A BILL FOR AN ACT
101 CONCERNING THE REQUIREMENT FOR FRONT LICENSE PLATES ON MOTOR
102 VEHICLES.
Bill Summary

Eliminates the requirement of front license plates on motor
vehicles starting January 1, 2000. Specifies that any savings as a result
of issuing only one license plate shall remain in the highway users tax
fund.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 42-3-113 (1) (a), Colorado Revised Statutes, is
3 amended, and the said 42-3-113 (1) is further amended BY THE
4 ADDITION OF A NEW PARAGRAPH, to read:
5 42-3-113. Number plates furnished - style - periodic reissuance
6 - repeal. (1) (a) (I) UNTIL JANUARY 1, 2000, the department shall also
7 furnish to every owner whose vehicle is registered one number plate for
8 a motorcycle, street rod vehicle, trailer, or semitrailer, any other vehicle
9 drawn by a motor vehicle, or any item of mobile machinery or
10 self-propelled construction equipment, and two number plates, or, at the
[ ] denotes HOUSE amendment. { } denotes SENATE amendment.

1 discretion of the executive director of the department, one number plate
2 for every other vehicle, except as otherwise provided in this article. The
3 department has the authority to require the return to the department of all
4 number plates upon termination of the lawful use thereof by the owner.
5 (II) For the purposes of this paragraph (a), "street rod vehicle" has
6 the same meaning as provided in section 42-3-114 (3) (b).
7 (III) THIS PARAGRAPH (a) IS REPEALED, EFFECTIVE JANUARY 1,
8 2000.
9 (a.5) (I) COMMENCING JANUARY 1, 2000, THE DEPARTMENT SHALL
10 FURNISH TO EVERY OWNER WHOSE VEHICLE IS REGISTERED ONE NUMBER
11 PLATE FOR EVERY VEHICLE, EXCEPT AS OTHERWISE PROVIDED IN THIS
12 ARTICLE. THE DEPARTMENT HAS THE AUTHORITY TO REQUIRE THE RETURN
13 TO THE DEPARTMENT OF ALL NUMBER PLATES UPON TERMINATION OF THE
14 LAWFUL USE THEREOF BY THE OWNER.
15 (II) IN IMPLEMENTING THE PROVISIONS OF SUBPARAGRAPH (I) OF
16 THIS PARAGRAPH (a.5), THE DEPARTMENT SHALL CONTINUE ISSUING
17 DUPLICATE PLATES UNTIL THE INVENTORY OF SUCH PLATES IS EXHAUSTED.
18 THEREAFTER, A SINGLE PLATE SHALL BE ISSUED IN ACCORDANCE WITH THE
19 PROVISIONS OF SUBPARAGRAPH (I) OF THIS PARAGRAPH (a.5). THIS
20 SUBPARAGRAPH (II) IS REPEALED, EFFECTIVE JULY 1, 2001.
21 (III) ALL SAVINGS GENERATED AS A RESULT OF ISSUING ONE
22 NUMBER PLATE SHALL BE RETAINED IN THE HIGHWAY USERS TAX FUND
23 AND APPROPRIATED IN ACCORDANCE WITH THE PROVISIONS OF SECTION 18
24 OF ARTICLE X OF THE COLORADO CONSTITUTION AND SHALL NOT REVERT
25 OR BE TRANSFERRED TO THE GENERAL FUND OF THE STATE OF COLORADO
26 OR ANY OTHER FUND.

1 SECTION 2. 42-3-123 (1) (a), Colorado Revised Statutes, is
2 amended, and the said 42-3-123 (1) is further amended BY THE
3 ADDITION OF A NEW PARAGRAPH, to read:
4 42-3-123. Number plates to be attached - repeal.
5 (1) (a) (I) Number plates assigned to a self-propelled vehicle other than
6 a motorcycle or street rod vehicle shall be attached thereto, one in the
7 front and the other in the rear. The number plate assigned to a
8 motorcycle, street rod vehicle, trailer, or semitrailer, any other vehicle
9 drawn by a motor vehicle, or any item of mobile machinery or
10 self-propelled construction equipment shall be attached to the rear
11 thereof. Number plates shall be so displayed during the current
12 registration year, except as otherwise provided in this article.
13 (II) THIS PARAGRAPH (a) IS REPEALED, EFFECTIVE JANUARY 1,
14 2000.
15 (a.5) EFFECTIVE JANUARY 1, 2000, THE NUMBER PLATE ASSIGNED
16 TO ANY MOTOR VEHICLE SHALL BE ATTACHED TO THE REAR THEREOF.
17 NUMBER PLATES SHALL BE SO DISPLAYED DURING THE CURRENT
18 REGISTRATION YEAR, EXCEPT AS OTHERWISE PROVIDED IN THIS ARTICLE.
19 SECTION 3. 42-3-114 (7) (a), Colorado Revised Statutes, is
20 amended to read:
21 42-3-114. Issuance of personalized plates authorized. (7) (a) A
22 fee of thirty-five dollars shall be charged in addition to the registration fee
23 normally due upon the vehicle for the issuance of the same number of
24 personalized license plates for a vehicle as are specified in section
25 42-3-113 for the issuance of number plates PURSUANT TO THIS SECTION.
26 SUCH PLATES SHALL BE DISPLAYED IN THE MANNER PRESCRIBED FOR

1 NUMBER PLATES ISSUED PURSUANT TO SECTION 42-3-123. Upon
2 reissuance of the same personalized license plates in subsequent years,
3 the additional fee shall be twenty-five dollars. Such fee shall be due upon
4 the original issue or any reissuance of personalized license plates other
5 than a renewal of registration under paragraph (b) of this subsection (7).
6 SECTION 4. Safety clause. The general assembly hereby finds,
7 determines, and declares that this act is necessary for the immediate
8 preservation of the public peace, health, and safety.
