TITLE:            CONCERNING LIMITATIONS ON THE AUTHORITY OF A POLITICAL SUBDIVISION TO BRING SUIT.



Summary of Assessment


            The bill adds a new Part 8 to Article 20 of Title 13, concerning actions against firearms or ammunition manufacturers, dealers, or trade associations. The legislative declaration states that the lawful design, marketing, or manufacture of firearms and ammunition and the lawful sale of firearms and ammunition to the public is not an unreasonably dangerous activity and does not constitute a nuisance.


            Proposed Section 802 reserves to the State of Colorado the right to sue any firearms or ammunition manufacturer or dealer or any firearms trade association in any action arising from the lawful design, manufacture, marketing, or sale of firearms and ammunition to the public. Subsection (2) states that political subdivisions are not prohibited from bringing an action against a firearms or ammunition manufacturer or dealer for breach of contractor warranty relating to firearms or ammunition purchased by the political subdivision. The bill will become effective upon the signature of the Governor.


            This bill will not affect state or local government revenue or expenditures. Therefore, it is assessed as having no fiscal impact.
