A BILL FOR AN ACT
101 CONCERNING A CHANGE IN THE ELECTION OF MEMBERS OF THE STATE
102 BOARD OF EDUCATION FROM PARTISAN TO NONPARTISAN.

Changes the election of state board of education members from
partisan to nonpartisan.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 22-2-105 (2), Colorado Revised Statutes, is
3 amended to read:
4 22-2-105. State board - composition. (2) The member of the
5 state board from each congressional district of the state shall be
6 nominated and elected by the registered electors of such district in the
7 same manner as members of the house of representatives of the congress
8 of the United States are nominated and elected MANNER PRESCRIBED IN
9 SECTION 1-4-806, C.R.S. Each member from a congressional district shall
10 be a registered elector of such district. If the total number of
11 congressional districts of the state is an even number, the additional
12 member of the board shall be nominated and elected at large in the same

3 SECTION 2. Part 8 of article 4 of title 1, Colorado Revised
4 Statutes, is amended BY THE ADDITION OF A NEW SECTION to
5 read:
6 1-4-806. Petitions for nominating nonpartisan state board of
7 education members. (1) ANY PERSON WHO DESIRES TO BE A CANDIDATE
8 FOR A MEMBER OF THE STATE BOARD OF EDUCATION FOR A
9 CONGRESSIONAL DISTRICT SHALL FILE A NOMINATING PETITION SIGNED BY
10 A NUMBER OF ELIGIBLE ELECTORS EQUAL TO THE LESSER OF ONE
11 THOUSAND SIGNERS OR TWO PERCENT OF THE ELIGIBLE ELECTORS
12 RESIDENT IN THE CONGRESSIONAL DISTRICT IN WHICH THE PERSON IS A
13 CANDIDATE.
14 (2) ANY PERSON WHO DESIRES TO BE A CANDIDATE FOR A MEMBER
15 OF THE STATE BOARD OF EDUCATION FOR AN AT-LARGE POSITION SHALL
16 FILE A NOMINATING PETITION SIGNED BY A NUMBER OF ELIGIBLE ELECTORS
17 EQUAL TO THE LESSER OF FIFTEEN HUNDRED SIGNERS OR TWO PERCENT OF
18 THE VOTES CAST IN THE MOST RECENT GENERAL ELECTION FOR ALL
19 CANDIDATES FOR THE AT-LARGE MEMBER OF THE STATE BOARD OF
20 EDUCATION.
21 (3) PETITIONS FOR NOMINATING STATE BOARD OF EDUCATION
22 MEMBERS SHALL COMPLY WITH THE REQUIREMENTS OF PART 9 OF THIS
23 ARTICLE.
24 (4) PETITIONS SHALL BE FILED WITH THE SECRETARY OF STATE NO
25 LATER THAN 3 P.M. ON THE FIFTY-FIFTH DAY PRECEDING THE DATE OF THE
26 ELECTION.

1 SECTION 3. 1-4-502 (1), Colorado Revised Statutes, is amended
2 to read:
3 1-4-502. Methods of nomination for partisan candidates.
4 (1) Nominations for United States senator, representative in congress,
5 governor, lieutenant governor, secretary of state, state treasurer, attorney
6 general, member of the state board of education, regent of the university
7 of Colorado, member of the general assembly, district attorney, and all
8 county officers to be elected at the general election may be made by
9 primary election by major political parties, by petition for nomination of
10 an unaffiliated candidate as provided in section 1-4-802, or by a minor
11 political party as provided in section 1-4-1304 (2).
12 SECTION 4. 1-4-802 (1) (c) (III), Colorado Revised Statutes, is
13 amended to read:
14 1-4-802. Petitions for nominating unaffiliated candidates for
15 a partisan office. (1) Candidates for partisan public offices to be filled
16 at a general or congressional vacancy election who do not wish to affiliate
17 with a political party may be nominated, other than by a primary election
18 or a convention, in the following manner:
19 (c) Every petition for the office of president and vice president,
20 for statewide office, for congressional district office, for the office of
21 member of the general assembly, for district attorney, and for county
22 office shall be signed by eligible electors residing within the district or
23 political subdivision in which the officer is to be elected. The number of
24 signatures of eligible electors on a petition shall be as follows:
25 (III) The lesser of eight hundred or two percent of the votes cast
26 in the congressional district in the most recent general election for the

1 office of member of the United States house of representatives member
2 of the state board of education for a congressional district, or member of
3 the board of regents of the university of Colorado for a congressional
4 district;
5 SECTION 5. Effective date. This act shall take effect at 12:01
6 a.m. on the day following the expiration of the ninety-day period after
7 final adjournment of the general assembly that is allowed for submitting
8 a referendum petition pursuant to article V, section 1 (3) of the state
9 constitution; except that, if a referendum petition is filed against this act
10 or an item, section, or part of this act within such period, then the act,
11 item, section, or part, if approved by the people, shall take effect on the
12 date of the official declaration of the vote thereon by proclamation of the
13 governor.
