A BILL FOR AN ACT
101 CONCERNING A PROHIBITION ON OVERTAKING ANOTHER MOTOR VEHICLE
102 WHILE IN A SCHOOL ZONE.
Bill Summary

Prohibits a driver of a vehicle from passing another vehicle that is
proceeding in the same direction while the vehicles are in a school zone.
Prohibits a driver of a vehicle from passing on the right while in
a school zone.
Prohibits a vehicle from being driven on the left side of the
roadway while in a school zone.
1 Be it enacted by the General Assembly of the State of Colorado:
2 SECTION 1. 42-4-1003, Colorado Revised Statutes, is amended
3 BY THE ADDITION OF A NEW SUBSECTION to read:
4 42-4-1003. Overtaking a vehicle on the left.
5 (1.5) NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE
6 CONTRARY, NO DRIVER OF A VEHICLE SHALL OVERTAKE AND PASS
7 ANOTHER VEHICLE THAT IS PROCEEDING IN THE SAME DIRECTION WHILE
8 THE VEHICLES ARE WITHIN A SCHOOL ZONE DESIGNATED AS SUCH
9 PURSUANT TO SECTION 42-4-615 AND POSTED WITH THE APPROPRIATE

2 SECTION 2. 42-4-1004 (2), Colorado Revised Statutes, is
3 amended to read:
4 42-4-1004. When overtaking on the right is permitted. (2) The
5 driver of a vehicle may overtake and pass another vehicle upon the right
6 only under conditions permitting such movement in safety. In no event
7 shall such movement be made by driving off the pavement or
8 main-traveled portion of the roadway, OR WHILE WITHIN A SCHOOL ZONE
9 DESIGNATED AS SUCH PURSUANT TO SECTION 42-4-615 AND POSTED WITH
10 THE APPROPRIATE SIGNS.
11 SECTION 3. 42-4-1005 (2) (b) and (2) (c), Colorado Revised
12 Statutes, are amended, and the said 42-4-1005 (2) is further amended BY
13 THE ADDITION OF A NEW PARAGRAPH, to read:
14 42-4-1005. Limitations on overtaking on the left. (2) No
15 vehicle shall be driven on the left side of the roadway under the following
16 conditions:
17 (b) When approaching within one hundred feet of or traversing
18 any intersection or railroad grade crossing; or
19 (c) When the view is obstructed upon approaching within one
20 hundred feet of any bridge, viaduct, or tunnel; OR
21 (d) WHEN APPROACHING WITHIN A SCHOOL ZONE DESIGNATED AS
22 SUCH PURSUANT TO SECTION 42-4-615 AND POSTED WITH THE
23 APPROPRIATE SIGNS.
24 SECTION 4. Safety clause. The general assembly hereby finds,
25 determines, and declares that this act is necessary for the immediate
26 preservation of the public peace, health, and safety.
