TITLE:            CONCERNING THE RESTRUCTURING OF THE STATE BOARD OF NURSING, AND, IN CONNECTION THEREWITH, CREATING PANELS TO INVESTIGATE, ADJUDICATE, AND PERFORM LICENSING FUNCTIONS.



Summary of Assessment


            This bill makes changes to the regulation of the State Board of Nursing, Division of Registrations, Department of Regulatory Agencies. It restructures the board, providing for the election of a president and creating two panels of five members each to facilitate licensing and to act as both an inquiry and a hearings panel for complaints filed against nurses and psychiatric technicians. It prohibits the panel that investigates the complaint to adjudicate the complaint. It also replaces existing provisions on disciplinary procedures. The bill would become effective July 1, 1999, and would apply to all investigations, complaints, and hearings on or after said date.


            The changes to the structure of the board will not affect the number of applications or complaints received and processed. Any increases in operating costs of the board will be offset by decreases in other operating costs. The bill will not affect any other state agency, or unit of local government. Therefore, the bill is assessed as having no fiscal impact.
