Summary of Legislation
This bill revises statutes governing county planning and building codes by:
• allowing registered electors who reside or own property in an unincorporated area of a county that is not subject to zoning or building code regulations to file a petition to refer any county resolution to impose such regulations upon the area to a vote;
• allowing the registered electors who reside or own property in the area to vote in the election;
• specifying the filing period and allowing the petition to be submitted at a November general election or a special election;
• specifying the referendum petition process only applies to counties with a population in excess of 100,000 and at least 25.0 percent of the unincorporated area is not subject to certain zoning regulations or building codes;
• allowing an exemption in the event the owners of land included in the area have agreed in writing to the imposition of the regulation; and
• requiring a ballot issue notice to be prepared and distributed in a manner similar to matters arising under Section 20 of Article X of the State Constitution.
Local Government Impact
This bill allows for a petition for the imposition of new county zoning or building code regulations to be submitted at a November general election or a special election. If such a petition is successfully filed, the county would incur additional election expenses. The costs of a special election for a certain area of a county are estimated to be more than the costs associated with placing a question on the ballot of a general election on a cost per voter basis. If the voters were to approve the question, the county may incur additional administrative expenses to adopt, implement, and enforce zoning and building code regulations for that area. These costs may be significant, depending on the size and location of the area, in that the county could require additional personal service resources.

This fiscal note would imply no new state appropriations are required for FY 1999-2000.
