A BILL FOR AN ACT
101 CONCERNING COLLECTION OF VOLUNTARY SPECIAL DUES FOR UNITED
102 STATES OLYMPIC LICENSE PLATES.
Bill Summary

Changes the collection process for collecting voluntary special
dues established by the United States olympic committee in connection
with the annual renewal of special license plates.
Requires the department of revenue annually to collect the
voluntary special dues amount established by the United States olympic
committee when persons apply for or renew special license plates.
Requires the department of revenue to transmit said dues to the state
treasurer, to be credited to the olympic committee fund. Specifies that the
general assembly shall make an annual appropriation out of the olympic
committee fund to the department of revenue for administration of this
fund. Requires the state treasurer to transfer the remaining moneys in the
fund, including interest, to the olympic committee at the end of each
fiscal year.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 42-3-115.8 (3) (b) (II), (4), and (6), Colorado
3 Revised Statutes, are amended to read:
4 42-3-115.8. Special plates - United States olympic committee.
5 (3) (b) The committee may establish the following qualifications for

1 persons seeking to obtain special license plates under the provisions of
2 this section:
3 (II) Payment of specified dues, including VOLUNTARY special dues
4 established for the special license plates WHICH SHALL BE COLLECTED BY
5 THE DEPARTMENT OF REVENUE AT THE TIME A PERSON APPLIES FOR OR
6 RENEWS A SPECIAL LICENSE PLATE. If the olympic committee collects
7 special dues for special license plates, the ANY moneys COLLECTED FOR
8 SPECIAL DUES may be expended only for support of the United States
9 olympic committee program.
10 (4) Vehicles registered under this section shall be subject to all
11 other provisions of this article except those relating to the type of number
12 license plates under section 42-3-113, UNLESS THE REGISTERED OWNER OF
13 THE VEHICLE FAILS TO RENEW THE SPECIAL OLYMPIC COMMITTEE LICENSE
14 PLATES.
15 (6) Any renewal of a special license plate issued under this section
16 shall be handled in the same manner as other license plates under the
17 provisions of section 42-3-112 or, for personalized plates, under the
18 provisions of section 42-3-114; EXCEPT THAT, AT THE TIME OF RENEWAL,
19 THE DEPARTMENT SHALL COLLECT THE VOLUNTARY SPECIAL DUES
20 AMOUNT ESTABLISHED BY THE OLYMPIC COMMITTEE PURSUANT TO
21 SUBPARAGRAPH (II) OF PARAGRAPH (b) OF SUBSECTION (3) OF THIS
22 SECTION. THE DEPARTMENT SHALL TRANSMIT THE AMOUNT
23 ATTRIBUTABLE TO VOLUNTARY SPECIAL DUES TO THE STATE TREASURER,
24 WHO SHALL CREDIT SUCH AMOUNT TO THE OLYMPIC COMMITTEE FUND
25 ESTABLISHED PURSUANT TO SECTION 39-22-902, C.R.S. ALL MONEYS
26 TRANSMITTED TO THE OLYMPIC COMMITTEE FUND AS A RESULT OF THE

1 VOLUNTARY SPECIAL DUES SHALL REMAIN IN THE OLYMPIC COMMITTEE
2 FUND TO BE USED FOR OLYMPIC COMMITTEE PURPOSES. SAID MONEYS
3 SHALL NOT REVERT TO THE GENERAL FUND OR ANY OTHER FUND. THE
4 GENERAL ASSEMBLY SHALL APPROPRIATE ANNUALLY FROM THE OLYMPIC
5 COMMITTEE FUND TO THE DEPARTMENT OF REVENUE ITS COST OF
6 ADMINISTERING THE MONEYS CONTRIBUTED AS VOLUNTARY SPECIAL DUES
7 TO THE FUND. ALL INTEREST DERIVED FROM THE DEPOSIT AND
8 INVESTMENT OF THE MONEYS IN THE OLYMPIC COMMITTEE FUND SHALL BE
9 CREDITED TO THE FUND. AT THE END OF EACH FISCAL YEAR, THE STATE
10 TREASURER SHALL TRANSFER ALL MONEYS IN THE FUND AND ALL INTEREST
11 EARNED THROUGH THE INVESTMENT OF FUND MONEYS TO THE UNITED
12 STATES OLYMPIC COMMITTEE AFTER SUBTRACTING THE APPROPRIATION TO
13 THE DEPARTMENT OF REVENUE FOR THE COSTS OF ADMINISTERING THE
14 COLLECTION OF THE VOLUNTARY SPECIAL DUES PURSUANT TO THIS
15 SECTION.
16 SECTION 2. Effective date - applicability. This act shall take
17 effect July 1,1999, and shall apply to special licenses issued or renewed
18 on or after said date.
19 SECTION 3. Safety clause. The general assembly hereby finds,
20 determines, and declares that this act is necessary for the immediate
21 preservation of the public peace, health, and safety.
