A BILL FOR AN ACT
101 CONCERNING ELECTIONS FOR MEMBERS OF THE BOARD OF EDUCATION OF
102 SCHOOL DISTRICT 1.
Bill Summary
(Note: This summary applies to this bill as introduced and does
not necessarily reflect any amendments that may be subsequently
adopted.)
Effective with the elections in 2003, eliminates the election of
members of the Denver school board at large. Provides that members
elected in 2001 shall serve 2-year terms.
Requires the general assembly to establish the boundaries for 7
single-member districts following the federal census in 2000. Establishes
that members from all 7 districts shall be elected in 2003, but the terms
of members elected from 4 of the districts shall expire in 2 years.
Establishes that the members elected in 2011 from districts that had
4-year terms following the 2003 election shall serve 2-year terms.
Requires a similar process following future federal censuses.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 22-31-131 (1.5) (a) (IV), (1.5) (b), and (1.5) (c) (II),
3 Colorado Revised Statutes, are amended, and the said 22-31-131 (1.5) is
4 further amended BY THE ADDITION OF A NEW PARAGRAPH, to
5 read:

1 and county - repeal. (1.5) (a) The general assembly hereby finds and
2 declares that:
3 (IV) All communities of district number 1, especially the parents
4 of pupils enrolled in the district, should be represented on the board of
5 education and the views of such communities will be better represented
6 if five ALL of the seven members of the board of education are elected
7 under a director district plan of representation BEGINNING WITH THE
8 ELECTION IN 2003;
9 (b) (I) On and after FROM January 1, 1993, THROUGH JANUARY 1,
10 2003, each school district coterminous with a city and county shall elect
11 a seven-member board of education with one eligible elector elected from
12 each of five director districts and two eligible electors elected from the
13 district at large. Directors elected from each of the five director districts
14 shall be voted on by the eligible electors residing within the director
15 district only, but the two directors elected at large shall be voted on by the
16 electors of the entire district. Directors shall be elected for four-year
17 terms; EXCEPT THAT THE DISTRICT DIRECTORS ELECTED IN 2001 SHALL BE
18 ELECTED FOR A TWO-YEAR TERM.
19 (II) In implementing the change to a director district plan of
20 representation and the change in the length of terms, the five school
21 directors elected prior to January 1, 1993, whose terms expire in 1995 and
22 1997, shall not have their offices terminated. Therefore, the board of
23 education shall be elected in accordance with the following provisions:
24 (A) In 1993, a director shall be elected from director district 2 and
25 a director shall be elected at large.
26 (B) In 1995, directors shall be elected from director district 1 and

1 director district 5 and a director shall be elected at large.
2 (C) In 1997, directors shall be elected from director district 3 and
3 director district 4. In addition, successors shall be elected for the director
4 elected from director district 2 and the director elected at large who were
5 elected in 1993 and whose terms expire in 1997.
6 (D) IN 1999, SUCCESSORS SHALL BE ELECTED FOR THE DIRECTORS
7 ELECTED FROM DIRECTOR DISTRICTS 1 AND 5 AND THE DIRECTOR ELECTED
8 AT LARGE, WHO WERE ALL ELECTED IN 1995 AND WHOSE TERMS EXPIRE IN
9 1999.
10 (E) IN 2001, SUCCESSORS SHALL BE ELECTED FOR THE DIRECTORS
11 ELECTED FROM DIRECTOR DISTRICTS 2, 3, AND 4 AND THE DIRECTOR
12 ELECTED AT LARGE, WHO WERE ALL ELECTED IN 1997 AND WHOSE TERMS
13 EXPIRE IN 2001, BUT THE TERMS OF DIRECTORS ELECTED IN 2001 SHALL
14 EXPIRE IN 2003.
15 (III) THIS PARAGRAPH (b) IS REPEALED, EFFECTIVE JULY 1, 2004.
16 (c) (II) The general assembly shall provide for the revision
17 ESTABLISHMENT of the SEVEN director district boundaries established
18 REQUIRED by this paragraph (c) (c.5) OF THIS SUBSECTION (1.5) following
19 the federal census in 2000 and FOR THE REVISION OF SUCH BOUNDARIES
20 FOLLOWING THE FEDERAL CENSUS IN 2010 AND each federal census
21 thereafter. THE ESTABLISHMENT AND REVISION OF DIRECTOR DISTRICT
22 BOUNDARIES SHALL BE IMPLEMENTED NO LATER THAN THE ELECTION HELD
23 IN THE THIRD YEAR FOLLOWING THE YEAR IN WHICH THE CENSUS WAS
24 TAKEN.
25 (c.5) (I) ON AND AFTER JANUARY 1, 2003, EACH SCHOOL DISTRICT
26 COTERMINOUS WITH A CITY AND COUNTY SHALL ELECT A SEVEN-MEMBER

1 BOARD OF EDUCATION WITH ONE ELIGIBLE ELECTOR ELECTED FROM EACH
2 OF SEVEN DIRECTOR DISTRICTS. DIRECTORS ELECTED FROM THE SEVEN
3 DIRECTOR DISTRICTS SHALL BE VOTED ON BY THE ELIGIBLE ELECTORS
4 RESIDING WITHIN THE DIRECTOR DISTRICT ONLY. EXCEPT AS PROVIDED IN
5 SUBPARAGRAPH (II) OF THIS PARAGRAPH (c.5), DIRECTORS SHALL BE
6 ELECTED FOR FOUR-YEAR TERMS.
7 (II) THE BOARD OF EDUCATION SHALL BE ELECTED IN ACCORDANCE
8 WITH THE FOLLOWING PROVISIONS:
9 (A) IN 2003, AND EVERY TEN YEARS THEREAFTER, A DIRECTOR
10 SHALL BE ELECTED FROM ALL SEVEN DIRECTOR DISTRICTS, BUT THE TERM
11 OF THE DIRECTORS ELECTED FROM DIRECTOR DISTRICTS 1, 5, 6, AND 7
12 SHALL BE A TWO-YEAR TERM.
13 (B) IN 2011, AND EVERY TEN YEARS THEREAFTER, THE TERM OF
14 THE DIRECTORS ELECTED FROM DIRECTOR DISTRICTS 2, 3, AND 4 SHALL BE
15 A TWO-YEAR TERM.
16 SECTION 2. 22-31-131 (1.7), Colorado Revised Statutes, is
17 amended BY THE ADDITION OF A NEW PARAGRAPH to read:
18 22-31-131. Election procedures in districts composed of a city
19 and county - repeal. (1.7) (c) THIS SUBSECTION (1.7) IS REPEALED,
20 EFFECTIVE JULY 1, 2000.
21 SECTION 3. Safety clause. The general assembly hereby finds,
22 determines, and declares that this act is necessary for the immediate
23 preservation of the public peace, health, and safety.
