Summary of Legislation


            The bill would require the Department of Transportation (DOT) to notify by first class mail or personal delivery all persons who reside within 500 feet of a construction project. The DOT would also be required to publish the notification in a newspaper of general circulation in the counties where the project is being constructed.



State Expenditures


            The DOT currently publishes a notice in a newspaper in the counties affected by a construction project. This provision would not have a fiscal impact to the department. The mailing of a first class notice or the personal notification would have a fiscal impact on the DOT. The DOT conducts approximately 200 construction projects annually. The DOT would have costs of determining who resides within the construction project area, postage for the notices, or staff time to personally notify the resident. For some projects, this cost would be minimal, for other projects the cost could be significant. The DOT currently has spending authority for this purpose. The cost for this notification process would be added to the total project cost.
