-BASED TEACHER DEVELOPMENT PROGRAMS AT SCHOOLS
22 WITHIN THE SCHOOL DISTRICT.
23 (6) "TEACHER DEVELOPMENT PROGRAM" MEANS A PROGRAM
24 DEVELOPED BY A SCHOOL DISTRICT OR BOARD OF COOPERATIVE SERVICES
25 TO ASSIST TEACHERS IN DEVELOPING THE SKILLS AND METHODOLOGIES
26 NECESSARY FOR IMPLEMENTING STANDARDS-BASED EDUCATION.

1 22-7-604. Department of education - teacher development
2 facilitators. (1) NOT LATER THAN JANUARY 1, 2000, THE DEPARTMENT
3 SHALL IMPLEMENT A PROGRAM TO TRAIN PERSONS TO ACT AS
4 FACILITATORS FOR TEACHER DEVELOPMENT PROGRAMS AS DESCRIBED IN
5 SECTION 22-7-605. PERSONS PARTICIPATING IN THE FACILITATOR
6 TRAINING PROGRAM SHALL RECEIVE INSTRUCTION IN HOW TO ASSIST
7 TEACHERS IN:
8 (a) EXAMINING AND REALIGNING THEIR TEACHER ASSIGNMENTS,
9 STUDENT WORK, CURRICULUM, AND TEACHING METHODS TO ENSURE THAT
10 ALL STUDENTS ACHIEVE THE CONTENT STANDARDS ADOPTED BY EACH
11 SCHOOL DISTRICT;
12 (b) DEVELOPING THEIR UNDERSTANDING OF AND CAPACITY IN
13 SUBJECT MATTER AND TEACHING METHODOLOGIES;
14 (c) DEVELOPING APPROPRIATE CURRICULUM REPLACEMENT UNITS
15 TO ADEQUATELY ADDRESS DIFFERENCES AMONG STUDENTS AND THEREBY
16 ENSURE THAT ALL STUDENTS ACHIEVE THE CONTENT STANDARDS ADOPTED
17 BY EACH SCHOOL DISTRICT.
18 (2) PERSONS WHO COMPLETE THE FACILITATOR TRAINING
19 PROGRAM SHALL BE AVAILABLE TO SCHOOLS IN IMPLEMENTING TEACHER
20 DEVELOPMENT PROGRAMS AS DESCRIBED IN SECTION 22-7-605.
21 FACILITATORS SHALL ALSO PROVIDE FACILITATOR TRAINING TO SCHOOL
22 DISTRICTS TO ENABLE OTHER PERSONS TO ACT AS FACILITATORS AND
23 ASSIST IN IMPLEMENTING LOCAL TEACHER DEVELOPMENT PROGRAMS.
24 (3) THE DEPARTMENT SHALL WORK WITH OTHER ENTITIES THAT
25 HAVE EXPERIENCE IN STANDARDS-BASED EDUCATION, INCLUDING BUT NOT
26 LIMITED TO THE STATE STANDARDS AND ASSESSMENTS DEVELOPMENT AND

1 IMPLEMENTATION COUNCIL CREATED PURSUANT TO SECTION 22-7-404, IN
2 DEVELOPING AND IMPLEMENTING THE FACILITATOR TRAINING PROGRAM.
3 (4) THE DEPARTMENT MAY RETAIN UP TO 5 PERCENT OF ANY
4 MONEYS APPROPRIATED TO THE STANDARDS-BASED TEACHER
5 DEVELOPMENT FUND FOR THE COSTS INCURRED IN IMPLEMENTING THE
6 FACILITATOR TRAINING PROGRAM.
7 22-7-605. Standards-based teacher development program -
8 role of department of education - recommended guidelines - rules.
9 (1) THERE IS HEREBY CREATED A PROGRAM FOR TEACHER DEVELOPMENT
10 IN STANDARDS-BASED EDUCATION, WHICH SHALL BE A VOLUNTARY
11 PROGRAM IN WHICH SCHOOL DISTRICTS AND BOARDS OF COOPERATIVE
12 SERVICES MAY PARTICIPATE THROUGH THE CREATION OF LOCAL TEACHER
13 DEVELOPMENT PROGRAMS.
14 (2) THE DEPARTMENT SHALL DEVELOP GUIDELINES FOR THE
15 IMPLEMENTATION OF LOCAL TEACHER DEVELOPMENT PROGRAMS, WHICH
16 GUIDELINES SHALL INCLUDE, BUT NEED NOT BE LIMITED TO:
17 (a) SCHEDULING MODELS FOR SCHOOLS THAT WILL ALLOW
18 TEACHERS TO MEET TOGETHER DURING SCHOOL HOURS TO REVIEW AND
19 ALIGN THEIR ASSIGNMENTS, STUDENT WORK, CURRICULUM, AND TEACHING
20 METHODS USED IN TEACHING STANDARDS-BASED EDUCATION IN AT LEAST
21 THE AREAS OF READING, WRITING, MATHEMATICS, AND SCIENCE;
22 (b) RECOMMENDED PROCEDURES FOR REVIEWING ASSIGNMENTS,
23 STUDENT WORK, CURRICULUM, AND TEACHING METHODS AND
24 DETERMINING THE EFFECTIVENESS OF EACH ALONE AND IN COMBINATION;
25 (c) CONSIDERATION OF REPLACEMENT CURRICULUM IN
26 CIRCUMSTANCES UNDER WHICH THE CURRICULUM USED DOES NOT

1 EFFECTIVELY ADDRESS THE LEARNING STYLES OF ALL STUDENTS;
2 (d) CONSIDERATION OF OTHER RESEARCH-BASED TEACHER
3 DEVELOPMENT METHODS THAT ARE CONTENT-RELATED AND RESULT IN
4 INCREASED STUDENT ACHIEVEMENT;
5 (e) CONSIDERATION OF RESEARCH-BASED TEACHER DEVELOPMENT
6 METHODS THAT FOCUS ON CERTAIN GROUPS OF STUDENTS WITH THE GOAL
7 OF CLOSING THE GAP BETWEEN HIGH-PERFORMING AND LOW-PERFORMING
8 STUDENTS BY ACCELERATING THE LEARNING OF THE LOWEST-ACHIEVING
9 STUDENTS.
10 (3) A SCHOOL DISTRICT MAY REQUEST THE DEPARTMENT TO
11 PROVIDE PERSONS TRAINED AS FACILITATORS PURSUANT TO SECTION
12 22-7-604 TO ASSIST THE SCHOOL DISTRICT IN IMPLEMENTING A LOCAL
13 TEACHER DEVELOPMENT PROGRAM.
14 (4) IN ACCORDANCE WITH ARTICLE 4 OF TITLE 24, C.R.S., THE
15 STATE BOARD SHALL PROMULGATE SUCH RULES AS MAY BE NECESSARY TO
16 CARRY OUT THE DUTIES OF THE DEPARTMENT SET FORTH IN THIS PART 6.
17 22-7-606. Teacher development grants. (1) BEGINNING WITH
18 THE FALL SEMESTER 2000, A SCHOOL DISTRICT OR BOARD OF COOPERATIVE
19 SERVICES THAT CHOOSES TO IMPLEMENT A LOCAL TEACHER DEVELOPMENT
20 PROGRAM MAY APPLY FOR A TEACHER DEVELOPMENT GRANT BY FILING AN
21 APPLICATION WITH THE DEPARTMENT PURSUANT TO RULES ADOPTED BY
22 THE STATE BOARD.
23 (2) (a) AWARDING OF TEACHER DEVELOPMENT GRANTS FOR LOCAL
24 TEACHER DEVELOPMENT PROGRAMS SHALL BE BASED ON STUDENT
25 PERFORMANCE ON ASSESSMENTS ADMINISTERED THROUGH THE COLORADO
26 STUDENT ASSESSMENT PROGRAM PURSUANT TO SECTION 22-7-409.

1 GRANTS SHALL BE AWARDED FOR FIVE ACADEMIC YEARS IN THE AMOUNT
2 CALCULATED PURSUANT TO SUBSECTION (3) OF THIS SECTION. GRANTS
3 RECEIVED BY A SCHOOL DISTRICT PURSUANT TO THIS SECTION SHALL BE
4 ALLOCATED TO ENSURE THAT TEACHER DEVELOPMENT PROGRAMS ARE
5 IMPLEMENTED FIRST AT THE ELIGIBLE SCHOOLS WITHIN THE SCHOOL
6 DISTRICT AND SUBSEQUENTLY AT OTHER SCHOOLS WITH THE HIGHEST
7 NUMBERS OF STUDENTS SCORING BELOW PROFICIENT ON THE STATEWIDE
8 ASSESSMENTS ADMINISTERED PURSUANT TO SECTION 22-7-409.
9 (b) EACH SCHOOL DISTRICT THAT RECEIVES A TEACHER
10 DEVELOPMENT GRANT PURSUANT TO THIS SECTION SHALL PROVIDE
11 MATCHING FUNDS IN AN AMOUNT THAT IS AT LEAST EQUAL TO TWENTY
12 PERCENT OF THE GRANT FOR THE FIRST YEAR OF THE GRANT, FORTY
13 PERCENT OF THE GRANT FOR THE SECOND YEAR OF THE GRANT, SIXTY
14 PERCENT OF THE GRANT FOR THE THIRD YEAR OF THE GRANT, AND EIGHTY
15 PERCENT OF THE GRANT FOR EACH REMAINING YEAR OF THE GRANT. SUCH
16 MATCHING FUNDS MAY BE DERIVED FROM REDIRECTING THE AMOUNT
17 SPENT BY THE SCHOOL DISTRICT IN PROVIDING OTHER TEACHER
18 PROFESSIONAL DEVELOPMENT PROGRAMS.
19 (3) (a) GRANTS SHALL BE AWARDED FIRST TO THOSE SCHOOL
20 DISTRICTS THAT INCLUDE ELIGIBLE SCHOOLS. THE AMOUNT OF THE
21 TEACHER DEVELOPMENT GRANT AWARDED TO A SCHOOL DISTRICT SHALL
22 DEPEND ON THE NUMBER OF ELIGIBLE SCHOOLS IN THE SCHOOL DISTRICT.
23 THE AMOUNT SHALL BE CALCULATED TO ENSURE THAT THE AMOUNT OF
24 THE GRANT, COMBINED WITH THE MATCHING FUNDS PROVIDED BY THE
25 RECEIVING SCHOOL DISTRICT, EQUALS TEN THOUSAND DOLLARS PER
26 ELIGIBLE SCHOOL IN THE SCHOOL DISTRICT.

1 (b) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (a) OF
2 THIS SUBSECTION (3), IF THE AMOUNT APPROPRIATED TO THE
3 STANDARDS-BASED TEACHER DEVELOPMENT FUND IS INSUFFICIENT, WHEN
4 COMBINED WITH MATCHING FUNDS, TO PROVIDE TEN THOUSAND DOLLARS
5 PER ELIGIBLE SCHOOL, THE AMOUNT OF THE GRANT FOR EACH ELIGIBLE
6 SCHOOL SHALL BE REDUCED BY THE SAME AMOUNT.
7 (c) ANY AMOUNT REMAINING IN THE STANDARDS-BASED TEACHER
8 DEVELOPMENT FUND FOLLOWING THE AWARD OF GRANTS TO SCHOOL
9 DISTRICTS WITH ELIGIBLE SCHOOLS MAY BE DIVIDED ON A PER SCHOOL
10 BASIS AMONG THOSE SCHOOL DISTRICTS THAT APPLY FOR GRANTS AND DO
11 NOT INCLUDE ELIGIBLE SCHOOLS. ANY GRANT SO AWARDED SHALL BE
12 SUBJECT TO THE MATCHING FUND REQUIREMENTS SPECIFIED IN PARAGRAPH
13 (b) OF SUBSECTION (2) OF THIS SECTION AND ALLOCATED TO ENSURE THAT
14 TEACHER DEVELOPMENT PROGRAMS ARE ESTABLISHED FIRST AT THE
15 SCHOOLS WITHIN THE SCHOOL DISTRICT WITH THE HIGHEST NUMBERS OF
16 STUDENTS SCORING BELOW PROFICIENT ON THE STATEWIDE ASSESSMENTS
17 ADMINISTERED PURSUANT TO SECTION 22-7-409.
18 22-7-607. Standards-based teacher development fund -
19 creation - acceptance of funds. (1) THERE IS HEREBY CREATED IN THE
20 STATE TREASURY THE STANDARDS-BASED TEACHER DEVELOPMENT FUND,
21 REFERRED TO IN THIS SECTION AS THE "FUND", WHICH FUND SHALL BE
22 MADE UP OF ANY MONEYS TRANSFERRED THERETO FROM THE GENERAL
23 FUND, AS WELL AS ANY MONEYS RECEIVED BY THE DEPARTMENT
24 PURSUANT TO SUBSECTION (2) OF THIS SECTION. THE MONEYS IN THE FUND
25 SHALL BE SUBJECT TO ANNUAL APPROPRIATION BY THE GENERAL
26 ASSEMBLY TO THE DEPARTMENT FOR THE PURPOSE OF AWARDING TEACHER

1 DEVELOPMENT GRANTS PURSUANT TO SECTION 22-7-606. IN ADDITION, UP
2 TO 5 PERCENT OF THE AMOUNT APPROPRIATED TO THE FUND MAY BE
3 RETAINED BY THE DEPARTMENT FOR IMPLEMENTATION OF THE
4 FACILITATOR DEVELOPMENT PROGRAM PURSUANT TO SECTION 22-7-604
5 AND UP TO 5 PERCENT MAY BE RETAINED BY THE DEPARTMENT TO OFFSET
6 THE COSTS INCURRED BY THE DEPARTMENT IN IMPLEMENTING SECTION
7 22-7-606.
8 (2) IN ADDITION TO ANY FUNDS APPROPRIATED FROM THE GENERAL
9 FUND FOR IMPLEMENTATION OF THIS PART 6, THE DEPARTMENT IS HEREBY
10 DIRECTED TO SEEK ANY FEDERAL FUNDS THAT MAY BE AVAILABLE FOR
11 IMPLEMENTATION OF THIS PART 6. THE DEPARTMENT IS AUTHORIZED TO
12 USE ANY GENERAL FUND MONEYS APPROPRIATED TO THE FUND AS
13 MATCHING FUNDS FOR FEDERAL GRANT PROGRAMS. THE DEPARTMENT IS
14 ALSO AUTHORIZED TO ACCEPT GIFTS, GRANTS, AND DONATIONS OF ANY
15 KIND FROM ANY PRIVATE SOURCE OR FROM ANY GOVERNMENTAL UNIT TO
16 CARRY OUT THE PURPOSES OF THIS PART 6, SUBJECT TO ANY CONDITIONS
17 UPON WHICH THE GIFTS, GRANTS, OR DONATIONS ARE MADE; EXCEPT THAT
18 NO GIFT, GRANT, OR DONATION SHALL BE ACCEPTED IF THE CONDITIONS
19 ATTACHED THERETO REQUIRE THE USE OR EXPENDITURE THEREOF IN A
20 MANNER CONTRARY TO LAW. ALL SUCH GIFTS, GRANTS, AND DONATIONS
21 SHALL BE TRANSMITTED TO THE STATE TREASURER, WHO SHALL CREDIT
22 THE SAME TO THE STANDARDS-BASED TEACHER DEVELOPMENT FUND.
23 SECTION 2. Safety clause. The general assembly hereby finds,
24 determines, and declares that this act is necessary for the immediate
25 preservation of the public peace, health, and safety.
