A BILL FOR AN ACT
101 CONCERNING REVENUES ALLOCATED TO THE CAPITAL CONSTRUCTION
102 FUND FOR STATE HIGHWAY PROJECTS, AND MAKING AN
103 APPROPRIATION IN CONNECTION THEREWITH.
Bill Summary

Directs that an additional $100 million be transferred out of the
general fund and into the capital construction fund on July 1, 1999, and
that such additional moneys be used exclusively for state highway
reconstruction, repair, maintenance, and capacity expansion projects.
Makes an appropriation.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 24-75-302 (2) (l), Colorado Revised Statutes, is
3 amended to read:
4 24-75-302. Capital construction fund - capital assessment fees
5 - calculation. (2) As of July 1, 1988, and July 1 of each year thereafter
6 through July 1, 2002, a sum as specified in this subsection (2) shall accrue
7 to the capital construction fund. The state treasurer and the controller
8 shall transfer such sum out of the general fund and into the capital

1 construction fund as moneys become available in the general fund during
2 the fiscal year beginning on said July 1. Transfers between funds
3 pursuant to this subsection (2) shall not be deemed to be appropriations
4 subject to the limitations of section 24-75-201.1. The amount which shall
5 accrue pursuant to this subsection (2) shall be as follows:
6 (l) (I) On July 1, 1999, one TWO hundred million dollars, plus
7 three hundred twenty-three thousand nine hundred ninety-eight dollars
8 pursuant to H.B. 97-1186, enacted at the first regular session of the
9 sixty-first general assembly; plus three thousand eight hundred forty
10 dollars pursuant to S.B. 98-021, enacted at the second regular session of
11 the sixty-first general assembly;
12 (II) OF THE AMOUNT THAT ACCRUES TO THE CAPITAL
13 CONSTRUCTION FUND PURSUANT TO SUBPARAGRAPH (I) OF THIS
14 PARAGRAPH (l), AT LEAST ONE HUNDRED MILLION DOLLARS SHALL BE
15 APPROPRIATED FOR STATE HIGHWAY RECONSTRUCTION, REPAIR,
16 MAINTENANCE, AND CAPACITY EXPANSION PROJECTS;
17 SECTION 2. 2-3-1304 (1) (a.5), Colorado Revised Statutes, is
18 amended to read:
19 2-3-1304. Powers and duties of capital development
20 committee. (1) The capital development committee shall have the
21 following powers and duties:
22 (a.5) To study the capital construction request from the
23 transportation commission for state highway reconstruction, repair, and
24 maintenance projects to be funded from money transferred to the capital
25 construction fund pursuant to section 24-75-302 (2), C.R.S., specifically
26 for such purpose. On or before October 1 of each year, the transportation

1 commission shall submit its capital construction request, based on the
2 statewide transportation improvement programs, with a prioritized list of
3 recommended state highway reconstruction, repair, and maintenance
4 projects with the priority of projects on the list determined on the basis of
5 greatest need without regard to location in the state; except that, for the
6 1998-99 1999-2000 fiscal year, the prioritized list of projects to be funded
7 by the revenues appropriated for such year by House Bill 98-1202 HOUSE
8 BILL 99-___, as enacted at the second FIRST regular session of the
9 sixty-first SIXTY-SECOND general assembly, shall consist only of state
10 highway reconstruction, repair, maintenance, and capacity expansion
11 projects. The capital development committee shall determine the number
12 of projects on the list that may be funded from money available in the
13 capital construction fund for state highway reconstruction, repair, or
14 maintenance projects. Only projects on the list may be funded from
15 money available in the capital construction fund for state highway
16 reconstruction, repair, or maintenance projects, and the projects must be
17 funded in the priority determined by the transportation commission.
18 Projects on the list submitted by the transportation commission by
19 October 1 may be funded from money transferred to the capital
20 construction fund and available in the current fiscal year or money to be
21 transferred to the capital construction fund for the fiscal year beginning
22 the following July 1.
23 SECTION 3. Capital construction appropriation. The sum of
24 one hundred million dollars ($100,000,000) is hereby appropriated out of
25 the capital construction fund to the department of transportation for state
26 highway reconstruction, repair, maintenance, and capacity expansion

1 projects included on the prioritized list of projects submitted by the
2 transportation commission to the capital development committee pursuant
3 to section 2-3-1304 (1) (a.5), Colorado Revised Statutes. The
4 appropriation made by this section shall become available to the
5 department on July 1, 1999, and the appropriation shall remain available
6 until completion of all the projects or for a period of three years,
7 whichever comes first, at which time the unexpended and unencumbered
8 balance shall revert to the capital construction fund.
9 SECTION 4. Safety clause. The general assembly hereby finds,
10 determines, and declares that this act is necessary for the immediate
11 preservation of the public peace, health, and safety.
