TITLE:            CONCERNING THE AWARD OF COSTS IN ACTIONS FOR NUISANCE AGAINST AGRICULTURAL OPERATIONS.

Summary of Assessment

            This bill requires a court to award expert fees, court costs, and reasonable attorney fees to the prevailing party in any action seeking to assert that an agricultural operation is a public or private nuisance. The bill will become effective on July 1, 1999.

            This bill does not affect state or local government revenue or expenditures. Therefore, the bill is assessed as having no fiscal impact.
