Bill Summary

Requires any health care practitioner who participates in a
personal injury protection (PIP) examination review panel to be actively
engaged in practice at the office listed with the commissioner of
insurance. States that a majority of the income earned at such office shall
not derive from witness fees and the examination of persons not under
such practitioner's care.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 10-4-706 (6) (b), Colorado Revised Statutes, is
3 amended to read:
4 10-4-706. Required coverages - complying policies - PIP
5 examination program. (6) (b) The PIP examination program shall
6 provide a group of licensed health care practitioners that shall be known
7 as the PIP examination review panel. The commissioner shall utilize

1 such public and private resources as are available and appropriate in
2 determining standards and qualifications for the PIP review panel
3 members. A health care practitioner participating in the PIP review panel
4 shall be actively engaged in the practice of his or her profession AT THE
5 OFFICE LISTED WITH THE [COMMISSIONER, WHICH SHALL BE LOCATED
6 WITHIN THE ZIP CODE OF THE INJURED PARTY,] and a majority of such
7 practice and income AT SUCH OFFICE shall not derive from witness fees
8 and examinations of persons not under the practitioner's care and
9 treatment. [IF THE OFFICES OF LESS THAN FIVE REGISTERED HEALTH CARE
10 PRACTITIONERS ARE LOCATED WITHIN SUCH ZIP CODE, THEN THOSE
11 REGISTERED PRACTITIONERS LOCATED WITHIN A FIFTY MILE RADIUS OF THE
12 ZIP CODE OF THE INJURED PARTY SHALL BE CONSIDERED FOR THE PIP
13 REVIEW PANEL. THE RADIUS SHALL CONTINUE TO BE EXPANDED UNTIL THE
14 OFFICES OF FIVE REGISTERED HEALTH CARE PRACTITIONERS ARE LOCATED
15 WITHIN A GIVEN RADIUS OF THE INJURED PARTY.] It shall be the duty of the
16 PIP examination review panel to perform the PIP examinations at the
17 request of the commissioner.
18 SECTION 2. Safety clause. The general assembly hereby finds,
19 determines, and declares that this act is necessary for the immediate
20 preservation of the public peace, health, and safety.
