101 CONCERNING THE ACQUISITION BY THE DIVISION OF PARKS AND OUTDOOR
102 RECREATION OF LAND IN MONTROSE COUNTY FOR PUBLIC
103 PURPOSES.

Authorizes the division of parks and outdoor recreation in the
department of natural resources to acquire certain land in Montrose
county, Colorado.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. Acquisition authorized. The division of parks and
3 outdoor recreation, in the department of natural resources, is hereby
4 authorized to acquire certain land in Montrose County, Colorado,
5 consisting of approximately 168.89 acres, and more particularly described
6 as follows:
7 A tract of land situate in the S1/2 and the S1/2N1/2 of Section 34, and the
8 S1/2 of Section 35 of Township 48 North, Range 17 West, and in the
9 N1/2 and N1/2S1/2 of Section 2, and the N1/2 of Section 3, Township 47
10 North, Range 17 West, New Mexico Principal Meridian, all in Montrose

1 County, Colorado, and more particularly described as the following
2 parcels, collectively:
3 1. That part of the patented New Fisherman Placer, M.S. No. 5303, lying
4 northwesterly of that certain tract of land previously conveyed to the
5 State of Colorado, as described in a Correction Quit Claim Deed dated
6 December 17, 1987, and recorded in the records of the Montrose County
7 Clerk and Recorder in Book 783 at Page 614.
8 2. All of the unpatented Uravan No. 85 Mill Site, M.S. No. 20887;
9 grantor's interest in this Mill Site is subject to the paramount title of the
10 United States of America.
11 3. All of the patented Uravan No. 11 Mill Site, M.S. No. 20663.
12 4. All of the patented Uravan No. 4 Mill Site, M.S. No. 20663.
13 5. The southeasterly 435 feet of the patented August Mill Site, M.S. No.
14 19813, as determined by a line parallel with the line between AP 2 and
15 AP 3 of the August Mill Site.
16 6. That part of the New River Bend Placer, M.S. No. 5303, lying
17 southeasterly of the following described lines: Beginning at AP 2 of the
18 August Mill Site, M.S. No. 19813; thence N. 44 degrees 04 minutes W.,
19 on the line between AP 2 and AP 1 of the August Mill Site, for a distance
20 of 475 feet; thence N. 45 degrees 56 minutes E., parallel with the line
21 between AP 3 and AP 2 of the August Mill Site, to a point on the easterly
22 sideline of the New River Bend Placer.
23 Subject to all conditions and reservations of record.
24 SECTION 2. Effective date. This act shall take effect at 12:01
25 a.m. on the day following the expiration of the ninety-day period after
26 final adjournment of the general assembly that is allowed for submitting

1 a referendum petition pursuant to article V, section 1 (3) of the state
2 constitution; except that, if a referendum petition is filed against this act
3 or an item, section, or part of this act within such period, then the act,
4 item, section, or part, if approved by the people, shall take effect on the
5 date of the official declaration of the vote thereon by proclamation of the
6 governor.
