Concerning reimbursements to the Colorado state patrol for costs incurred in mitigating a hazardous substance incident.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. 29-22-104 (3), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW PARAGRAPH to read:
29-22-104. Right to claim reimbursement. (3) (d) All moneys collected or recovered pursuant to the provisions of this section on behalf of the Colorado state patrol, except for moneys distributed to assisting agencies pursuant to paragraph (b) of this subsection (3) or to pay legal fees or costs pursuant to paragraph (c) of this subsection (3), shall be transmitted to the state treasurer who shall credit the same to the highway users tax fund established in section 43-4-201, C.R.S.
SECTION 2. Effective date - applicability. This act shall take effect upon passage and shall apply to moneys collected on or after said date.
SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
