Summary of Legislation
The reengrossed bill would require that out of the fifty percent share of limited gaming proceeds that are currently available to be transferred to the state General Fund, or other such funds as the General Assembly may provide, an additional 10.0 percent would annually be transferred to the Municipal Limited Gaming Impact Fund for the infrastructure needs of the cities of Central, Black Hawk, and Cripple Creek for planning, construction, and maintenance of public facilities and for the provision of public services. The moneys would be spent by the governing bodies of these cities in a manner that considers the historic nature of the cities.
The bill would reduce the amount of moneys from limited gaming proceeds that would otherwise be available for transfer to the General Fund. The bill would increase the money available for distribution from the Municipal Limited Gaming Impact Fund by the same amount. Therefore, the bill is assessed as having state and local fiscal impact.
State Revenues
The bill would reduce the amount of moneys that would otherwise be available to the state General Fund. Since the bill is effective upon signature of the Governor (and the bill would become law prior to June 30, 1999), it is assumed that the change in the distribution will also apply to the current fiscal year (FY 1998-99) distribution. Based on the estimates of gaming revenue, the Division of Gaming estimates that the bill will reduce General Fund revenues by $3,151,905 in FY 1998-99, and by $3,368,091 in FY 1999-00 and FY 2000-01. Gaming revenue estimates for FY 2000-01 are not yet available. The Municipal Limited Gaming Impact Fund would be increased by a corresponding amount.
State Expenditures
The bill would make additional revenue available from the Municipal Limited Gaming Impact Fund beginning in FY 1998-99 for distribution to the governing bodies of Central City, Black Hawk, and Cripple Creek for planning, construction, and maintenance of public facilities and for the provision of public services.
Local Government Impact
Currently, the governing bodies of Central City, Black Hawk, and Cripple Creek are not eligible to receive distributions from the Municipal Limited Gaming Impact Fund. The bill would make additional funds available to the three cities. The moneys would be distributed by the Local Government Limited Gaming Impact Advisory Committee based on the following criteria:
• the financial need of the city to alleviate the infrastructure impacts created by gaming in an historic setting;
• the number of citizens living within the city limits affected by gaming and requiring municipal services; and
• the historic nature and preservation needs of the city.
State Appropriations
The bill authorizes the State Treasurer to transfer additional funds to the Municipal Limited Gaming Impact Fund based on a formula. No other appropriations would be required to implement the bill.
